Abstract

Abstrak: Dalam pelaksanaan penyelenggaraan pelayanan publik di Indonesia Ombudsman RI sebagai lembaga pengawas juga ditugaskan melakukan upaya pencegahan maladmistrasi dalam pelaksanaan pelayanan publik seperti disebutkan dalam Pasal 7 Huruf (g) Undang-Undang No.37 Tahun 2008 Tentang Ombudsman RI namun pelaksanaan upaya pencegahan maladministrasi oleh Ombudsman perwakilan Aceh di Kabupaten Bener Meriah belum maksimal sesuai harapan. penelitian ini bertujuan untuk memberikan pengetahuan terhadap upaya-upaya pencegahan maladministrasi yang telah dilakukan oleh Ombudsman RI perwakilan Aceh, penyebab Ombudsman RI perwakilan Aceh tidak maksimal dalam melaksanakan upaya pencegahan maladministrasi dan akibat yang timbul dari tidak maksimalnya upaya pencegahan maladministrasi di Kabupaten Bener Meriah. Penelitian ini merupakan penelitian Yuridis Empiris, penelitian ini dilakukan dengan mencari suatu permasalahan dalam mencari data atau informasi secara langsung melalui peraturan perundang-undangan yang dimaksud, aparatur hukum terkait serta penelitian lapangan yang dilakukan dengan cara wawancara dan penyebaran kuesioner. Upaya pencegahan maladministrasi yang dilakukan oleh Ombudsman RI perwakilan Aceh di Kabupaten Bener Meriah belum maksimal hanya berupa upaya pengawasan, pencegahan maladministrasi terhambat oleh anggaran, sumber daya manusia, jarak tempuh kantor Ombudsman RI perwakilan Aceh dengan Kabupaten/Kota, dan pengetahuan masyarakat terhadap Ombudsman dan maladministrasi, sehingga berakibat terjadinya lonjakan kasus maladministrasi, menimbulkan kurangnya kepercayaan masyarakat terhadap penyelenggara pelayanan publik, potensi terjadi tindak pidana korupsi meningkat. Disarankan kepada pihak Ombudsman RI perwakilan Aceh untuk membentuk kerjasama dengan pemerintah daerah dan lembaga-lembaga swadaya masyarakat yang ada di daerah guna memaksimalkan upaya pengawasan dan pencegahan maladministrasi oleh aparatur penyelenggara pelayanan publik di daerah.Kata kunci:Pelayanan Publik, Maladministrasi. Abstract

Plant genetic diversity has an important meaning in plant breeding programs. High genetic diversity allows breeders to select plant genotypes according to the desired breeding objectives. One of the efforts to increase diversity is through mutation induction techniques. Research has been carried out to increase the diversity of Kipas Putih soybeans by using gamma ray irradiation. Radiation was carried out on Kipas Putih soybean seeds as a result of pure strain selection using an irradiation level of 100-1000 Gy in Batan. The pure Kipas Putih line that has been irradiated, is planted on dry land according to the technical instructions for soybean cultivation and allowed to self-pollinate. Furthermore, after physiological maturity, the seeds were harvested and dried to obtain the Aceh succession M1 seed population. All the growing mutant plants were evaluated for morphological characteristics and yields. The results showed that the highest diversity was at the irradiation level of 200-300 Gy. Gamma ray irradiation can induce genetic diversity of Kipas Putih soybean which is indicated by variations in stem shape, leaf and yield. The higher the level of irradiation, the higher the level of cell and tissue damage, even resulting in death. The first generation mutant (M1) Kipas Putih soybean has the potential to produce a line with a higher yield than the original plant and allows selection of new characters such as drought tolerance, disease resistance, and high yield. It is necessary to select the M2, M3, and M4 generations on selected lines for drought tolerant characters and high production.

Abstract

The Formulation of Qanun through a legislation program (Prolek) implemented in a planned, integrated, and systematic with the aim to realize certainty of legal development in the region. The process of drafting the legislation program is carried out not in accordance with the planning and scale of priorities that have been set so as not to provide legal certainty to the priority and legal development in the region. This study uses normative juridical methods with a statue approach and conceptual approach. In addition, to determine the aspects that cause the lack of legal certainty, this study also uses empirical juridical methods. The establishment of the Local Legislation Program has not provided legal certainty because Qanun Aceh No. 5 of 2011 on The Procedure of Formation of Qanun has not set concretely on the scale of priorities that form the basis of the urgency of the establishment of a qanun. In addition, the District House of Representative (DPRK) given the function of legislation in the region does not yet have a preference for the field of legislation so that the process of legislation can not be completed as planned. In realization the legal certainty of the local legislation program against legal development in the region there needs to be concrete regulatory efforts in the provisions of Qanun Aceh No. 5 of 2011 relating to determining the scale of priorities as well as changing the mindset of the DPRK in the field of legislation by making it part of the priority function. Abstract

ABSTRAK: Pidana tambahan uang pengganti merupakan salah satu konsekuensi hukum yang dibebankan kepada pelaku tindak pidana korupsi. Perbuatan pelaku telah mengakibat-kan kerugian negara. Pembebanan tersebut merupakan pidana tambahan dari pidana pokoknya. Uang pengganti dibayar dalam waktu paling lama satu bulan sesudah putusan pengadilan yang telah memperoleh hukum yang tetap. Penelitian ini ingin mengetahui efektivitas ketentuan ambang waktu satu bulan dalam pelaksanaan pembayaran uang pengganti dan penghitungan besaran jumlahnya. Penelitian ini menggunakan metode yuridis-empiris. Penelitian menemukan bahwa mekanisme pembayaran pidana uang pengganti tidak sesuai dengan amanat Undang-Undang  Tindak Pidana Korupsi dan Undang-Undang Perbendaharaan Negara dalam kaitannya dengan pemidanaan dan pembayaran kerugian negara. Temuan ini menyebabkan ketidakpastian hukum dan ketidakefektifan proses pengembalian kerugian negara. Criminal Sanction Compensation Payment As Liability For States Financial Lost In The Case Of Corruption ABSTRACT: Additional penalty of compensation money is one of the legal consequences imposed on the perpetrators of corruption. The perpetration has caused a state’s losses. The money replacing the loss is an additional penalty of the principal penalty. It is paid within a month after a court decision enforceable. This paper is going to discuss the effective-ness of the provisions of the threshold of one month in the application of the payment and the calculation of the amount paid. This is juridical-empirical research. It shows that the mechanism of paying the state’s loss in against the mandate of the Corruption Act and the State Treasury Law in relation to the prosecution and payment of state losses. It causes law uncertainty and ineffectiveness of the compensation process.

Abstract

ABSTRACT: This article explores principles that must be focused in managing the management of natural resources and legal politics that must be run to fulfill the implementation of the principles in managing it in the Act of Natural Resources. Sveral policies of law have been issued by the state both the Act of Environment and the Act of Natural Resources. From such rules, the principles and norm of management fair environment, democratic and sustainable has not been accommodated and integrated fully. Abstract

ABSTRACT: The purpose of this study is to investigate and explain the form of policies, synergy of government, the appropriateness of policies issued by the provincial and district governments with the authority granted by Act No. 26 of 2007 This research is a normative, legal source material is the primary law materials and secondary legal materials, obtained through field research and library research. Aceh government policies and the policy of local governments has not been able to resolve the border conflict districts. This affects the difficulty of making the border spatial planning policy. Although the provinces and Regency/Municipality in Aceh had formed the Coordinating Agency for Spatial Planning Area (BKTRW), but BKTRW has not functioned optimally. There are no known incompatibilities in spatial planning policy, because local governments are still awaiting the birth of the provincial Qanun. To local governments expected to make policy together adjacent to resolve border issues in spatial planning. Forms of collective wisdom can be shared qanun, joint regulation or collective decisions. Abstract

This study aims to analyse and final the ideal legal design of the accountability concept to legislative organ in particular Regional House of Representatives (DPRK). One of The authority of DPRK is stated in Article 24 paragraph (1) of Law Number 11 of 2006 on the Government of Aceh states that: "DPRK has the duty and authority to form district/city qanuns which are discussed with the regents/mayors for mutual approval". In that law, that has not been formulated specific forms of accountability of the legislative organ. In genuine, when the DPRK has not carried out its duties and functions effectively in the field of legislation, there has no legal consequences can be given. This research uses normative legal research with statutory and conceptual approach. The outcomes of this study indicate that, the concept of legislative accountability relates to two aspects, that is political and managerial accountability. This accountability should have electoral implications on the performance of the DPRK in carrying out its functions in the field of legislation. The implementation of legislative accountability on the performance of DPRK in the field of legislation has legal and political consequences.

Abstract

ABSTRAK: Provinsi Papua memiliki begitu banyak sumber daya alam, tetapi masyarakatnya masih hidup dalam keterbelakangan dan serba kekurangan. Kondisi ini menjadi pemicu timbulnya konflik di Papua. Untuk mengatasi persoalan dimaksud melalui Undang-Undang No. 21 Tahun 2001 sebagaimana telah diubah dengan Undang-Undang No. 35 Tahun 2008, Provinsi Papua diberikan status sebagai daerah otonomi khusus dengan berbagai kewenangan, salah satu kewenangan dimaksud adalah dalam bidang pengelolaan sumber daya alam. Pemberian kewenangan dalam pengelolaan sumber daya alam ini dimaksudkan sebagai upaya untuk meningkatkan pendapatan masyarakat, sehingga masyarakat Papua dapat hidup lebih makmur dan sejahtera. The Authority of Natural Resources Management in the Scope of Special Autonomy in Papua ABSTRACT: Papua Province has a lot of natural resources, but the people still live poverty. The condition has caused a conflict in Papua. In order to handle the problems, the Act Number 21, 2001 has awarded the province as special autonomy with several authorities; one of these is in the field of managing natural resources. The provision in the field of managing natural resources is aiming at increasing the income of people of Papua Province hence they will be living in wealth and prosperity.
