Abstract

This study aims to analyze human rights violation on action that done by Indonesian government. The method used in this research is normative legal research. The results of this study shows that temporary blocked the internet to Papuan people is regulated under ICCPR and Indonesian law number 19 of 2016 about information and electronic transaction. Although, the reason for the temporary blocking action is to keep security of public but in other way that action was done in wrong procedure that make this action is illegal and against Indonesian law particularly law number 19 of 2016 about information and electronic transaction and also article 19 of international covenant on civil and political rights that have been ratified by Indonesian government through law number 12 of 2005 about ratification of ICCPR.Keyword : ICCPR, International Human rights, Freedom of Expression, Legal problems.

Abstract

Abstract PT. EMM is a foreign company engaged in the field of gold mining in the Nagan Raya district, Aceh. The mining business licenses of  PT.  EMM is  invalid because the  Central Government does not  conduct consultation with the Governor of Aceh as stated under the Government Regulation Number 3 year 2015 and the overlapping of regulation between the Ministerial Decree of Energy and Mineral Resources number 25 year2015 and Act number 11 year 2006 on Aceh Government. This study aims to analyze the meaning of host state control on foreign investment, the implementation of host state control on Act Number 25 year 2007 on Investment and the authority of Aceh government at PT. EMM Nagan Raya district regarding mining license. This research is normative legal research stipulates a systematic exposition by comparing the existing rules and interviewing the mining business licenses foreign company. The outcome shows that the meaning of host state control is the state has rights and responsibility on foreign investment, and the implementation of host state control in Indonesia shows that Indonesia has controlled foreign investment according to Act No.25 year 2007 on investment. Regarding licensing of PT. EMM is the authority of Aceh Government according to Act number 1 year 2006 on the Government of Aceh (UUPA). It is suggested to The Central Government in carrying out its legislation should clarify the rules of authority over foreign investment in the Aceh so that there is no legal overlap between the central government and the Aceh government.Keywords : Host State, Foreign Investment, Authority, Mining License.

Abstract

Abstrak- Penelitian ini bertujuan mengetahui bagaimana bentuk perlindungan bagi warga sipil di dalam suatu konflik bersenjata serta mekanisme penegakan hukum humaniter internasional bagi pelaku pelanggaran hukum humaniter internasional khususnya dalam konflik Armenia dan Azerbaijan di wilayah Nagorno Karabakh. Hasil penelitian di dapati bahwa Armenia dan Azerbaijan di dalam konflik bersenjata yang terjadi pada akhir tahun 2020 lalu telah melakukan pelanggaran terhadap warga sipil, yang mana menembakkan senjata dengan tidak akurat serta tindakan lainnya yang melanggar ketentuan hukum humaniter internasional terhadap warga sipil. Peristiwa yang terjadi dalam kurun waktu 3 bulan tersebut telah menewaskan sekitar 142 orang warga sipil tidak bersalah. Dalam hal mekanisme penegakan hukum humaniter internasional, baik pihak Armenia maupun Azerbaijan hingga saat ini belum di tempuh. Disarankan kepada Armenia dan Azerbaijan selaku negara yang berkonflik untuk mempertanggungjawabkan tindakan pelanggaran yang dilakukan dengan cara memberikan sanksi tegas terhadap pelaku pelanggaran hukum humaniter internasional terhadap warga sipil dalam konflik bersenjata di wilayah Nagorno Karabakh.Kata kunci: Perlindungan Hukum, Konflik Bersenjata, Hukum Humaniter Internasional

Abstract

This study analyzes the legal problem regarding implementing the distinction principle related to drones as military weapons by the United States of America (USA) based on international humanitarian law. The method used in this research is normative legal research. The results show that implementing the distinction principle when the United States of America uses drones as military weapons is not correctly implemented, as international humanitarian law requires. It can be seen from the number of civilian casualties who fell during drone attacks and the destruction of civilian objects. So the USA has been violated the distinction principle of international humanitarian law, so legal liability must be pursued under the international justice system. Also, other states have to follow the principle when using to conform to international requirements, commit to solid criteria for disclosure, monitoring, and accountability, and release regular updates on drone strikes and casualties. Keywords: Distinction principle; International Humanitarian Law; Drones as military Weapon; United States of America

Abstract

This paper is explaining about the importance of the new energy bill to build and operating nuclear as a sustainable energy. This research is conducted using normative-juridical methods. The results have shown that there are many international aspects of nuclear law and regulations that have been adopted or ratified which needs to be accommodated in national legislation and many oppositions in the fear with the nuclear management failure and the past nuclear fatality and the lack of human resources; and also the effect on NPT has rather clear that the use of nuclear power for peaceful use is allowed for peace use and benefit. Suggestion on several implementing law and nuclear security regulations that have not been adequately regulated need to be prepared and the bill of new and renewable energy should be imposed as soon as possible and to conclude nuclear power in the bill..

Abstract

This research focuses on the sustainability analysis of capture fisheries based on local wisdom in Lhok Kuala Gigieng. This study aims to analyze the sustainability status of capture fisheries and determine the factors that influence the sustainability of capture fisheries in Lhok Kuala Gigieng. The method used in this study is a descriptive method with survey techniques in data collection through questionnaires. The RAPFISH analysis uses four dimensions: ecological, economic, social, and institutional. This study indicates that the sustainability index score for the ecological dimension is in a good category, and the economic dimension of the sustainability index is in the medium category. Furthermore, it also shows that the social dimension of the sustainability index is in a good category, and the institutional dimension of the sustainability index is in a good category.

Abstract

ABSTRAK: Hasil kajian ilmuan ditemukan bahwa perubahan iklim memberi dampak negatif pada berbagai sektor, salah satunya kelautan dan perikanan. Dampak negatif pada bidang kelautan adalah terjadinya kenaikan permukaan air laut yang diakibatkan oleh pemanasan global yang menyebabkan mencairnya es di kutub utara dan selatan. Selain itu cuaca ekstrem juga merupakan dampak dari pemanasan global yang langsung dirasakan oleh hampir seluruh masyarakat dunia, terutama nelayan. Nelayan sangat bergantug kelangsunga hidupnya pada iklim. Aceh sebagai provinsi yang berbatasan langsung dengan laut, sebagian masyarakat Aceh berprofesi sebagai nelayan, sektor perikanan merupakan salah satu pilar ekonomi masyarakat yang terkena dampaknya. Hasil Penelitian mendapati bahwa dampak perubahan iklim terhadap sektor perikanan di Aceh telah sampai pada tahap yang mengkhawatirkan, terutama pada masyarakat nelayan tradisional dan kapal boat penangkap ikan kecil. Lebih lanjut pengaturan dan keterlibatan pemerintah daerah Aceh dalam membantu masyarakat dalam menghadapi dampak perubahan iklim sampai saat ini masih sangat minim. Hal ini dapat dilihat di beberapa kawasan yang mayoritas masyarakatnya nelayan, sangat minim sarana dan prasarana, serta informasi terkait dampak perubahan iklim. Saat ini Qanun No.7 Tahun 2010 tentang Perikanan, belum mampu memberikan dampak yang signifikan terhadap sector perikanan di Aceh Besar pada umumnya, hal ini dikarenakan sampai dengan saat ini belum adanya Pergub terkait qanun tersebut. Oleh sebab itu diperlukan penanganan segera untuk dapat mengatasi hal ini, sehingga dapat melahirkan program-program dari turunan qanun tersebut untuk dapat meningkatkan kesejahteraan masyarakat nelayan.  Local Government Policy on Facing the Impact of Climate Change on Fishery Sector ABSTRACT: Fishermen depends on the weather, and Aceh as a province that faces the sea directly, the fisherman in Aceh feel difficult life than before. Almost all the fisherman have no other source for their income, they only depend on fisheries as their livehood. Research finds that effect on climate change to the fisheries sector in Aceh has  been in critical level, especially for fisherman that uses traditional method and using small boat. Furthermore, regulation and the involvement of Aceh Government is lack in handling the problems. This situation can be seen in majority of fisherman, lacks of facility and information related to the impacts of climate change. Now, generally, Qanun (Local Regulation) No. 7/2010 on Fisheries is still unable to give significant impacts for fisheries sector in Aceh Besar. It is because until now there is Governor Regulation related to those Qanun. Therefore, it needs to handle and overcome the problems. Thereby, the programs that related to Qanun can be implemented and can increase the fisherman welfare.
