Abstract

Indonesia have an enormous population. The population is much this cause in Indonesia there are various kinds of industrial activities to boost the economy. Industrial improved and developedquite rapidly at the moment. The industry that is eexpanding quite a lot is the creative economy. Creative economy is the development of creativity, taste and human initiative, because the creative economy is something that can improve the well-being of not a few more people who join and trailing thus requiring it differentiator. Abstract

The economic growth in Indonesia is thrive. The Economic growth can not be separate of the role of investment in Indonesia. The population in Indonesia very much and also the location of the Indonesian state strategic pretty much made Indonesia enjoyed by citizens of Indonesia itself and also foreign nationals who wish to also invest in Indonesia. In Indonesia there is a domestic investment and foreign investment. In this paper will be devoted to foreign investment. Foreign investment that currently exist in Indonesia has a sizeable amount and spread from Sabang to Merauke, and also has a fairly diverse business fields. The investors who come in and make an investment in Indonesia is sometimes caused the dispute. Dispute occurs either the foreign investment by government or also foreign investment with other parties outside the government well with other foreign investment, and also in the company itself. Foreign investment dispute settlement is not only done through the court owned by the government, but there are also ways of alternative dispute resolution outside the court . One of the alternative dispute resolution outside the court is Arbitration. Arbitration carried out as part of efforts to achieve settlement of the problem in terms of investment activity . Arbitration itself is set in the legislation applicable investment in Indonesia . The parties in capital investment may create a separate section in the agreement governing the settlement of disputes in the case of investments completed by Arbitration. In the event that the parties have arranged to settle the case with Arbitration, then the court is not allowed to try again or to interfere in the decision Arbitration. Arbitration is one of the solutions if justice denial occur in the settlement of foreign direct investment issue.

Abstract

Indonesia as a part of the international community inactable merely accordance to the government of Indonesia provision without considering to any of the international world provisions. Indonesia is the members of the World Trade Organization (WTO), so that Indonesia shall be subject to the provisions issued by the WTO. One of the provisions in the WTO is the principle of non-discrimination for foreign investment. Indonesia has numerous Natural Resources that can be exploitation for economic reasons. One business that is promising and ravish for foreign investors are exploiting the natural resources in Indonesia that is coal. Indonesia is the country’s seventh largest coal producer in the world, even since 2006, Indonesia became the second largest coal exporter in the world after Australia. Mining construction line of business was forbidden to foreign investment companies until Law number 4 Year 2009 regarding Mineral and Coal have been issued. On the Law number 4 Year 2009 regarding Mineral and Coal foreign investment company can enter the coal mining. The provision objective is to obey the principle of non discrimination on the On The Agreement on Trade-Related Investment Measures and also being considered to be capable as a selling point and competitiveness in contemporary trade to invite foreign investors to invest their capital in Indonesia.

Abstract

Demi meningkatkan kesejahteraan perekonomian, masyarakat mengembangkan industry kreatif di mana industry kreatif ini juga sudah menjadi perhatian pemerintah. Perhatian pemerintah sudah tercermin di dalam Rencana pengembangan ekonomi kreatif yang dikeluarkan oleh pemerintah. Namun dalam perjalanannya, industry kreatif ini mengalami banyak tantangan salah satunya mengenai modal. Banyak dari antara industry kreatif ini kesulitan untuk mencapai lembaga keuangan dengan modal dan juga banyak dari industry kreatif ini yang memang tidak memiliki itikad baik sehingga bank harus juga melakukan pencegahan yaitu dengan prinsip kehati-hatian bank.Penulis menggunakan metode penelitian yuridis normatif dengan menganalisis peraturan-peraturan yang berkaitan dengan Perbankan sebagai lembaga keuangan yang bertugas sebagai penyalur dana masyarakat. Sifat penelitian adalah deskriptif analitis yaitu menggambarkan prinsip kehati-hatian bank pada saat bank meminjamkan dana kepada pelaku industry kreatif. Teknik pengumpulan data dengan yuridis normatif di mana melihat peraturan perundangan yang berlaku, melihat pendapat para ahli dalam prinsip kehati-hatian bank. Prinsip kehati-hatian bank perlu diterapkan dalam rangka untuk pengembangan industry kreatif dengan cara menyalurkan dana kepada pelaku industry kreatif. Prinsip kehati-hatian pada bank juga dapat membantu bank agar bank tidak mengalami kerugian. Di sisi lain juga mencegah pelaku industry kreatif yang memang memiliki itikad tidak baik pada saat melakukan pinjaman dana ke bank.Kata Kunci : Industri kreatif; prinsip kehati-hatian, perbankan

Abstract

Pasar Modal adalah salah satu lembaga keuangan yang berpengaruh pada saat sekarang. Dengan kehadiran pasar modal, masyarakat sudah dapat memiliki modal untuk mengembangkan usahanya. Perkembangan pasar modal juga tidak lepas dari perkembangan teknologi dan globalisasi. Di mana dengan teknologi yang berkembang pesat menyebabkan pasar modal mengglobal. Global dalam arti transaksi saham dapat dilakukan di mana saja, kapan saja, dan siapa saja tidak terbatas tempat termasuk batas negara. Saat ini pasar modal sudah menjadi salah satu tempat atau media yang paling efektif untuk melakukan tindak pidana. Hal ini disebabkan karena kemudahan nasabah yang melakukan transaksimelalui scripless trading yang menyebabkan nasabah yang beritikad tidak baik dapat melakukan kejahatan di dalam pasar modal. Salah satu perangkat untuk pencegahan tindak pidana dalam transaksi di pasar modal adalah dengan menerapkan prinsip mengenal nasabah. Dasar hukum dari penerapan prinsipmengenal nasabah ini adalah. Keputusan Ketua Badan Pengawas Pasar Modal dan Lembaga Keuangan Nomor KEP- 476/BL/2009 tentang Prinsip Mengenal Nasabah oleh Penyedia Jasa Keuangan di Bidang Pasar Modal Penerapan Prinsip Mengenal Nasabah Dalam Pasar Modal. Penulis menggunakan metode penelitian yuridis normatif dengan menganalisis peraturan-peraturan pelaksana yang berkaitan denganBapepam sebagai lembaga independen yang bertugas mengawasi pasar modal sebelum memutuskan apakah transaksi tersebut mencurigakan atau tidak. Sifat penelitian adalah deskriptif analitis yaitu menggambarkan penerapan prinsip mengenal nasabah di dalam pasar modal untuk mencegah tindak pidana, lalu menganalisis fakta-fakta dalam praktek pasar modal di mana transaksi yang mencurigakandapat berkembang menjadi tindak pidana. Teknik pengumpulan data dengan yuridis normatif di mana melihat peraturan perundangan yang berlaku, melihat pendapat para ahli dalam penerapan prinsip mengenal nasabah pada scripless trading atau transaksi pasar modal elektronik. Kejahatan di dalampasar modal semakin mudah untuk dilakukan akibat dari scripless trading yang sekarang berlangsung di dalam pasar modal karena dalam pelaksanaannya, scripless trading masih memiliki banyak kekurangan dan memerlukan pengaturan agar kemajuan teknologi tidak serta merta membuat para pelaku tindak pidana melakukan kejahatan. Banyaknya hambatan yang terjadi sehingga prinsip mengenal nasabah belum diterapakan secara maksimal dalam pasar modal sesuai peraturan yang berlaku. Pertimbangan utama bagi pedagang atau perantara pedagang efek dalam penerapkan prinsip mengenal nasabah adalah kemungkinan kehilangan nasabah yang akan bertransaksi melalui pedagang atau perantara pedagang efek. Prinsip mengenal nasabah sebagai salah satu prinsip dari pasar modal untuk mengantisipasi berbagai tindakan kejahatan yang dapat terjadi di dalam pasar modal, dan menuntut peran pemerintah mengantisipasinya.Kata kunci : Mengenal Nasabah, Scripless Trading, Pasar Modal

Abstract

The rise in buying and selling of imported second-hand clothing is caused by the government's lack of firmness in imposing sanctions on businesses importing second-hand goods. The purpose of this research is to determine the responsibility of importers which must be followed up by the government and not harm consumers in a normative legal manner. The government should follow up on import activities of used goods which are prohibited according to law by imposing sanctions on importers, including sanctions that apply in Law No. 8 of 1999 and Law No. 7 of 2014.
