Abstract

The increasing number of Foreign Workers (TKA) each year, particularly in Central Sulawesi, is undoubtedly a phenomenon contributing to the disparity amidst the persistently high unemployment rates in the region. The role of the government is increasingly crucial in ensuring harmony, fairness, and the fulfillment of rights for every worker in Indonesia. However, the Job Creation Act has changed the regulations governing foreign workers by relevant institutions, from ministries to local offices. This research aims to analyze the position of foreign workers entering Indonesia. The research method employed is Juridical Normative research, which examines the position of foreign workers after enacting the Job Creation Act and explores the changes that have occurred. The research utilizes legal and analytical approaches. The findings indicate that the position of foreign workers after the enactment of the Job Creation Act provides legal certainty for the rights of all workers, regardless of whether they are foreign workers (TKA) or Indonesian workers (TKI). However, the Job Creation Act introduces new regulations regarding administrative provisions, as the permit for employing foreign workers (IMTA) has now been revoked by the Job Creation Act. Abstrak Tingginya jumlah Tenaga Kerja Asing (TKA) yang setiap tahunnya semakin meningkat di Indonesia khususnya di wilayah Sulawesi Tengah tentunya menjadi fenomena ketimpangan terhadap masih tingginya jumlah pengangguran di wilayah Sulawesi Tengah, peran pemerintah tentu semakin banyak terkait pengaturan agar tercipta keselarasan, keadilan serta jaminan terpenuhinya hak bagi setiap pekerja yang berkedudukan di Indonesia pada umumnya. akan tetapi keberadaan Undang-Undang Cipta Kerja terdapat perubahan pengaturan TKA oleh lembaga terkait dalam hal ini kementrian hingga dinas. Tujuan penelitian ini untuk menganalisis kedudukan TKA yang masuk di Indonesia. Adapun metode penelitian yang digunakan ini yaitu penelitian Yuridis Normatif, dimana penelitian ini akan mengkaji kedudukan TKA pasca keberadaan Undang-Undang Cipta Kerja yang telah mengalami perubahan, serta penelitian ini menggunakan pendekatan Undang-Undang dan Analistis. Hasil penelitian menunjukan bahwa kedudukan TKA pasca keberadaan Undang-Undang Cipta Kerja bahwa undang-undang memberikan kepastian hukum terhadap hak-hak tenaga kerja tanpa melihat TKA maupun TKI, akan tetapi Undang-Undang Cipta memberikan pengaturan baru terkait ketentuan administratif sebab IMTA (Izin Mempekerjakan TKA) kini telah dicabut oleh Undang-Undang Cipta Kerja.

Abstract

Islam provides women with rights under the Prophet Muhammad SAW. With the changes, women have full freedom of ownership rights in all permitted ways and have full rights to express opinions when they are asked to express their opinions. This research uses sociological research methods on law using empirical data collected through techniques. observation, interviews and documentation, the data analysis techniques used are data reduction, data presentation and checking the validity of the data. From women's opinions regarding the implementation of women's rights in choosing a life partner, not all implementations of women's rights have been implemented because they are still held by those closest to them. Therefore, the importance of communication and education in determining life choices. As the Hanafi school of thought emphasizes that women have the right to choose. The Prophet also said "marry someone you like". However, the facts on the ground contradict the existing theory. The supporting factors for reviewing Islamic law towards women are socio-economic background, education, mature age and parents. Inhibiting factors are the will or choice of parents, lack of readiness of men chosen by women, men who are economically disadvantaged, women who are still in the process, social and family factors and others.

Abstract

The provision of iddah and mut'ah maintenance is the maintenance given to the wife after the legal provisions regarding the consequences of breaking up a marriage due to divorce according to the provisions of the law, among other things, the court can oblige the ex-husband to provide living costs and/or determine certain obligations for the ex-wife. The costs of living and obligations referred to in these provisions are iddah and mut'ah living. In this regard, the description in this article discusses how the provision of Iddah and mut'ah support is implemented based on social strata in the Religious Courts and the inhibiting and supporting factors for the implementation of the provision of Iddah and mut'ah support based on social strata. This article uses sociological legal research using empirical data. Data obtained through interview techniques, documentation studies, observation and data reduction, data presentation, verification and checking the validity of the data. It shows that in determining the judge's decision regarding the provision of iddah and mut'ah living based on social strata, this is when the judge wants to impose a burden on the husband in paying iddah living to the wife, in this case it does not burden the husband and does not harm the wife, with the judge's basic reference being to look at the ability from the applicant. The provision of iddah and mut'ah maintenance is based on the appropriateness and propriety of a husband's income. When the panel of judges wants to decide on the iddah and mut'ah maintenance that will be given to the wife, there is no definite calculation because basically each judge usually has a different opinion on the amount of maintenance that will be charged to the ex-husband. The provision of mut'ah maintenance is a gift of mementos in the form of money or objects by a husband to his ex-wife, except for his ex-wife qobla al dukhul and does not mean the wife who is nusyuz for providing mut'ah maintenance, the judge looks at how long they have lived together as a married couple.

Abstract

The phenomenon of the high number of foreign workers (TKA), which is increasing every year in Indonesia, especially in the Central Sulawesi region, of course, means that the supervisory function carried out by the Central Sulawesi Province Manpower and Transmigration Service will be increasingly strict. However, since the existence of the Job Creation Law, employment agencies have changed the supervisory function of TKA. The research aims to analyze the role of the employment service in carrying out the supervisory function of foreign workers entering the Central Sulawesi region after the existence of the Job Creation Law. The research method used in this research is Normative Juridical research, which will examine the role of the employment department's supervisory function from changed aspects of the Job Creation Law. To examine how the law should apply. where based on cases in the field, researchs try to analyze facts and also applicable legislation. The research results show that the supervisory function of the Manpower Service after the existence of the Job Creation Law still provides a mandate similar to the Manpower Law. However, in its implementation, as an institution appointed by the state that has the task and function of issuing IMTA (Permits to Employ Foreign Workers), it has now been revoked by the Job Creation Law. The regulations regarding foreign workers after enacting the Job Creation Law underwent significant changes. Keywords: Employment Service; Supervisory Function; Job Creation Law

Abstract

Palu City is the capital of Central Sulawesi Province. The original inhabitants of Palu City are the Kaili tribe. Most of the population adheres to Islam (86.99%), Christianity (10.65%), Catholicism (0.90%), Hinduism (0.93%), Buddhism (0.50%), and Confucianism (0.001%). The potential for diversity certainly contains both positive and negative values. Conflicts due to ethnic and religious diversity often occur. What is interesting is that the largest tribe in the Palu Valley, which has an open character with differences and diversity, is the character of the Kaili people, so this is interesting to study, especially regarding the abilities of the Kaili tribe with its system called "Tonda." Talusi” can make the City of Palu one of the cities that is able to easily instill the value of religious moderation. This research is qualitative research, a type of library research. The research results show that Tonda Talusi is the philosophy of the Kaili indigenous people, which describes the harmonious relationship between humans and the universe, with fellow humans, and with God. Tonda Talusi means three supports (furnaces) for the lives of the Kaili indigenous people. The principles of togetherness in Tonda Talusi's philosophy include the 3 pillars of life of the Kaili traditional community, which are based on good values, namely: Matuvu Mosipeili means seeing each other, Matuvu Mosiepe means hearing each other, and Matuvu Mosimpotove means loving each other. Abstrak Kota Palu adalah Ibu Kota Provinsi Sulawesi Tengah, penduduk asli Kota Palu adalah Suku Kaili. Sebagian besar penduduknya memeluk Agama Islam (86,99%), Kristen (10,65 %), Katholik (0,90 %), Hindu (0,93 %), Budha (0,50 %) dan Kong Hu Cu (0,001 %). Potensi keragaman tersebut tentu memuat nilai positif maupun negatif. Konflik akibat faktor keragaman suku dan agama kerap terjadi, hal yang menarik, ketika suku terbesar di lembah Palu yang mempunyai karakter terbuka dengan perbedaan dan keragaman merupakan karakter masyarakat Kaili sehingga hal ini menarik untuk digkaji terutama terkait kemampuan suku Kaili dengan sistemnya yang disebut dengan “Tonda Talusi” dapat menjadikan Kota Palu menjadi salah satu kota yang mampu dengan mudah menanamkan nilai moderasi beragama. Penelitian ini merupakan penelitian kualitatif, jenis penelitian library research. Hasil penelitian menujukan bahwa Tonda Talusi adalah filosofi masyarakat adat Kaili yang menggambarkan hubungan harmonis antara manusia dengan alam semesta, dengan sesama manusia, dan dengan Tuhan. Tonda Talusi artinya tiga penyangga (tungku) kehidupan masyarakat adat Kaili. Prinsip-prinsip kebersamaan dalam falsafah Tonda Talusi, meliputi 3 pilar kehidupan masyarakat adat Kaili yang dilandasi nilai-nilai kebaikan, yaitu: Matuvu Mosipeili artinya saling melihat, Matuvu Mosiepe artinya saling mendengar, Matuvu Mosimpotove artinya saling mengasihi.

Abstract

In a marriage relationship, household conflicts can be resolved in various ways, one of which is mediation by Togura Nuada, as carried out by the Kaili Tribe in Wani Lumbumpetigo Village. Alternative dispute resolution is divided into litigation (through the courts) and non-litigation (outside the courts). Mediation by Togura Nuada is a non-litigation resolution based on local wisdom, based on the concept of living law as recognized in Article 18B Paragraph (2) of the 1945 NRI Constitution. This study aims to identify the role of Togura Nuada as a mediator in household conflicts in the Kaili community, as well as supporting and inhibiting factors. This research is empirical juridical with an empirical approach. The study results show that Togura Nuada plays an active role as a mediator. Supporting factors include community culture, social legitimacy, and support systems. Inhibiting factors include limited resources and attitudes of the conflicting parties. To overcome these obstacles, adequate infrastructure, communication skills, emotional intelligence, and a deeper understanding of culture are needed.

Abstract

The developments of science and technology particularly in traffic and transportation field, apparently not only have benefits and positive effects on people’s life behavior, but also create negative impacts, traffic accidents, for instance. Victims of traffic accidents both minor and serious injuries as well as the heirs of the dead victims do need funds for medical expenses and funeral costs. Therefore, whoever has traffic accident, in fact, is entitled to compensation from Jasa Raharja. Jasa Raharja claim process begins by filling out the form as good and honest as possible based on valid documents. This process takes at least one to two hours, or a whole day, it depends on the number of people who submit claims at the same time.
