Abstract

Ever since the implementation of the regional governance reform era, fundamental changes have occurred in the discretion for the management of the mineral and coal mining sectors. The adoption of Law Number 22 Year 1999 led to the expansion of regional governments’ autonomy, applying autonomy in the broadest sense of the word, by focusing merely on ‘decentralization’, while disregarding the principle of de-concentration. Governmental affairs submitted based on decentralization refer to discretion by attribution, whereas de-concentration refers to discretion by delegation. Basically, all governmental affairs are submitted to the Regency and Municipality Government, except for 6 (six) matters which constitute the discretion of the central government. Discretion for the management of mining includes the discretion vested in the Regency and Municipality Government by virtue of Government Regulation Number 75 Year 2001. This implies that the concept of ‘control by the state’ (‘penguasaan negara’) as mandated in Article 33 of the 1945 Constitution of the State of the Republic of Indonesia has become degraded.

Abstract

Mining law, since before the Indonesian independence has already been a debatable topic between the business sector, Government, and other stakeholders until now. Several issues of mining law that have been debated among others, are: the form of concession and the authority for issuing mining licenses in relations with the right of state control stipulated under Article 33 paragraph (3) of the 1945 Indonesian Constitution, issues regarding taxes and royalties, environmental issues and other obligations. Since the enactment of Indische Mijn Wet 1899 until the enactment of Law No. 4 of 2009, these debates have yet to be settled; more, other serious issues are rising. These issues are steeply raised since the beginning of the reformation era of Local Governance which was marked by the enactment of Law No. 22 of 1999 that gives the power for the Municipal/City level Government to regulate the mining sector.

Abstract

Granting mining licenses brings various negative impacts in various aspects. In addition to the environmental damage that must have been caused, it also caused a lot of leakage in the revenue of state finances that should have been received by the State. Permits should be a controlling instrument in mining operations, so that they are in accordance with the philosophical meaning as mandated by Article 33 paragraph (3) of the 1945 Constitution. The meaning contained in the Article is the principle of "State's Right to Control" over natural resources and the mandate "for the greatest prosperity. people". These two things must then be used as a basis in the formulation of various policies both regulating (regeling) and those that are set (decision / licensing). Related to licensing, it has been given since the Dutch East Indies government with the form of "Concession" as stipulated in Indische Mijnwet 1899. Therefore this article wants to find a form of exploitation (including licensing) that is in accordance with the concept of the Right to Control by the State in accordance with Article 33 paragraph (3) of the 1945 Constitution.

Abstract

This thesis discusses the implementation of the principle of "equitable efficiency" as contained in Article 33 paragraph (4) of the 1945 Constitution After the 4th Amendment in legislations concerning electricity. This research analyzes how the Constitutional Court interprets the element of "equitable efficiency" in the constitutional reviews Electricity Law. This article concludes that the meaning of "equitable efficiency" in Article 33 paragraph (4) of the 1945 Constitution After the 4th Amendment is that the national economy should be organized to use the least amount of resources to achieve the greatest amount of welfare which could be enjoyed equitably by the all citizens. In regards to Indonesia's electricity sector, it was found that each electricty regulation has embodied at least one aspect of the principle of "equitable efficiency".

Abstract

Violations of human rights by corporations occur due to technological advances that compel and the weakness of the system of laws and regulations as well as punishment for violators, resulting in acts of human rights violations both directly and indirectly. In order to analyze efforts to prevent human rights violations by corporations, human rights and business perspectives are needed and use normative research methods and present effective and appropriate prevention efforts. Thus, human rights violations committed by corporations are divided into 3 (three), namely forced migration of local residents, discrimination or closed access to justice and environmental damage. Therefore, the involvement of the state, corporations and society is needed in the implementation of corporate business entities to prevent and as an effort to mitigate human rights violations in the business sector.

Abstract

Education is a conscious and planned effort to make humans intelligent, skilled and have noble character. In educational practice in Indonesia, the government has launched the Independent Learning curriculum. The Independent Learning Curriculum aims to enable students to freely think, express, be creative, and access knowledge from various sources. In practice, the Independent Curriculum certainly cannot be separated from the learning and assessment process. The learning process and assessment are components that cannot be separated, if the learning process carried out is effective then it must be accompanied by an assessment that is able to facilitate students providing feedback on their strengths and weaknesses, so that students always experience development in a positive direction. Diagnostic assessment is a type of assessment that is very important to determine students' learning readiness, talents, interests and learning styles. Conclusions from this research First, implementing diagnostic assessments is very important in order to create learning that supports students. Second, the implementation of diagnostic assessments in class I mathematics learning is based on the Pancasila Student Profile so that its implementation can be in accordance with the nation's noble values. Third, the application of a diagnostic assessment based on the Pancasila Student Profile in class I mathematics learning is based on the learning theory of cognitive development by "Piaget" with the aim that the assessment is in accordance with the stages of cognitive development of class students, namely at the concrete pre-operational stage. Fourth, the implementation of diagnostic assessments based on the Pancasila Student Profile and referring to the "Piagetian" theory of cognitive development has been proven to bring positive changes, including increased student motivation and focus on learning, students understand the learning material better, and student learning outcomes also improve. Abstract

Dalam menyelesaikan sengketa kepegawaian ada dua jalur yang bisa dilakukan, yakni melalui Upaya Administrasi dan melalui peradilan. Namun upaya administrasi kurang dapat menyelesaikan masalah kepegawaian di Indonesia. Dengan demikian maka  perlu dilakukan kajian yang mendalam agar ditemukan cara yang paling efektif dalam penyelesaian sengketa kepegawaian yang memberikan kepastian hukum kepada para pihak yang bersengketa.

Abstract

Maladministrasi dimaksudkan sebagai perbuatan-perbuatan, sikap atau perilaku melampaui wewenang, kelalaian melawan hukum, atau mengabaikan kewajiban hukum dalam pelayanan publik, menggunakan wewenang untuk tujuan lain dan mengakibatkan kerugian baik materiil maupun immateriil kepada masyarakat atau perseorangan. Salah satu Maladministrasi dalam proses penyidikan tindak pidana yang banyak dilaporkan berdasarkan data dari Ombudsman RI adalah berkaitan dengan penundaan berlarut yang didefinisikan sebagai pemberian layanan yang melebihi baku mutu waktu dari janji layanan atau perbuatan mengulur waktu penyelesaian layanan. Penundaan berlarut tersebut berimplikasi pada hak atas kepastian kukum bagi Korban dan Tersangka. Hak untuk mendapatkan informasi atas perkembangan kasus yang dilaporkan oleh korban tidak terpenuhi, sedangkan bagi Tersangka berkaitan dengan hak agar Tersangka segera diajukan ke pengadilan oleh penuntut Umum dan diadili tanpa penundaan yang tidak semestinya.

Abstract

The study aimed to discover an understanding of the handling of government officials who do not carry out the decisions of the State Administrative Court. In the mechanism for implementing decisions, the State Administrative Court has no implementing agency, and hence, the State Administrative Officers often disobey and do not implement the decisions of the State Administrative Court. Therefore, citizens' constitutional rights to justice decided by the State Administrative Court can be threatened. This study aimed to compare the state administrative justice systems in Indonesia and Thailand. This research uses doctrinal research with a statutory approach. The results of this study are that there is no institution for implementing the decisions of the State Administrative Court in Indonesia. Meanwhile, in Thailand, there is already an implementing agency, and functionally the executive body executes litigants. Therefore, regulation and implementation of State Administrative Officers who do not implement State Administrative Court Decisions is an urgency to increase the effectiveness of implementing State Administrative Court decisions in Indonesia.
