Abstract

One day minutation ialah minutasi perkara pada hari yang sama dengan putusan dibacakan. Dengan kata lain, dapat diartikan bahwa proses yang dilakukan panitera pengadilan dalam menyelesaikan proses administrasi meliputi pengetikan, pembundelan serta pengesahan suatu perkara dilakukan dalam satu hari yang sama setelah putusan dibacakan oleh majelis hakim. Penulis menjelaskan pada bagian ini mengenai latar belakang one day minutation dan prosedur minutasi. Metode penelitian ini adalah penelitian lapangan yaitu field research kualitatif  deskriptif dengan pendekatan penelitian yang digunakan ialah Pendekatan Teologi Normatif syar’i. Lokasi dan objek penelitian ini dilakukan di Pengadilan Agama Manado Kelas 1A.Hasil penelitiannya menunjukkan bahwa Prosedur minutasi di Pengadilan Agama Manado sudah tertuang dalam SOP (standar operasional prosedur) Minutasi Satu Hari yang didalamnya menjelaskan tahapan-tahapan proses minutasi di Pengadilan Agama Manado. Berdasarkan SOP Minutasi Satu Hari, proses minutasi membutuhkan waktu sekitar 47 menit untuk setiap perkara,  dengan ketentuan berkas telah dipilah dan disusun serta BAS (berita acara sidang) telah dibuat dengan sempurna dan ditandatangani. Adanya durasi waktu minutasi tersebut, menandakan bahwa Pengadilan Agama Manado telah mengimplementasikan program one day minutation yang telah dicanangkan oleh Dirjen Badilag, meskipun pencapaiannya belum optimal sesuai dengan harapan Dirjen Badilag dan Mahkamah Agung.

Abstract

Polemik kekuasaan adalah perdebatan sengit yang terjadi karena adanya sebuah kemampuan seseorang untuk mempengaruhi individu atau kelompok dalam hal ini pemerintah dan Masyarkat. Dalam kehidupan bermasyarakat di mana pemerintah ada pasti ada masyarakat yang akan mengikuti aturannya. Dalam Prespektif hukum Islam yaitu mengena Aturan bagaimana cara mendamaikan sesuai undang-undang dan prinsip-prinsip Islam. Dengan demikian sangat penting diperhatikan bagaimana penyebab, pencegahan, dan padangan hukum Islam. Metode penelitian ini adalah penelitian lapangan dengan pendekatan penelitian adalah: Pendekatan sosiologis, pendekatan syariah, dan pendekatan yuridis. Hasil penelitian ini menyimpulkan yaitu Polemik kekuasaan yang muncul karena adanya kesenjangan sosial yang terjadi antara pemerintah dengan masyarakat sehingga timbul lah prilaku yang tak sepantasnya yang berlaku dalam kehidupan bermasyarakat. Tentang sumber kekuasaan, harus menegaskan rakyat adalah sumber kekuasaan bagi pemerintah. Rakyatlah yang mengangkat dan yang mempunyai hak memaksa pemerintah dalam pandangan Islam dalam lapangan politik, kekuaasaan tertinggi di sebut kedaulatan) ada di tangan Allah Swt; manusia hanya sebagai pelaksana kedaulatan itu. Implikasi penelitian adalah diharapkan kepada Pemerintah sering melakukan sosialisasi di kecamatan agar mempunyai hubungan jalinan antara masyarakat membaik dan terbentuknya kerja sama dalam berbagai aspek dalam kehidupan bermasyarakat.Kata kunci : Kekuasaan; Polemik Masyarakat; hukum Islam

Abstract

Penelitian ini ingin melihat sejauhmana transaksi tersebut sesuai dengan konsepsi hukum Islam terutama teori-teori mas}lah}ah. Penelitian ini adalah penelitian kualitatif dengan pendekatan yuridis normatif serta teori-teori hukum Ekonomi Syariah, sehingga transaksi perdagangan di wilayah perbatasan dapat ditinjau dari kedua pendekatan teori tersebut. Hasil penelitian ini menunjukkan bahwa ada beberapa bentuk perdagangan di wilayah perbatasan di Kabupaten Sambas Kalimantan Barat diantara: Perdagangan dengan pemesanan barang, pemesanan barang ini dilakukan oleh para pembeli dari Malaysia yang memesan barang kepada pedagang Indonesia di pasar Temajuk. Mekanisme pemesanan barang ini yaitu dengan pemberian uang panjar. Sesuai dengan spesifikasi barang yang dipesan. Dalam hukum Islam dinamakan dengan ba’i salam,  dan ba’i salam telah sesuai dengan aspek-aspek transaksi di sistem Muamalah. Diantara bentuk transaksi perdagangan di wilayah perbatasan lainnya yaitu perdagangan mata uang asing atau biasa disebut dengan jual beli s}arf. Perdagangan mata uang ini dilakukan antara pembeli dan penjual. Hal ini terjadi disebabkan pembeli dari Malaysia menggunakan mata uang Ringgit. Apabila pembelian tersebut terdapat sisa pengembalian maka penjual akan mengembalikannya dengan mata uang Rupiah. Oleh karena itu, disamping para pedagang tersebut menjual barang dagangannya, mereka juga sembari menjual mata uang Rupiah kepada  pembeli dari Malaysia, dengan kurs yang mereka sepakati.

Abstract

Tulisan ini akan mendeskripsikan peran dosen wanita UIN Alauddin Makassar dalam mewujudkan keluarga sakinah. Penelitian ini merupakan penelitian lapangan (field research) dengan jenis penelitian kualitatif deskriptif yang bertujuan mendeskripsikan pandangan dosen wanita UIN Alauddin Makassar tentang keluarga sakinah dan kontribusinya dalam mewujudkan keluarga sakinah. Lokasi penelitian ini di UIN Alauddin Makassar. Sumber data diambil hasil wawancara dengan beberapa dosen wanita di UIN Alauddin Makassar. Metode pengumpulan data yang digunakan adalah observasi, wawancara dan dokumentasi. Instrumen yang digunakan dalam bentuk peneliti sebagai instrumen utama, panduan wawancara, serta alat pendukung lainnya seperti kamera dan alat tulis. Teknik pengolahan data mulai pengumpulan data, reduksi data, mengatur data, dan memverifikasi data. Uji validasi data menggunakan teknik triangulasi. Hasil penelitian ini menunjukkan bahwa dosen wanita UIN Alauddin Makassar memandang keluarga sakinah sebagai sebuah keluarga yang bukan saja telah mapan secara rohani, ekonomi, dan sosial, melainkan juga telah mampu berkontribusi terhadap lingkungan sekitar bahkan masyarakat. Hal ini sejalan dengan konsep keluarga sakinah III plus menurut Kementerian Agama.Hambatan dalam usaha mempertahankan kesakinahan rumah tangga yaitu terbatasnya waktu untuk berkumpul bersama keluarga, dan kesibukan atau padatnya jam kerja diluar rumah, dan kedua hal ini saling berkaitan satu sama lain. Guna mengatasi hambatan tersebut para dosen wanita UIN Alauddin Makassar memilih untuk bersikap positif dan memanfaatkan secara maksimal waktu yang ada untuk keluarga, dan senantiasa membangun komunikasi dengan keluarga baik itu di dalam rumah maupun di luar rumah. Kontribusi dosen wanita UIN Alauddin Makassar terhadap pembentukan keluarga sakinah melalui empat aspek, yakni aspek agama, ekonomi, sosial, dan psikologis. Kontribusi mereka di aspek agama ditunjukkan melalui keterlibatan mereka dalam kegiatan-kegiatan agamis di dalam rumah tangga. Di aspek ekonomi, kontribusi mereka sangat nyata karena mereka telah menjadi salah satu pilar ekonomi rumah tangga. Di aspek sosial, mereka telah berhasil menaikkan status sosial rumah tangga dengan profesi mereka sebagai pendidik. Di aspek psikologis, segala konsekuensi positif dari profesi mereka sebagai pendidik telah membebaskan rumah tangga mereka dari perasaan inferior (minder) dan menghadirkan rasa bersyukur.

Abstract

The purpose of this study is to find out the various factors that cause divorce due to domestic violence in Sinjai Regency and to describe how to resolve divorce due to domestic violence in Sinjai Regency and to elaborate on how divorce due to domestic violence is from an Islamic legal perspective. This research is a qualitative descriptive field research, taking place in Sinjai Regency. The approach used is a normative theological approach, a juridical approach and a sociological approach. The data collection obtained in the field with the technique of observation, interviews / interviews and documentation. The collected data is then processed using data reduction analysis, data presentation and conclusion drawing. Furthermore, by linking one of the theories of Islamic law, namely the theory of existence and competence of religious courts, the process of resolving divorce cases due to domestic violence in Sinjai Regency, which in this case is the authorized and entitled institution in resolving it, namely the Sinjai level I religious court, goes through several stages. namely through table I, table II and table III. However, before the plaintiffs and defendants seek justice, the panel of judges first has the obligation to mediate/advise both parties, in which the panel of judges makes every effort to provide the best advice or solution to the plaintiff or defendant. And Islamic law does not legalize violence against wives. Beating a wife who does nusyuz as contained in QS al-Nisa` verse 34 should be interpreted as an act to teach a lesson / for obedience, not to hurt or even do violence. The beatings carried out in the case of nusyuz basically should not injure. Meanwhile, the husband's act of hitting his wife until he is injured or the husband's violence against his wife can be declared as nusyuz of the husband against his wife. Furthermore, related to divorce due to domestic violence in Sinjai Regency which is analyzed from the perspective of Islamic law, the researcher connects one of the theories of Islamic law that applies in Indonesia to date, namely the theory of existence and competence of the Sinjai religious court which refers to the compilation of Islamic law or Islamic law. Abstract

Salah satu pemikiran Imam Abu Hanifah adalah penetapan dalam transaksi perjanjian salam yang sangat menekankan kepercayaan untuk mencegah pihak-pihak bertransaksi dari transaksi yang merugikan pihak-pihak yang bersangkutan dengan merumuskan ketegasan dalam proses penawaran dalam kelangsungan perjanjian. perjanjian transaksi yang mirip dengan salam, yaitu kesepakatan jual beli online baik berdasarkan media sosial maupun e-commerce. Aktivitas jual beli online merupakan praktik jual beli yang banyak dilakukan generasi milenial saat ini dari berbagai kalangan termasuk generasi muda muslim juga tertarik dengan kemudahan jual beli secara online. Penelitian ini menggunakan penelitian pustaka dengan menela’ah pemikiran imam Abu Hanifah terkait akad jual beli salam melalui kita-kitab fiqih, artikel, karya ilmiah, dan dokumentasi terkait dengan pendekatan sosiologis dengan melihat aktivitas jual beli online generasi milenial muslim berdasarkan asas yang ditetapkan imam Abu Hanifah dalam sistem jual beli salam. Ditemukan bahwa aktivitas jual beli online yang terjadi di kalangan generasi milenial telah sesuai dengan asas yang ditetapkan oleh Imam Abu Hanifah dalam transaksi salam. Walaupun demikian, harus dibarengi dengan kejujuran dan kredibilitas para pihak agar menghindarkan diri dari kerugian masing-masing pihak,

Abstract

Qadzf ikhtilath jinayah an act that is set up in Aceh Qanun No. 6 of 2014 concerning jinayah, Qadzf ikhtilath are accusing others of committing ikhtilath or two-pair, and making out. The type of research used is library research (library research) Accusing others of committing acts of ikhtilath, including intentional acts because they have intended and done those acts. Although berikhtilat is forbidden in religion but do not accuse others. Exxon ikhtilath in Aceh in accordance with canon law if it could not prove the act of the accused offender qadzf will be chargedcaning and a fine of 30 times the gold. The accuser is also obliged to bring 4 witnesses at the same time if the accuser is unable to bring witnesses then the accuser will also be under the law of ta'zir. Witnesses who must be present must not come alone because they will be declared as accusers so the witnesses who must be present must come together. And the perpetrator of qadzf ikhtilath will lose his sentence if the accused person admits his robbery, so the one who gets the punishment is the person who is accused because he has admitted his deeds. To avoid the act of qadzf ikhtilath has been regulated in Law No.6 of 2014 on Crimes as a warning to the perpetrators not to hurt others and protect the community who are the victims of the accusation.

Abstract

Administration and supervision are supporting tools for achieving educational goal. Likewise also the purpose of school education can also be achieved if there is a systimatic and continous administration and super vision activities. Super vision theory from perspective of the approachused begins with directive supervision. But after seeing the axxistence of supervision ineffctiveness, the directive then emerged the teory of non directive supervision.   But, after seeing the existence of supervision ineffectiveness, the directive then emerged the theory of non directive supervision. The ineffectiveness of directive supervision because directive supervision does not give teachers the opportunity to develop their abilities aand creativity, full responsibility is on the supervisor, so the supervisor is dominnt. This is one of the factors behind the birth of the ssupervisor directive.

Abstract

The implementation of the pilgrimage in the mid-19th century experienced a significant increase. Various purposes and activities they do while in the holy land. Hajj is a means of communication between a servant and his Creator. This worship was first prescribed in the sixth year of the Hijrah. The word al-Hajj according to language means intentional. Therefore, according to the term Islamic shari'a, it means deliberately visiting the Ka'bah in Mecca to perform several series of acts of worship according to the pillars and conditions that have been determined by syara'. Hajj is the fifth pillar of Islam and the fourth point of worship, which is ordered after the three previous points of worship are prescribed, namely: prayer, fasting in Ramadan, and zakat. Hajj has many roles and many benefits. This study is examined by looking at the contribution of the Hajj in various social fields that occur after performing the worship for the people in Indonesia.

Abstract

Every child certainly has the same rights in terms of inheritance and others, mistakes made by both parents should not have an impact on children who are victims of immoral acts or adultery of both parents. Every human being has the same rights in the eyes of the law, whether Islamic law or positive law and it is regulated in the law so that in determining the inheritance status of a child born as a result of adultery, if born at the age of marriage of at least 6 (six) months, the child can follow the lineage of the father and the rights to inherit the property. It is also explained in articles 100 and 186 of the Compilation of Islamic Law which means that children from the consequences of adultery have the rights to inherit if they are born in a marital relationship
