Abstract

The study aims to provide a constitutional analysis of judicial review (PK) in civil cases for more than once. The research-based is the decision of the Constitutional Court No. 108 / PUU-XIV / 2016 and No. 34 / PUU-XI / 2013 in which the two judgments provide a different classification between criminal and civil cases. The method used in this research is a normative juridical with a conceptual, legislation, and case approach. The results of the study assert that: first, the opportunity for judicial review (PK) more than once in a criminal case is an effort to uphold justice substantively by the Constitutional Court. Whereas the restriction of judicial review (PK) only once in civil cases is intended to guarantee legal certainty. Secondly, there is rational inconsistency in the arguments of the Constitutional Court which is indicated in Decision No. 108 / PUU-XIV / 2016 and No. 34 / PUU-XI / 2013. Both criminal and civil cases must seek to establish and maintain substantial justice, especially since there is a due process of law principle that requires that everyone can get the same opportunity before the law.

Abstract

This study purpose to describe the implementation of the principle of good governance in the justice system in Indonesia. It will also be explained in relation to the view of fiqh siyasah qadaiyyah in the application of the principle of good governance in the world of justice. The research method used is normative legal research, through a legislation and conceptual approach that is expected to be able to answer and provide a description of this research. The results of the study say that the application of the principle of good governance in the world of justice can begin by applying transparency and accountability in each court institution. In addition, fiqh siyasah  qodloiyah in Islamic justice also strongly recommends that judges always do justice and deliver the mandate as well as possible. Therefore, both in the Islamic court and the judiciary in Indonesia have both applied the principles and principles of good governance.

Abstract

Keterwakilan perempuan di parlemen diharapkan dapat melahirkan kebijakan yang berpihak pada perempuan. Harapan besar tersebut juga diamanatkan pada anggota legislatif perempuan di DPRD Jawa Timur. Artikel ini mengangkat isu hukum,  tentang keterwakilan perempuan anggota Legislatif dalam proses legislasi yang melahirkan kebijakan  perlindungan  perempuan dari tindak kekerasan. Untuk menjawab isu hukum tersebut digunakan metode penelitian hukum empiris dengan pendekatan socio legal studies. Hasil penelitian ini menunjukkan bahwa keterwakilan perempuan di DPRD Jawa Timur menghasilkan kebijakan yang berpihak pada perempuan, yaitu melalui produk hukum yang memberikan perlindungan terhadap perempuan dari tindak kekerasan yang semakin meningkat di masa pandemi covid-19. Proses legislasi yang dilakukan oleh anggota legislatif perempuan dalam melahirkan kebijakan perlindungan perempuan tidak lepas dari  hambatan budaya patriarki yang masih kuat di masyarakat; keterbatasan anggaran; serta minimnya keterwakilan perempuan di parlemen. Peran keterwakilan perempuan sangat dibutuhkan dalam meningkatkan IDG di Jawa Timur dalam mewujudkan demokrasi yang berkeadilan gender.

Abstract

This study aims to look at global legal standards that identify with ecological problems, especially the problem of natural security. The research method used is normative legal research with two main studies, namely the statutory approach and the conceptual approach. The results of the study show that the relationship between ecological law and general freedom law are interrelated and have an impact on each other, although there are many public and global instruments on natural insurance as a component of basic freedom security, there are still many ecological problems and damages. Especially for Indonesia's natural resilience, there are several government programs, one of which is the RANHAM program, planting 1,000,000 trees and efforts to local areas. Recognizing how important climate is as part of shared freedom, local areas must be more careful and pay attention to climate for resilience. Apart from the current guidelines on ecological assurance, stricter supervision and authorization is also needed to limit natural problems. Natural resilience in Indonesia must be worked on with the aim that harmony in life is more guaranteed on the grounds that the right to a proper and strong climate is the right of every individual.
