Abstract

Abstract: One of the objects of the philosophy studies is the nature. The thought of the nature  runs continually  to the things beyond the nature (metaphysics) and eventually comes to a conclusion that the existence of the nature must be in process. The philosophers argued that all things created must be in process, namely the process of emanation. The implication of this argument is that the nature is qadīm, because it was created by God since qidam and azālī. This argument was opposed by the theologists (mutakallimīn). They said that the nature was something new and its existence was from nothing. These two different theories are supported by the dalīls of the Qur’an. Their interpretations on the verses of the Qur’an gave the opportunity to result in different argument. The reason is that the use of the terms in the Qur’an, which  refer to the meaning of creating, is various, moreover when    referring to the proposition which rejects the existence of the  synonims in the Qur’an. Therefore,  eventhough the meaning of the term “khalaqa, bada‘a and fatara is “to create”, each this single word has its own substancial meaning.Kata Kunci: Alquran, filsafat, penciptaan alam, khalaqa, bada‘a, fatara

Abstract

Bank interest is an interesting topic to discuss from classical era to modern era. In classical era,  interest   has been decided as ribâ., the law status of which   is harâm (forbidden) because of an addition (ziyâdah). Based on this, bank interest is also categorized as ribâ. Nevertheless, some say that the forbiddance of ribâ is because of  an exploitation to  the clients, based on which bank interest is not ribâ. It is based on these two opinions that a controversy  on bank interest emerges. The controversy emerges since the first group interprets the verses on ribâ textually while the second group interprets the verses contextually.Kata Kunci: bunga bank, paradigma tekstual, paradigma  kontekstual

Theological thought of the Ash’arite founded by Abu Hasan al-Asyari develops through its theologians such as al-Baqillani, al-Juwaini, and al-Ghazali. Each of them has his own theological thought that differentiates him from other theologians. Abstract

The provision of iddah and mut'ah maintenance is the maintenance given to the wife after the legal provisions regarding the consequences of breaking up a marriage due to divorce according to the provisions of the law, among other things, the court can oblige the ex-husband to provide living costs and/or determine certain obligations for the ex-wife. The costs of living and obligations referred to in these provisions are iddah and mut'ah living. In this regard, the description in this article discusses how the provision of Iddah and mut'ah support is implemented based on social strata in the Religious Courts and the inhibiting and supporting factors for the implementation of the provision of Iddah and mut'ah support based on social strata. This article uses sociological legal research using empirical data. Data obtained through interview techniques, documentation studies, observation and data reduction, data presentation, verification and checking the validity of the data. It shows that in determining the judge's decision regarding the provision of iddah and mut'ah living based on social strata, this is when the judge wants to impose a burden on the husband in paying iddah living to the wife, in this case it does not burden the husband and does not harm the wife, with the judge's basic reference being to look at the ability from the applicant. The provision of iddah and mut'ah maintenance is based on the appropriateness and propriety of a husband's income. When the panel of judges wants to decide on the iddah and mut'ah maintenance that will be given to the wife, there is no definite calculation because basically each judge usually has a different opinion on the amount of maintenance that will be charged to the ex-husband. The provision of mut'ah maintenance is a gift of mementos in the form of money or objects by a husband to his ex-wife, except for his ex-wife qobla al dukhul and does not mean the wife who is nusyuz for providing mut'ah maintenance, the judge looks at how long they have lived together as a married couple.

Abstract

The growing social inequality in the modern era signifies that the global economic system is losing its moral compass. The interest based capitalist system places profit above justice. This study seeks to reinterpret the Quranic verses on riba in a more contextual and humanistic manner, not merely as a legal-formal prohibition, but as a moral call to restructure economic relations toward greater justice. This research employs a qualitative-descriptive method and a thematic (maudhu‘i) approach to verses such as QS. Al-Baqarah [2]: 275–279, Ali Imran [3]: 130, and Ar-Rum [30]: 39 to trace the ethical meanings behind the sacred text. The findings reveal that the Qur’an’s critique of riba is, in essence, a critique of exploitative economic systems both classical and modern. Conversely, values such as zakat, infaq, and mudharabah offer a more just economic path that fosters solidarity and upholds humanity. Thus, this study affirms that the Quranic ethics on riba can serve as an alternative foundation for building an economically and morally dignified system one that embraces progress and innovation without compromising ethical integrity. What the modern world needs is not merely an interest-free system, but an economic civilization imbued with empathy and oriented toward collective well-being.
