Abstract

Indonesia's forest degradation which is triggered by decades of uncontrolled deforestation has caused massive tropical forest depletion. The same situation also happened to Aceh's forest whose forest areas have been shrinking from year to year.  Indication of the increase in illegal logging is both in Indonesia and especially in Aceh as if showing an indication and an academic conclusion that there is a crucial problem. Therefore, there is a need for a mechanism to create an effective legal role to at least reduce illegal logging that is increasingly prevalent in Indonesia's forests. One of the mechanisms is by using a remote sensing technology approach to monitor the occurrence of illegal logging or other criminal acts in the forest which are considered to be the cause of the loss of Aceh's forest in particular and Indonesia in general. This study aims to find out the use of remote sensing satellite technology to monitor illegal logging in Aceh and to identify the use of satellite imagery by law enforcement officials in Aceh to punish illegal logging offenders. The results showed that law enforcement officers used satellite imagery data on conditions before and after environmental damage in handling illegal logging.   However,   the data that emerged from   LAPAN   is rarely used by law enforcement officials to monitor the condition of national forests, especially those in their work areas. Lack of use of satellite data by law enforcement officials in the initial tracking to eradicate illegal logging due to their lack of initiative to prevent illegal logging, the physical condition of  Leuser protected forest areas which are also close to residential areas,   and external issues of areas that make wood from Aceh's forests are traded outside the region and even abroad, as well as the lack of qualifications of law enforcement officials who know the environmental issues.

Abstract

Abstrak – The provisions regarding International Maritime boundaries have been regulated significantly under UNCLOS 1982, one of the maritime boundaries set in UNCLOS is related to Exclusive Economic Zones boundaries, which regulated in Article 55 of UNCLOS 1982. According to “historic rights”, China has breached these provisions by established the nine-dash line in the South China Sea and it gives impact to other states including Indonesia’s EEZ in Natuna waters.This study analyses about International Permanent Court of Arbitration award of 12 July 2016 regarding the South China Sea dispute and to find out the impact of the International Permanent Court of Arbitration Award of 12 July 2016 in the South China Sea to Indonesia. The research was used normative legal research and analyze the award by finding out the relevant rules. The outcome of this study indicates that China does not have a legal basis to claim the South China Sea and it was contradicted the provisions in UNCLOS 1982. The Tribunal award could be a basis for Indonesia in maintaining its territory from China’s claim. The recommendation for China is China should respect to the Tribunal award and Indonesia should also take any decisive actions regarding China’s claim in the Natuna waters as Indonesia’s Exclusive Economic Zones. Abstract

Artikel ini ingin mendalami pentingnya pembangunan hukum terkait kekosongan hukum tentang qanun gampong di Kabupaten Aceh Besar. Penelitian ini dilakukan dengan mengkaji bahan hukum, terutama qanun, untuk kemudian mendalami proses pembangunan hukum dalam konteks qanun gampong. Penggantian Qanun Aceh Besar Nomor 11 Tahun 2009 dengan Qanun Aceh Besar Nomor 2 Tahun 2020 telah menimbulkan masalah dalam pengaturan hukum, yakni pengaturan mengenai qanun gampong yang tidak ada lagi dasar hukumnya. Pengisian pengaturan kembali sangat penting dilakukan, dengan berangkat dari konsep pembangunan hukum. Disarankan kepada Pemerintah Kabupaten Aceh Besar untuk segera menyiapkan pedoman dalam tata penyusunan rancangan qanun gampong sebagai bentuk dari pembinaan kepada pemerintah gampong. Pedoman ini sendiri juga akan sangat membantu proses pemerintah gampong dalam menyiapkan berbagai kebutuhan qanun gampong.

Abstract

Program Kampung Iklim (Proklim) is a national mitigation and adaptation program to climate change in Indonesia. Like other areas across the country, several districts in Aceh Province are designated Climate Village Program (Proklim). However, as an innovative government-led initiative, the program's efficacy in Aceh has not been well-documented. This study explores the potential challenges and opportunities of Proklim implementation in Aceh. Even though Proklim is a significant initiative for adapting to the impact of climate change, poor community involvement in the planning and implementation stages led to the program's unsustainability. Lack of public participation correlates with their limited understanding of the program's benefits. Moreover, people's poor understanding is influenced by how the program is communicated. Drawing from previous research on public participation in implementing Proklim in three areas in Aceh Besar districts, this study analyzes the internal and external factors identified as strengths, weaknesses, opportunities, and threats of the climate change programs. The study argues that exploring and communicating the social capitals of local communities allows for more public involvement and participation in developing sustainable Proklim in the area.

Abstract

The relevance of foreign vessel sinking policy to eradicate IUU fishing in IEEZ by national regulation to UNCLOS 1982 is questionable. This paper uses a normative legal analysis,  examining international conventions and national regulation provisions and their application to legal events. The results indicate that implementing the foreign vessel sinking policy is national law enforcement of  Law No. 45 of 2009 amendment to the  Law No. 31 of 2004 Concerning Fishery,  Article 69 (1) and (4). The foreign vessel sinking policy is not contrary to UNCLOS 1982 because the subject protected in EEZ by Article 73 (3) is the human being, not the vessel. It remains an effective means to create a deterrent effect as an optimum penalty for such crime.

Abstract

Abstrak - Tujuan dari penelitian ini untuk mengetahui pengaturan dan pengelolaan konservasi perikanan dalam hukum internasional dan hukum nasional dalam regulasi konservasi laut yang diatur dalam UNCLOS dan Undang-Undang serta untuk mengetahui tantangan pelaksanaan konservasi wilayah laut di Indonesia. Beberapa pedoman umum dan mendunia yang bisa dimanfaatkan alasannya untuk masing-masing pihak yang memiliki kemampuan untuk mengikuti kelestarian ikan di lautan liar, misalnya pasal 117 dan 118 UNCLOS 1982 yang memerintahkan kerjasama negara-negara dalam perlindungan pengelola aset organik di laut lepas dan UndangUndang Nomor 31 Tahun 20044tentang Perikanan. Dalam tantangan pelaksanaannya, terjadi pengurangan porsi subsidi perlindungan laut dari otoritas publik, dan peningkatan bentrokan antar wilayah yang terjadi di kawasan pelestarian laut, dimana tidak ada pedoman atau peraturan yang tidak membahas masalah dan perbaikan daerah setempat. Disarankan agar penelitian ini dapat dipahami dengan keinginan otoritas publik untuk terus bekerja dalam penyelenggaraan kawasan pelestarian laut, dengan memperluas porsi subsidi perlindungan laut dan menyelesaikan bentrokan kemajuan sektoral yang terjadi di kawasan pelestarian laut. Abstract

This paper aims to find out the roles of corporate responsibility in reducing carbon emissions under international law, and to find out the carbon emission reduction programs carried out by PT. Solusi Bangun Andalas (SBA) as a form of corporate responsibility. This paper uses primary data obtained in field  in the form of interviews with respondents and informants, observations, and combines legal materials such as textbooks, theories, laws and regulations which become secondary data. The results found that the Paris Agreement is one of the most likely solutions in the future in terms of order to deal with the impact of climate change, especially in terms of reducing carbon emissions due to the firmness of including to hold global temperatures below 2 degrees Celsius, and also to overcome the increase in carbon emissions.

Abstract

ABSTRAK: Hasil kajian ilmuan ditemukan bahwa perubahan iklim memberi dampak negatif pada berbagai sektor, salah satunya kelautan dan perikanan. Dampak negatif pada bidang kelautan adalah terjadinya kenaikan permukaan air laut yang diakibatkan oleh pemanasan global yang menyebabkan mencairnya es di kutub utara dan selatan. Selain itu cuaca ekstrem juga merupakan dampak dari pemanasan global yang langsung dirasakan oleh hampir seluruh masyarakat dunia, terutama nelayan. Nelayan sangat bergantug kelangsunga hidupnya pada iklim. Aceh sebagai provinsi yang berbatasan langsung dengan laut, sebagian masyarakat Aceh berprofesi sebagai nelayan, sektor perikanan merupakan salah satu pilar ekonomi masyarakat yang terkena dampaknya. Hasil Penelitian mendapati bahwa dampak perubahan iklim terhadap sektor perikanan di Aceh telah sampai pada tahap yang mengkhawatirkan, terutama pada masyarakat nelayan tradisional dan kapal boat penangkap ikan kecil. Lebih lanjut pengaturan dan keterlibatan pemerintah daerah Aceh dalam membantu masyarakat dalam menghadapi dampak perubahan iklim sampai saat ini masih sangat minim. Hal ini dapat dilihat di beberapa kawasan yang mayoritas masyarakatnya nelayan, sangat minim sarana dan prasarana, serta informasi terkait dampak perubahan iklim. Saat ini Qanun No.7 Tahun 2010 tentang Perikanan, belum mampu memberikan dampak yang signifikan terhadap sector perikanan di Aceh Besar pada umumnya, hal ini dikarenakan sampai dengan saat ini belum adanya Pergub terkait qanun tersebut. Oleh sebab itu diperlukan penanganan segera untuk dapat mengatasi hal ini, sehingga dapat melahirkan program-program dari turunan qanun tersebut untuk dapat meningkatkan kesejahteraan masyarakat nelayan.  Local Government Policy on Facing the Impact of Climate Change on Fishery Sector ABSTRACT: Fishermen depends on the weather, and Aceh as a province that faces the sea directly, the fisherman in Aceh feel difficult life than before. Almost all the fisherman have no other source for their income, they only depend on fisheries as their livehood. Research finds that effect on climate change to the fisheries sector in Aceh has  been in critical level, especially for fisherman that uses traditional method and using small boat. Furthermore, regulation and the involvement of Aceh Government is lack in handling the problems. This situation can be seen in majority of fisherman, lacks of facility and information related to the impacts of climate change. Now, generally, Qanun (Local Regulation) No. 7/2010 on Fisheries is still unable to give significant impacts for fisheries sector in Aceh Besar. It is because until now there is Governor Regulation related to those Qanun. Therefore, it needs to handle and overcome the problems. Thereby, the programs that related to Qanun can be implemented and can increase the fisherman welfare.

Abstract

ABSTRACT: International law of the sea has ruled that a coastal state and foreign ship have a right to and certain power in straits including Indonesia towards the Malaka Strait. It is one of the straits used as international shipping lane. UNCLOS 1982 admits that there is a transit passage right for foreign vessels shipping over the strait and it cannot be called by Indonesia as a coastal state directly faces the strait. In several matters, the passage is a border for the acknowledgement of Indonesia sovereignty over its territory. On the other side, international law provides the right for foreign vessels to have a passage without getting permission from Indonesia. However, a coastal state is also acknowledged its right to defend the sea from damage.
