Abstract

Depletion of agricultural land the food also caused Indonesia to import food to meet the needs of the community. It should, with a vast territory, Indonesia can press the pace of food imports in order to capitalize on domestic products. However, this could not be realized because of the vast agricultural land are getting increasingly narrows because of the transition functions of land either for personal interest or the public interest. Based on the description of the need for further study of the question of the form the form related to the transition of the function of the agricultural land in Indonesia, a form of legal protection of agricultural land due to the occurrence of land in Indonesia over the function. This research was conducted with the normative method. Over the function of land can occur due to the procurement of land development to public interest and the transition is done by the owner to be non-agriculture. Act 41 the year 2009 has been protecting agricultural land with sustainable food there can be no transitional function except for the public interest and the existence of land his successor. A permit must be made by the owner of agricultural land when the land will divert his farm.

Abstract

The existence of collateral institutions is very important for creditors particularly to provide certainty over the fulfillment of their rights. In Indonesia there are several collateral institutions, one of which is fiduciary, as a collateral institution, fiduciaries have advantages and disadvantages, especially in carrying out executions, therefore it is necessary to know how the execution of fiduciary collateral objects, especially executions that are based on executorial titles. This paper is based on normative juridical research, with a legal and conceptual approach. According to the research it can be concluded that based on the provisions of article 30 of the Fiduciary Law, with an executorial title, the creditor is given the right to repossess so that the creditor can directly take the object of fiduciary collateral.

Abstract

Abstract In the capital market, the existence of trustees and trustee agreements is a crucial matter for bond holders, and equitability between trustees and publicly traded entities, as well as the realization of the proportionality principle in trustee agreements, are important for the realization of the exchange of rights and obligations that fulfills the principles of justice and fairness. This study aims to understand the urgency and realization of the proportionality principle in trustee agreements as a legal protection instrument, using the method of normative legal research, through a statute approach. Based on the research and analysis, it was found that there were several proportionality principle urgencies in trustee agreements, which are to correct the enforcement of the freedom of contract principle which sometimes does not provide justice and legal protection for bond holders, to control the execution of rights and obligations of parties in the trustee agreement so that proportionality is realized and the principles of justice and fairness are fulfilled, and to function as a basis of interpretation to understand whether or not Regulation No. VI.C.4 is feasible to be carried out. It was also found that trustee agreements which were created using Regulation No. VI.C.4 as a basis do not fulfill the proportionality principle because it was not realized using the values of equitability as a basis. Key words: trustee agreement, proportionality principle, bond Abstrak Di pasar modal, keberadaan wali amanat dan kontrak perwaliamanatan merupakan hal yang krusial bagi pemegang obligasi, dan kesetaraan atas kedudukan wali amanat dan emiten serta terwujudnya asas proporsionalitas dalam kontrak perwaliamanatan merupakan hal yang penting untuk terwujudnya pertukaran hak dan kewajiban yang memenuhi prinsip justice dan fairness. Tulisan ini bertujuan untuk mengetahui urgensi dan perwujudan asas proporsionalitas dalam kontrak perwaliamanatan sebagai instrumen perlindungan hukum, dengan menggunakan metode normatif legal research, melalui pendekatan undang-undang. Berdasarkan hasil kajian dan analisis dapat diketahui bahwa terdapat beberapa urgensi asas proporsionalitas dalam kontrak perwaliamanatan yaitu untuk mengkoreksi pemberlakuan asas kebebasan berkontrak yang terkadang tidak memberikan keadilan dan perlindungan hukum bagi pemegang obligasi, untuk mengkontrol pelaksanaan hak dan kewajiban para pihak dalam kontrak perwaliamanatan agar terwujud proporsionalitas dan memenuhi prinsip justice dan fairness, berfungsi sebagai dasar interpretasi untuk mengetahui sejauh mana Peraturan Nomor VI.C.4  tersebut layak atau tidak untuk dijalankan. Diketahui pula bahwa kontrak perwaliamanatan yang dibuat berdasarkan Peraturan Nomor VI.C.4 tersebut tidak memenuhi asas proporsionalitas karena tidak diwujudkan berdasarkan nilai-nilai kesetaraan (equitability). Abstract

This study intends to find out the legitimacy of interfaith marriages according to positive law in Indonesia and private international law, especially marriages held abroad between Indonesian citizens or with a foreign national. The method used in this study was a normative juridical through a legislation approach. Basically, marriages held in Indonesia must follow the provisions of Article 2 jo. Article 56 of Law No. 1 of 1974 concerning marriage. The results of the analysis revealed that interfaith marriages cannot be held either in Indonesia or abroad since they conflict with the principles of private international law and positive law in Indonesia. Tulisan ini disusun untuk mengetahui keabsahan perkawinan beda agama menurut hukum positif Indonesia dan hukum perdata internasional khususnya perkawinan yang dilangsungkan di luar negeri di antara mereka warga negara Indonesia atau dengan seorang warga negara asing. Metode penelitian yang digunakan yaitu yuridis normatif melalui pendekatan perundang undangan, perkawinan yang dilangsungkan di Indonesia harus memenuhi ketentuan Pasal 2 jo. Pasal 56 Undang undang Nomor 1 Tahun 1974 tentang perkawinan. Hasil kajian dan analisis dapat disimpulkan bahwa perkawinan beda agama tidak dapat dilangsungkan baik di dalam maupun di luar negeri karena bertentangan dengan asas asas hukum perdata internasional dan hukum positif Indonesia.

Abstract

Regulations regarding the settlement of disputes in regional head elections are divided based on the types and qualifications of administrative violations, criminal administrative violations, electoral administrative disputes, criminal violations, outcome disputes, and ethical violations. The division of the qualifications of these problems has led to a settlement process that is not in harmony with each other. It even causes an overlapping process between one violation and another, between one judicial institution and another judicial institution, as in the case of the settlement of the cancellation of the winner of the regional head election in Bandar Lampung in 2020. This study investigates the issue of the rules for the cancellation of the candidate pair winning the regional head election. This study is normative juridical research. Furthermore, the research approach used is concept, legislation, and case approaches. The results of this study indicate that, based on the ius contituentum, the cancellation of the winner of the regional head election can be pursued through legal remedies for Criminal Administration Violations (Article 135A) which are tried by the Election Supervisory Body and Supreme Court. In addition, it can also be through the pathways of the Case of Dispute over Election Results (Article 156) which is tried by the Constitutional Court. The cancellation process by the two pathways has the potential to cause conflicting decisions on the same object, making it confusing at the execution stage.

Abstract

Pendaftaran Tanah Sistematis Lengkap (PTSL) merupakan salah satu program yang diselenggarakan oleh Pemerintah untuk membantu masyarakat dalam memperoleh sertipikat tanah yang sebelumnya bernama Proyek Operasi Nasional Agraria (1981) dan Program Nasional Agraria (2015). Kota Batu merupakan salah satu kota di Indonesia yang mengikuti PTSL untuk membantu masyarakat yang mayoritas di antara mereka belum mendaftarkan tanahnya ke kantor pertanahan Kota Batu. Tujuan penelitian ini yaitu mengetahui dan menganalisis perbandingan antara pelaksanaan Prona dan PTSL di Kota Batu. Metode analisis yang digunakan dalam penelitian ini yaitu penelitian yuridis-empiris dengan pendekatan yuridis-sosiologis. Prona di Kota Batu merupakan pendaftaran tanah sporadis, aturan terkait biaya yang ditarik dari masyarakat yang belum jelas, dan pengukuran hanya dilakukan terhadap obyek yang dimohonkan saja. Sedangkan PTSL bersifat sistematis, aturan yang jelas terkait penarikan biaya dari masyarakat, dan pengukuran dilakukan kepada seluruh bidang tanah dalam satu wilayah.Kata Kunci: Perbedaan, Persamaan, Pendaftaran Tanah Sistematis Lengkap, Program Nasional Agraria Systematic and Complete Land Registration (PTSL) is a program organized by the Government to assist the public in obtaining the certificate of the land that was formerly the National Agrarian Operation Project (1981) and National Programmes Agrarian (2015). Batu City is one of the cities in Indonesia that follow to help communities that PTSL majority among those yet to register their land to land the Batu City. The purpose of the research is to find out and analyze the comparison between the implementation of Prona and PTSL in Batu City. Methods of analysis used in this study i.e. the juridical research-empirical juridical approach-sociological. Prona in Batu City is the sporadic land register, related costs rules drawn from the communities that are not yet clear, and the measurements are only done to the object that appealed only. Whereas the systematic nature of PTSL, clear rules of withdrawal-related costs from the community, and the measurements are performed to the entire field of ground in one region.Keywords: Differences, Similarities, Systematic and Complete Land Registration, The National Agrarian Programmes

Abstract

Covid-19 is a crucial health issue, as a right that must be fulfilled because it is one of human rights and the state has responsibility for public health in the form of promotive, preventive, curative and rehabilitative activities, especially in the era of covid 19. knowing the position of public health as part of human rights and the responsibility of the State for the fulfillment of health during the Covid-19 period based on the perspective of Law Number 39 of 1999 concerning Human Rights jo. Health Law Number 36 Year 2009 concerning Health. This research is a normative juridical research, with a statutory approach and a conceptual approach using legal materials in the form of legislation and some relevant literature. The technique of collecting legal materials is carried out by literature study activities using legal materials analysis techniques in the form of grammatical, systematic, and teleological. Abstract

The weakness of supervision on the field of banking cause weakness of protection for depositors. The weakness of supervision cause amerge of infraction that lost out for depositors. This condition is caused by a large and complex of duty and responsibility oh the Indonesian Bank as the institution of banking supervisor. In order to overcome the problems, ,formed Otoritas Jasa Keuangan that replace the role of Indonesian Bank on the supervision of banks in order to protect its depositor as set out in Undang-undang Nomor 21 Tahun 2011 tentang Otoritas Jasa Keuangan. It is known that there are differences in the role of  the supervision of Indonesian bank compared to Otoritas Jasa Keuangan gainst the banking especially in order to protect its depositors, and also know that Undang-undang Nomor 21 Tahun 2011 tentang Otoritas Jasa Keuangan doesn’t meet and demand The BaselCore Principles.Keywords: Otoritas Jasa Keuangan, Protection of Depositor, Supervision.

Abstract

Abstract:The PTSL program launched by the central government is like a breath of fresh air for the people of Batu City, where the community is greatly helped in terms of the ease of obtaining land certificates. However, in the general PTSL implementation process as regulated in PP 24 of 1997, there are several irregularities and problems, particularly related to administration which does not require a transfer deed. This study uses a qualitative approach with a SWOT analysis technique. The analysis is carried out based on maximizing strengths and opportunities, but at the same time minimizing weaknesses and threats. In conclusion, the village as the spearhead of the implementation of the PTSL program has different problems, both in terms of resources and technical aspects, namely, (1) Extension or socialization that is not comprehensive because the counseling process is carried out individually on the RT RW committee. (2) Issuance of certificates of property rights whose issuance still contains several errors. 3) There are internal problems within the Village level committee team which result in obstacles in the form of a decrease in service quality. (4) There is no certainty regarding the completion period for the issuance of the Certificate of Ownership which is announced to the public or the issuance is delayed from the schedule. Then suggestions that can be given are efforts to improve infrastructure, increase human resource capacity and be more active in conducting socialization activities both to the community and village officials, which should be carried out by the Batu City Government, in this case the Batu City Land Office.Keywords: Effectiveness, PTSL, Service, Administration Abstrak:Program PTSL yang dicanangkan oleh pemerintah pusat seperti menjadi angin segar bagi masyarakat Kota Batu, dimana masyarakat menjadi sangat terbantu dalam kaitannya kemudahan pengurusan sertifikat tanah. Namun, Pada proses penyelenggaraan PTSL secara umum sebagaimana diatur dalam PP 24 Tahun 1997 terdapat beberapa penyimpangan dan permasalahan, khususnya terkait administrasi yang tidak memerlukan adanya akta peralihan. Penelitian ini menggunakan pendekatan kualitatif dengan teknik analisis SWOT. Analisis dilakukan dengan didasarkan kepada pemaksimalan kekuatan (strength) dan peluang (opportunities), namun secara bersamaan juga meminimalkan kelemahan (weakness) dan ancaman (threats). Kesimpulan, desa sebagai ujung tombak pelakasnaan program PTSL mempunyai problem yang berbeda beda baik dari segi sumberdaya maupun teknis yakni, (1) Penyuluhan atau sosialisasi yang kurang menyeluruh dikarekan proses penyuluhan yang dilaksanakan secara individu pada panitia RT RW. (2) Penerbitan sertifikat hak milik yang penerbitannya masih terdapat beberapa kesalahan. 3) Adanya permasalahan internal dalam tim panitia tingkat Desa yang mengakibatkan adanya hambatan berupa penurunan kualitas pelayanan. (4) Tidak adanya kepastian mengenai jangka waktu penyelesaian penerbitan Sertifikat Hak Milik yang diumumkan kepada masyarakat atau penerbitan mundur dari yang sudah dijadwalkan. Kemudian saran yang dapat diberikan yakni upaya perbaikan infrastruktur, peningkatan kapasitas sumberdaya manusia dan lebih aktif dalam melakukan kegiatan sosialisasi baik kepada masyarakat maupun petugas dari pihak desa harus dilakukan oleh pemerintah kota batu dalam hal ini adalah Kantor Pertanahan kota batu.Kata Kunci: Efektivitas, PTSL, Pelayanan, Administrasi
