Abstract

This article aims to examine the implementation of the Regulation of the Minister of Transportation No.18 of 2020 concerning Transportation Control in the Context of Prevention of Covid-19 (“MoTR No.18/2020”) as amended by Regulation of the Minister of Transportation No.41 of 2020 which serves as a guideline for infrastructure providers. transportation such as managers of terminals, stations, seaports and airports in implementing health protocols and transportation control. This research combines normative juridical law research methods and empirical legal research. Normative legal research is carried out by taking an inventory of related laws and regulations, journals, other encyclopedias related to the topic of this research. Meanwhile, empirical legal research was conducted by conducting interviews with the management of PT. Angkasa Pura II (Persero) Kuala Namu and direct observation at Kuala Namu Airport. The data obtained will then be analyzed qualitatively and deductive conclusions are drawn. The results obtained, that there are still some discrepancies in the application of health protocols properly and correctly due to lack of awareness to carry out health protocols and the absence of strict sanctions and supervision for violations of these

Abstract

ABSTRACTDisputes are a common thing to happen, so the settlement must also benefit both parties. Alternative dispute resolution or Alternative Dispute Resolution (ADR) is an option in solving the problems of the parties in the field of international trade. This settlement is carried out by means of choice of law and choice of jurisdiction which is stated in the contract clause. Prior to the arbitration stage, dispute resolution begins with negotiations first. However, the implementation of the execution is a bit difficult, because sometimes some parties do not want to carry out the award from the arbitration, so it is quite time-consuming and labor-intensive to return the matter to court. For this reason, when making contract clauses, there must be self-awareness to carry out decisions if a dispute does occur in international trade. As an example of alternative dispute resolution by Indonesia is regarding the Indonesia-Japan National Car Dispute, the point of the problem is where Japan feels that Indonesia is doing injustice to the automotive industry which at that time cut the cost of tax duties for national cars, even though Japan has a large target market in Indonesia. in the automotive case, this lawsuit was brought to International Arbitration and the lawsuit was won by Japan. Furthermore, it is explained how the procedure for resolving disputes and how alternative dispute resolution is an option in resolving international trade disputes. The research method in this journal uses a normative juridical qualitative method that conducts research on existing theories.Keywords: Disputes, International Trade, Arbitration

Abstract

Hadirnya perusahaan peer to peer lending (P2PL) sebagai penyedia jasa pinjam-meminjam uang melalui jaringan internet di Indonesia diharapkan menjadi alternatif pendanaan bagi masyarakat, faktanya menimbulkan berbagai permasalahan. Salah satunya adalah masalah perlindungan konsumen yang sering diabaikan. Penelitian ini bertujuan untuk mengkaji gambaran umum penyelenggaraan usaha P2PL di Indonesia, bentuk pelanggaran hak konsumen dalam pelaksanaan industri P2PL di Indonesia, dan solusi untuk mengoptimalkan perlindungan konsumen dalam industri P2PL. Penelitian ini menggunakan metode yuridis normatif dan empiris dengan menganalisa peraturan perundang-undangan, jurnal dan data terkait pelanggaran hak konsumen dalam industri P2PL. Hasil penelitian ditemukan berbagai permasalahan dalam pelaksanaan industri P2PL di Indonesia dikarenakan terdapat kekosongan hukum terkait dengan perlindung-an konsumen industri P2PL di Indonesia. Solusi untuk mengatasi masalah tersebut adalah dengan membuat undang-undang yang secara spesifik mengatur tentang pelaksa-naan praktik P2PL di Indonesia beserta sanksi yang tegas bagi para pihak yang melakukan pelanggaran atas undang-undang tersebut. Consumer Protection Strengthening in the Peer to Peer Lending Business in Indonesia  The presence of a peer to peer lending company (P2PL) as a provider of money lending and borrowing services through the internet network in Indonesia is expected to be an alternative funding for the community, but in fact this raises various problems. One of the problems is consumer protection which is often ignored by P2PL companies. This study aims to examine the general description of P2PL business operation in Indonesia, forms of violation of consumer rights in the implementation of the P2PL industry in Indonesia, and solutions to optimize consumer protection in the P2PL industry. This research uses normative and empirical juridical methods by analyzing laws and regulations, journals and data related to violations of consumer rights in the P2PL industry. The result shows that various problems in the implementation of P2PL industry in Indonesia because there is a legal vacuum related to consumer protection for the P2PL industry in Indonesia. The solution to solve this problem is to make laws that specifically regulate the implementation of P2PL practices in Indonesia along with strict sanctions for parties who violate the law.

Abstract

 Law Number 2 of 2012 states that the acquisition of land for public interests must be accompanied by adequate and fair compensation, as well as the protection and respect of human rights. However, the construction of the Tebing-Tinggi - Kuala Tanjung Toll Road in Sipare-pare and Pasar Lapan Villages, Air Putih Subdistrict, Batu Bara Regency, Indonesia, exemplifies how compensation is frequently unfair. This study seeks to determine the suitability of implementing land acquisition using current laws and regulations. The primary data is gathered through interviews with landowners and the Regional Office of the National Land Agency of the Province of North Sumatra. While secondary data are gathered via literature and legal research. The results revealed that the provided compensation did not meet the requirements of Law No. 2/2012, prompting the public to file an objection with the Kisaran District Court.
