Abstract

In welcoming 2019 concurrent general elections, the General Election Commission issued PKPU No. 20 of 2018, one of which banned former convicts of corruption from becoming legislative candidates on the grounds that corruption is an extraordinary offense that is commonly practiced by legislators both individually and in congregation. The regulation is stated in Article 4 paragraph (3) PKPU No. 20 of 2018 concerning Nominations for Members of DPR, Provincial DPRD and Regency / City DPRD. However, the regulation was canceled with the issuance of Supreme Court decision No. 46 P / HUM / 2018. Based on this, the limitation of the problem of this research is how to measure the aspects of the legal objectives behind the decision No. 46 P / HUM / 2018 which are more pro-corrupt so that they can understand the judge's decidendi ratio in canceling the prohibition of ex-convicts from becoming legislators. This type of research is normative legal research with a statutory approach and conceptual approach. The theoretical basis in the presentation of research results is the theory of legal goals by Gustav Radbruch namely justice, certainty and usefulness which is compared with Islamic law. The results of this study indicate that the Supreme Court's consideration overturned PKPU No. 20 of 2018 because it is considered contrary to Article 240 of Law No. 7 of 2017 concerning General Elections and Article 12 of Law No. 12 of 2011 concerning Formation of Laws and Regulations. The Supreme Court's considerations in the a quo ruling contain the three legal objectives. However, it is more inclined to legal certainty, so it does not reflect the value of justice that lives in the community. The cause of not achieving the values of justice that live in the community in the a quo decision is because the basis for testing the regulation is Law No. 7 of 2017 concerning General Elections does not prohibit such matters, even though the nomination rules on the executive body namely the President and Vice President require that they do not have a bad track record. Likewise when viewed from Islamic law which requires legislative candidates called ahlul ahli wal aqdi must have a fair way which means having integrity and a good image in the society.

Abstract

AbstractIntegration of Islamic law and customary law of inheritance that run in the Bugis community in District Palakka Bone takes place in the form of assimilation, syncretic, acculturative, and legitimacy. Integration in a syncretic form can be seen in the division of inheritance society that make Islamic law and customary law as a reference. Integration in the form acculturative can be seen at the time of the division of property, there is executed before the death, and there is also carried out after the death of the testator. The integration in the form of legitimacy can be seen from the case of the division of inheritance community continue to provide part of property to the son of the heir who had died earlier than the heir known as substitute heirs. Integration of Islamic law and customary law apply to the division of the community estate Bugis Bone in District Palakka namely because: a. between Islamic law and customary law have interacted for a long time, complementary in addressing the legal needs of the community, b. Islamic law and customary law used as a reference and a major cornerstone in the division of the community estate, c. Islamic law and customary law into the legal awareness of the public to follow both of these rules. d. between Islamic law and customary law have a common vision and goal to bring peace to people's lives.

Abstract

Tulisan ini membahas tentang konsep pemerintahan daerah dalam kaitannya dengan daerah kepulauan dengan menggunakan pendekatan konseptual. Tulisan ini berangkat dari sebuah pemikiran bahwa daerah kepulauan merupakan bagian dari Negara Kesatuan Republik Indonesia, sehingga perlu adanya penanganan pelayanan publik yang berbasis kekhususan tentunya yang berada di daerah kepulauan. Pemerataan pelayanan publik dimulai dengan menggeser makna urusan pemerintahan konkuren yang tertuang dalam Undang-Undang Nomor 23 Tahun 2014 tentang Pemerintahan Daerah yang mana dalam substansinya sangat bersifat rigid dalam pengaturannya, sehingga dibutuhkan pergeseran makna konkuren khusus untuk daerah kepulauan agar tercipta sebuah keseimbangan pelayanan publik yang bisa dirasakan masyarakat yang berada di daerah kepulauan. Pemaknaan urusan pemerintahan konkuren terhadap daerah kepulauan berangkat dari pendekatan pelayanan publik yang dimulai dari daerah non kepulauan yang menjadi penghubung antar pulau dengan memusatkan pelayanan pada daerah kepulauan yang memiliki jangkauan akses terdekat dari pulau-pulau kecil yang ada di daerah kabupaten/kota yang mana tujuan akhirnya akan memberikan kemudahan dalam hal pelayanan publik dan menjadikan daerah kepulauan sebagai satu kesatuan yang integratif. Percepatan proses pembangunan daerah-daerah kepulauan menjadi hal yang mutlak dilakukan oleh pemerintah dan pemerintah daerah demi mewujudkan kesejahteraan masyarakat khususnya yang berada di daerah kepulauan.Kata-kata Kunci: Konkuren, Pemerintahan Daerah, Daerah Kepulauan

Abstract

Child marriage remains a persistent issue in Bone County, as evidenced by the high number of cases reported in 2019. While there has been some reduction in child marriage due to government intervention and Unicef cooperation in select villages, the problem persists. NU Muslimat has implemented various strategies to raise awareness and prevent child marriage to combat this. The study employed the ABCD method and found that community service effectively raised awareness among majelis taklim members and their children. Furthermore, the da'iyah training produced professionals capable of counseling against child marriage, while the peer tutor training involved individuals who conducted counseling sessions and created awareness materials. As a result of these interventions, members of the community and students expressed strong determination to avoid child marriage, demonstrating the positive impact of NU Muslimat's initiatives.
