Abstract

What is very important in the sustainable management of coastal marine areas is the involvement of local communities from planning to implementation. This study aims to explain that community-based and sustainable management of coastal marine areas in North Kalimantan is the most ideal coastal management model. This type of research is the normative legal research method with qualitative analysis. The results showed the benefits of community-based and sustainable management of the coastal marine area of ​​North Kalimantan in improving the welfare of coastal communities because it is based on the potential and characteristics of the coastal marine area. Abstract

Adultery is a religious and legal prohibition against sexual intercourse between men and women without a legal marriage. It applies to individuals in religion, culture, and society. This research will discuss how the legal review of the criminal offense of adultery in Indonesia and how it is implemented in legal practice.The research method used is normative juridical legal research and approach through legislation.The results of this study explain that the criminal offense of adultery is regulated in the Criminal Code as a complaint offense. The legal review related to the criminal offense of adultery needs to clarify the practice of implementing the provisions in the Criminal Code against the perpetrators because it has not been able to provide a deterrent effect. In fact, the implementation of criminal regulations is not optimal due to the indifferent society towards norms, social values, and religion.

Abstract

This article explores the principles of Islamic inheritance law through a normative and conceptual approach, focusing on gender-based distribution and its alignment with the broader ideals of justice in Islamic legal thought. It analyzes classical juristic formulations, particularly the rule that assigns male heirs twice the share of females, in light of maqāṣid al-sharī‘ah and contemporary interpretations of gender justice. The study also compares these principles with customary inheritance practices in Indonesia, which emphasize social roles, flexibility, and deliberation-based distribution. The findings reveal an ongoing tension between the rigidity of classical fiqh and the evolving demands of justice in pluralistic and modern contexts. By synthesizing classical doctrines with maqāṣid-oriented reasoning and contextual ijtihād, the study demonstrates the potential for a more responsive and ethically grounded inheritance framework. This research contributes to the broader discourse on Islamic legal reform by highlighting how contextual reinterpretation of inheritance norms can reflect not only legal continuity but also the living spirit of sharī‘ah justice in addressing gendered realities.

Abstract

Pelatihan penyuluhan hukum bertujuan untuk meningkatkan pemahaman dan keterampilan peserta dalam menangani perkara hukum pidana dan perdata, mengingat kompleksitas masalah hukum yang dihadapi masyarakat saat ini. Kegiatan ini terdiri dari sesi teori, praktik, dan evaluasi yang dirancang untuk menciptakan lingkungan belajar yang interaktif dan produktif. Hasil pelatihan menunjukkan peningkatan signifikan dalam pemahaman peserta tentang prinsip-prinsip dasar hukum, serta keterampilan praktis dalam penanganan kasus melalui simulasi. Diskusi kasus dan tanya jawab memperkaya pemahaman peserta tentang tantangan yang dihadapi dalam praktik hukum sehari-hari, sekaligus menciptakan komunitas pembelajaran yang solid. Evaluasi akhir pelatihan menunjukkan pencapaian yang memuaskan, di mana peserta berhasil menerapkan pengetahuan yang diperoleh. Namun, tantangan tetap ada, termasuk keterbatasan dalam penerapan teori ke praktik yang lebih luas dan rendahnya pemahaman hukum di daerah terpencil. Rekomendasi untuk pengembangan program penyuluhan hukum yang lebih inklusif dan penggunaan teknologi dalam penyebaran informasi hukum diperlukan untuk meningkatkan literasi hukum di masyarakat.

Abstract

This study explores the legal strength and enforceability of prenuptial agreements under the Indonesian Civil Code (KUH Perdata) and examines how jurisprudential developments, particularly the Constitutional Court’s Decision No. 69/PUU-XIII/2015, have shifted the legal landscape. Historically, prenuptial agreements were only recognized if executed before marriage, limiting legal protection for couples facing economic, personal, or property changes after marriage. Through a normative juridical approach supported by case analysis, this research reveals that the Constitutional Court’s decision has expanded the legal understanding of contractual freedom by allowing postnuptial agreements. Despite this progressive development, the implementation remains uneven due to inconsistencies in judicial interpretations, absence of procedural regulations, and social stigmas surrounding such agreements. The study concludes that a harmonized legal and administrative framework is necessary to ensure consistent enforcement and public acceptance. Prenuptial and postnuptial agreements, if properly regulated and socially acknowledged, can serve as important instruments for protecting individual rights and maintaining legal certainty in marital relationships.
