Abstract

 Angka perceraian di Indonesia mengalami peningkatan setiap tahun. Bahkan jumlah perceraian di Indonesia rata-rata mencapai seperempat dari jumlah peristiwa nikah setiap tahunnya. Upaya pemerintah dalam menekan angka perceraian melalui prosedur mediasi di peradilan tampak belum optimal karena tingkat keberhasilan penyelesaian sengketa perdata melalui jalur mediasi pengadilan baru mencapai rata-rata 5%. Oleh karena itu, diperlukan adanya kajian mendalam peluang pelaksanaan mediasi perceraian di luar Pengadilan yang salah satunya adalah melalui Kantor Urusan Agama (KUA). Dengan menggunakan penelitian normatif empiris melalui pendekatan yuridis sosiologis, penelitian ini menganalisis potensi mediasi perceraian dalam Program Pusaka Sakinah di KUA Kayen Kidul Kabupaten Kediri dan KUA Tanjunganom Kabupaten Nganjuk. Berdasarkan hasil observasi dan wawancara dapat disimpulkan bahwa meskipun mediasi perceraian melalui program Pusaka Sakinah yang dirintis pada tahun 2019 belum terlaksana secara maksimal karena dampak penyebaran Pandemi Covid-19, upaya menyelenggarakan salah satu program pilot project Kementerian Agama ini terus digalakkan melalui pelatihan-pelatihan dan pendampingan terhadap masing-masing KUA.Kata Kunci: Mediasi, Sengketa Perceraian, Pusaka Sakinah The divorce rate in Indonesia has increased every year. Even the number of divorces in Indonesia on average reaches a quarter of the number of marriages every year. The government's efforts in suppressing the divorce rate through mediation procedures in the courts appear not to be optimal because the success rate of resolving civil disputes through court mediation has only reached an average of 5%. Therefore, it is necessary to have an in-depth study of the opportunities for implementing divorce mediation outside the Court, one of which is through the Office of Religious Affairs. By using empirical normative research through a sociological juridical approach, this study analyzes the potential for divorce mediation in the Sakinah Heritage Program at the Office of Religious Affairs (KUA) Kayen Kidul District, Kediri and Tanjunganom, Nganjuk. Based on the results of observations and interviews, it can be concluded that although divorce mediation through Pusaka Sakinah program which was initiated in 2019 has not been carried out optimally due to the impact of the spread of the Covid-19 Pandemic, efforts to organize one of these pilot project programs of the Ministry of Religion continue to be encouraged through training and mentoring to each KUA.Keywords: Mediation, Divorce case, Pusaka Sakinah

Abstract

Covid-19 is a crucial health issue, as a right that must be fulfilled because it is one of human rights and the state has responsibility for public health in the form of promotive, preventive, curative and rehabilitative activities, especially in the era of covid 19. knowing the position of public health as part of human rights and the responsibility of the State for the fulfillment of health during the Covid-19 period based on the perspective of Law Number 39 of 1999 concerning Human Rights jo. Health Law Number 36 Year 2009 concerning Health. This research is a normative juridical research, with a statutory approach and a conceptual approach using legal materials in the form of legislation and some relevant literature. The technique of collecting legal materials is carried out by literature study activities using legal materials analysis techniques in the form of grammatical, systematic, and teleological. Interpretations.

Abstract

AbstrakTulisan ini menjelaskan tentang Perubahan iklim yang membawa berbagai dampak bagi kehidupan manusia, terutama dalam permasalahan batas-batas wilayah laut suatu negara pantai. Dampak fisik yang signifikan dari perubahan iklim adalah meningkatnya permukaan air laut akibat mencairnya lapisan es di kutub-kutub bumi. Hal ini mengakibatkan adanya pergeseran garis pesisir pantai suatu negara pantai. Pergeseran garis pesisir pantai menandakan pula adanya perubahan pada garis pangkal laut yang berfungsi sebagai titik diukurnya lebar laut teritorial suatu negara pantai. Apabila garis pangkal suatu negara bergeser akibat meningkatnya permukaan air laut, maka laut teritorial dan zona maritim suatu negara dapat pula berubah. Instrumen internasional tentang Hukum Laut (UNCLOS 1982) belum mampu menjawab tantangan mengenai adanya perubahan fisik garis pangkal laut. Adanya perubahan pada garis pangkal laut suatu negara dapat mengancam keberadaan negara-negara pantai sehingga dapat merubah batas-batas maritim internasional yang sudah diakui oleh semua negara di dunia.Kata Kunci: Perubahan Iklim, Garis Pangkal, UNCLOS 1982, Laut Teritorial

Abstract

ABSTRACT The development of the subject of international law has led to the birth of rebel groups who demand their rights to a sovereign government in a region. The Taliban is an insurgent group founded by Mullah Omar in 1994 to fight political instability, corruption, and crimes that occurred in Afghanistan after the withdrawal of the Soviet Union from Afghanistan. Since the Taliban was founded until now there have been many deprivations of human rights carried out by the Taliban against the Afghan population. For example, girls who are 10 years old are prohibited from going to school, the ban on radio, television, and music broadcasting in Afghanistan. At the end of August 2021, the Taliban succeeded in overthrowing and taking over the Afghan government. This is what makes the international community confused regarding the statement of attitude towards the presence of the Taliban group. In this study, two basic questions become the object of research, namely: How is the position of the Taliban in the subject of international law and how is the recognition obtained by the Taliban after successfully controlling and leading Afghanistan according to international law. This research is normative juridical research using an international instrument approach, a conceptual approach, and a case approach. The results of this study are: the Taliban can be categorized as insurgent based on the characteristics and elements contained in the group, and the form of recognition obtained by the Taliban is in the form of acknowledging the new government, but the takeover of the government was carried out unconstitutionally (forced seizure). so the international community has not recognized it.Keywords: Taliban, Afghanistan, International Law ABSTRAKPerkembangan subjek hukum internasional menyebabkan lahirnya kelompok pemberontak yang menuntut hak-haknya kepada pemerintahan yang berdaulat dalam suatu wilayah. Taliban merupakan kelompok pemberontak yang didirikan oleh Mullah Omar pada tahun 1994 dengan tujuan untuk ketidakstabilan politik, korupsi, serta kejahatan-kejahatan yang terjadi di Afghanistan pasca penarikan Uni Soviet dari Afghanistan. Sejak Taliban didirikan hingga saat ini banyak terjadi perampasan hak asasi manusia yang dilakukan oleh Taliban terhadap penduduk Afghanistan. Misalnya anak perempuan yang sudah berusia 10 tahun dilarang untuk tayangan, musik larangan radio, televisi serta di Afganistan. pada akhir Agustus 2021 lalu, Taliban berhasil menggulingkan dan mengambil alih pemerintahan Afghanistan. Hal tersebutlah yang membuat masyarakat internasional kebingungan terkait dengan pernyataan sikap akan kehadiran kelompok Taliban. Dalam penelitian ini terdapat dua pertanyaan mendasar yang menjadi objek penelitian, yaitu: Bagaimana kedudukan Taliban dalam subjek hukum internasional dan Bagaimana pengakuan (recognition) yang didapat oleh Taliban setelah berhasil menguasai dan memimpin Afghanistan menurut hukum internasional. Penelitian ini merupakan penelitian yuridis normatif dengan menggunakan pendekatan berupa instrumen internasional, pendekatan konseptual dan pendekatan kasus. Hasil dari penelitian ini yaitu: Taliban dapat dikategorikan sebagai pemberontak berdasarkan karakteristik serta unsur-unsur yang terdapat di dalam kelompok tersebut, dan bentuk pengakuan yang didapatkan oleh Taliban berupa pengakuan terhadap pemerintahan baru,Kata Kunci: Taliban, Afghanistan, Hukum Internasional

Abstract

ABSTRACT               Not later than 7 (seven) working days from the date of signing the deed in question, the land deed official is obligated to submit the deed he made along with the relevant documents to the Land Office for registration. What if this is not done by the land deed official or it is late due to negligence, then are there special sanctions against the land deed official in question. The problems discussed are (1) How is the implementation of Article 40 section (1) of Government Regulation No. 24 of 1997 concerning Land Registration by land deed official at the Office of the National Land Agency? (2) What are the legal consequences for land deed official if they do not carry out land registration in accordance with Article 40 section (1) of Government Regulation No. 24 of 1997 concerning Land Registration?The research method used in this research is empirical juridical, with a sociological juridical approach, while the data analysis is done descriptive-qualitatively. From the results of the research, it can be concluded that (1) the implementation of Article 40 section (1) of Government Regulation Number 24 of 1997 concerning Land Registration by land deed official at the Land Office (BPN), no one is on time to meet the deadline of 7 (seven) working days, such as which is mandated by Government Regulation Number 24 of 1997. (2) The legal consequence for land deed official if it does not register land in accordance with Article 40 section (1) Government Regulation Number 24 of 1997 concerning Land Registration, is in the form of a warning and an obligation to make a certificate or statement of delay.  Keywords: Implementation, Legal Consequences, Land deed official, Land Registration.  ABSTRAKSelambat-lambatnya 7 (tujuh) hari kerja sejak tanggal ditandatanganinya akta yang bersangkutan, PPAT wajib menyampaikan akta yang dibuatnya berikut dokumen-dokumen yang bersangkutan kepada Kantor Pertanahan untuk didaftar. Bagaimana jika hal tersebut tidak dilakukan oleh PPAT atau terlambat karena kelalaiannya, maka apakah ada sanksi khusus terhadap PPAT yang bersangkutan. Adapun masalah yang dibahas adalah (1) Bagaimana implementasi Pasal 40 ayat (1) Peraturan Pemerintah Nomor 24 Tahun 1997 tentang Pendaftaran Tanah oleh PPAT di Kantor Badan Pertanahan Nasional? (2) Apa akibat hukumnya bagi PPAT apabila tidak melakukan pendaftaran tanah sesuai Pasal 40 ayat (1) Peraturan Pemerintah Nomor 24 Tahun 1997 tentang Pendaftaran Tanah ? Metode penelitian yang digunakan dalam penelitian ini adalah yuridis empiris dengan pendekatan yuridis sosiologis dan dianalisis secara deskriptif kualitatif. Dari hasil penelitian dapat disimpulkan bahwa (1) Implementasi Pasal 40 Ayat (1) Peraturan Pemerintah Nomor 24 Tahun 1997 Tentang Pendaftaran Tanah Oleh PPAT di Kantor Pertanahan/BPN, tidak ada yang tepat waktu memenuhi tenggat waktu selama 7 (tujuh) hari kerja, seperti yang diamanatkan oleh Peraturan Pemerintah Nomor 24 Tahun 1997. (2) Akibat hukumnya bagi PPAT apabila tidak melakukan pendaftaran tanah sesuai Pasal 40 Ayat (1) Peraturan Pemerintah Nomor 24 Tahun 1997 Tentang Pendaftaran Tanah, adalah berupa teguran dan kewajiban membuat surat keterangan atau surat pernyataan keterlambatan. Kata Kunci: Implementasi, Akibat Hukum, PPAT, Pendaftaran Tanah.

Abstract

The Ki Ageng Gribig Tomb area is planned to be developed as a santri village that presents a village model that carries a religious theme. People come to travel or to trade around the area. Merchants who will sell around the tomb area of Ki Ageng Gribig will live on land. If it lasts for a long time, the merchant will use a vacant lot to sell and will harm the original owner. So it is necessary to have awareness of the indigenous people living in the area around the ki Ageng Gribig tomb area to have proof of land ownership rights. The purpose of the study was to find out and analyze related to evidence of land ownership owned by the community living around the Tomb of Ki Ageng Gribg. Another purpose is to describe the urgency of ownership of the legality of land or buildings for people living around the Ki Ageng Gribig Tomb area. This research uses empirical juridical research methods with a sociological juridical approach. The result of this study is that before the birth of uupa, residents who lived around the Tomb area of Ki Ageng Gribig already had proof of rights in the form of eigendom rights and had been converted into property rights. The ownership of evidence of land ownership is very important because residents will get their full rights if one day the development of the Ki Ageng Grbig Tomb Area takes place. The certificate of land rights will be strong evidence for those who hold it, so that when the development of the Ki Ageng Gribig tomb area becomes a religious tourism village, the surrounding community will get reimbursement by the provisions of the Land Acquisition.

Abstract

The purposes of this mentoring are obtained education about perspective of cyberbullying through Law of Information and Electronical Transaction (A.K.A. UU ITE) and Fatwa MUI Number 24 Year 2017 to students that incidentally called “Generation Z”, a generation that cannot be separated from social media in their lives. The method that used in this mentoring is education in the form of training with model of participatory. It educates more motivating participants actively, not only knowledge transferring but it emphasizes on question and answers, discussion and reflection even though the interest of the students is limit, considering those activities were conducted on Zoom Application. This mentoring was succeeded to change the point of view of students that cyberbullying is a common view, cyber joke is a behaviour that must be avoided because it has an impact on juvenile delinquency, adult crime, domestic violence and suicide. It also creates friendship feud).

Abstract

Land in Malang City which is a land asset of the Malang City Government has not been registered which has resulted in some land being controlled by other parties without the knowledge of the Malang City Government. knowing the urgency of land certificate ownership of Malang City land assets and will not lose regional assets which when used by Third Parties will be a source of Regional Original Revenue. The problem to be researched is what are the legal consequences. The type of research used in this study is empirical juridical research with a sociological juridical approach. The Malang City Government is important to register its land as a city land asset, either with the right of use or the right of management. Land certificates that are already owned by the Malang City Government are able to provide legal certainty and legal protection to the Government and can increase the Regional Original Revenue of Malang City.

Abstract

Small home industry businesses (UKMRT) play a crucial role in the economy by providing income for marginalized families with limited capital. In Kedungkandang, Malang City, UKMRT, especially cassava chip producers, face challenges such as limited equipment, a lack of hygienic production knowledge, and poor financial management. This study employed Participatory Action Research (PAR) to address these issues by engaging the community in problem identification and solution implementation. Training sessions focused on financial management, hygienic production techniques, and marketing strategies. Introducing modern cassava-cutting tools and improved packaging significantly enhanced production efficiency and product appeal. Results indicated increased production capacity, higher product quality, and improved financial practices among partners. The economic impact was evident as daily income for producers increased substantially, and marketing expanded beyond local markets from 200 thousand rupiahs per day to 500 thousand rupiahs. This holistic approach, integrating economic, social, and technological aspects, highlights the potential for significant socio-economic transformation in similar communities. Further geographical expansion and product diversification are recommended to sustain and enhance these positive outcomes. The study demonstrates a replicable model for community service that effectively addresses the multifaceted needs of small home industry businesses.
