Abstract

The average person in Indonesia uses public transport in daily life. If observed in Indonesia has many diverse public transport both provided by the government and in cooperation with private parties. Neglected condition of public transportation sometimes is the main factor why traffic accident happens to public transportation. This causes many accident on land, water, even air public transportation, which in this case citizens are the victim. Government has laid out policy by providing PT Asuransi Jasaraharja as compulsory social insurance which is supposed to give compensation for public transportation’s victim in certain circumstances. However, not every citizens know their rights regarding the compensation given by PT Asuransi Jasarahardja when the traffic accident happens. Compensation has to go through particular procedure made by PT Asuransi Jasaraharja. Because if they dont, then the compensation cannot be given.In the insurance of premium services the collection is not based on the agreement between the two parties but has been regulated in the law. This is what distinguishes between the insurance of raharja services as compulsory social insurance with other insurance.

Abstract

Assurance is an important element in financial planning, but because of the low public awareness and myths that circulate in society around the insurance makes people reluctant to buy insurance products. Insurance is also known only for the upper middle class. On the other hand the realization of a prosperous society, one of which is assessed from the level of good public health. For that the government issued a compulsory social insurance in which the entire community on the mandate of the law shall be a participant of the program. Since 2011, the government has issued a regulation related to the National Social Security System and implemented through Badan Penyelenggara Jaminan Sosial (BPJS) in 2014. However, in the event it was due to political dynamics, the government under Jokowi leadership reissued Kartu Indonesia Sehat (KIS) A presidential regulation that functions the same as the existence of BPJS. This is what needs to be studied more deeply, because it is feared there will be overlapping roles and functions between BPJS and KIS them.

Abstract

The cultural heritage of a region is the identity and richness of history for the region. Given the importance of the existence of cultural heritage in an area, the local government should pay special attention to the continuity of its existence. Through inventory, listing the cultural heritages, maintenance until its restoration must be done properly and continuously. This is not only the responsibility of the local government, but it is the responsibility of all parties including the local community. But in practice, local government or society are less concerned about the existence of cultural heritage in the area. This research focuses on cultural heritage buildings in Surabaya because this city is one of the cities in Indonesia which has many buildings of cultural heritage with various conditions. Local governments need to act quickly and effectively to solve the problem, so the solution can be done by including third parties such as insurance companies engaged in the insurance of losses, which can help to cover some form of damage that occurred in the building of the reserve culture in Surabaya. From the problems mentioned above, the research method used is statute approach and conceptual approach.

Abstract

The demand for goods delivery services in Indonesia is very large. Through this service, an item can easily move from one location to another and can be utilized so that the item has more value. Freight forwarding services can not be separated from the role of motor vehicles used as a means of transport. When viewed from the classification of its type, motor vehicles consist of motorcycles, passenger cars, freight cars, bus cars and special vehicles. In the relevant regulations stipulate that the goods delivery service must be carried out using the goods car. The obligation to use the goods car that has been regulated by law is not without reason. By using freight cars, bad weather factors and shock factors due to damaged road conditions can be avoided. This can minimize the risk of damage to the goods. But in practice it is often found that the delivery of goods is done using another mean of transporation that is motorcycle. The use of motorcycles is considered more effective and efficient because it can reach even remote areas. Although assessed so, the use of motorcycles can not avoid if there are two factors as mentioned above. Then this can lead to the risk of damage to the goods. Meanwhile, the delivery of goods must be implemented properly so that the goods can be saved and secured to the destination.

Abstract

Kampong Tenggher hadir sebagai salah satu objek wisata potensial dalam upaya melestarikan adat dan budaya masyarakat Madura. Berdasarkan Undang-Undang Republik Indonesia No. 10 Tahun 2009 tentang Kepariwisataan, dalam upaya untuk mengembangkan objek wisata harus menganut prinsip kemanusian, keadilan, dan melestarikan budaya serta kearifan lokal, dalam upaya mengembangkan Kampong Tenggher menjadi objek wisata terdapat tantangan yang dihadapi. Permasalahan Kampong Tenggher yaitu rendahnya tingkat pendidikan masyarakat, rendahnya kualitas akses jalan menuju Kampong Tenggher dan kurangnya penerangan menuju dan di lokasi wisata Kampong Tenggher. Oleh karena itu, solusi dan rencana dalam permasalahan untuk program kegiatan ini adalah pembangunan dan peningkatan sarana dan prasarana penunjang pariwisata, peningkatan kualitas sumber daya manusia dan penguatan lembaga kampung wisata. Peningkatan sumber daya manusia disekitar Kampong Tenggher juga perlu diupayakan melalui pelatihan dan pendidikan kepariwisataan agar masyarakat sekitar Kampong Tanggher mampu mandiri dan berdaya serta memperbaiki dan memberikan fasilitas dan pelayaan bagi wisatawan. Dengan demikian upaya strategis perlu dilakukan untuk mewujudkan Kampong Tenggher menjadi suatu objek wisata potensial di Madura.   Development of Potential Tourism Objects “Kampong Tengher”: Challenges And Strategies. In an effort to preserve the Madurese community's customs and culture, Kampong Tenggher is being promoted as a possible tourist destination. According to the regulations of the Republic of Indonesia Law No. 10 of 2009 concerning Tourism, in order to develop tourism objects, they must adhere to the principles of humanity, justice, and the preservation of culture and local wisdom. There are challenges to overcome in order to develop Kampong Tenggher into a tourist attraction. Road access to Kampong Tenggher, as well as a lack of streetlight or to and at Kampong Tenggher's tourist attractions. So the answers and strategies for this activity program's challenges are the development and enhancement of tourist supporting facilities and infrastructure, the improvement of human resource quality, and the strengthening of tourism village organizations. Improvement of human resources around Kampong Tenggher also needs to be pursued through tourism training and education so that the people around Kampong Tanggher are able to be independent and empowered as well as improve and provide facilities and services for tourists. As a result, deliberate initiatives are required to make Kampong Tengher a prospective tourist attraction in Madura.

Abstract

Heavy vehicles are one of the modes of land transportation in Indonesia in the activity of transporting goods. A large number of transport companies creates business competition related to the supply of freight costs. To get more profit, transportation companies practice over dimension and overloading. Overloading which is more prevalent in transportation, causes losses for various groups. One of the losses can impact workers in a transportation company where the liability for the crew of the vehicle is not regulated in detail. The existence of the principle of Chain of Responsibility in regulations regarding the transportation of heavy vehicles aims to expand the responsibility for losses incurred, such as overloading practices. This principle ensures that all subjects in the logistics chain have the duty to ensure compliance with regulations, including truck owners, transportation operators, goods senders, and goods recipients.  This study discusses the responsibility of the parties in the delivery of goods related to overloading and recognizes the concept of Chain of Responsibility in transportation by land in overloading practices. The research method used is empirical juridical with a conceptual approach and a statute approach. For these problems, this study aims to analyze the accountability of the parties in overloading activities and to recognize the concept of Chain of Responsibility in land transportation in overloading practices.

Abstract

Kemajuan teknologi mendorong adanya inovasi dalam bidang transportasi, khususnya dalam penyediaan jasa pengangkutan yang efisien dan efektif untuk menenuhi kebutuhan masyarakat. Di Indonesia, ojek yang merupakan jasa transportasi dengan menggunakan sepeda motor dinilai mampu menjadi transportasi publik alternatif yang dapat mengangkut orang dari satu tempat ke tempat lainnya dengan cepat dan dengan biaya yang terjangkau. Dengan perkembangan teknologi dan transportasi di era digital seperti saat ini, ojek konvensional kemudian bertransformasi menjadi ojek online, suatu jasa transportasi yang menggunakan aplikasi online sebagai media pemesanannya. Dari sudut pandang hukum pengangkutan, perjanjian pengangkutan yang terbentuk dalam pelaksanaan ojek online merupakan suatu bentuk baru yang dinamakan kontrak online. Konsensus sebagai syarat pembentukan sekaligus salah satu sifat perjanjian pengangkutan terpenuhi dengan adanya penawaran dari aplikasi penyedia layanan ojek online dan adanya penerimaan oleh pengguna aplikasi sebagai penumpang ojek online. Para pihak dalam pelaksanaan ojek online terikat dalam suatu hubungan kontraktual yang berbeda-beda. Pengemudi dan perusahaan aplikasi terikat dalam hubungan kemitraan yang didasarkan pada perjanjian kemitraan. Hubungan kontraktual antara pengemudi dan penumpang membentuk suatu perjanjian pengangkutan, sedangkan perusahaan aplikasi dan penumpang didasarkan pada perjanjian penggunaan aplikasi.The improvement of technology encourages the innovation of transportation sector, especially for the provision of efficient and effective transportation services to fulfill the community needs. In Indonesia, ojek as a two-wheeled transportation service considered as alternative public transportation which can transport a person from one place to another in a fast way and at affordable costs. With the development of technology and transportation in this digital era, conventional motorcycle taxi (in Indonesia: ojek konvensional) transformed into online motorcycle taxi (known as ojek online), a transportation service using an online application as the ordering media. From the scope of transportation law, the transportation agreement formed by the operation of ojek online is a new form of agreement called online contract. Consensus, as a transportation agreement requirement, is fulfilled by an offer from transportation service application and an acceptance from the users as ojek online’s passenger. The parties in the operation of ojek online bound by a different contractual relation. The driver and the application company bound by a partnership agreement. The contractual relation between the driver and passenger formed a transportation agreement, while the application company and passenger based on application usage agreement.

Abstract

Neighbor law was born in the midst of community life to regulate and limit rights and obligations in neighborly relationships. One of the developments in neighbor law is the concept of servitude or property easement. Issues related to servitude right in Indonesia are still frequently encountered, often resulting in illegal actions that lead to losses for others. Therefore, based on several court decisions in Indonesia, it is necessary to conduct an in-depth study of property easements as a limitation on property rights and legal protection for those who are harmed in cases involving property rights restrictions. This research is a legal study that employs three approaches: legislative approach, conceptual approach, and case approach. The results reveal that servitude right is a restriction on property rights over land that is still applicable according to civil law provisions and is based on the social function found in agrarian law. Legal protection provided through the judicial system in Indonesia regarding cases involving property rights restrictions and violations of servitude right involves filing lawsuits by the injured party based on illegal actions. If it is proven that the defendant has committed an illegal act, the judge will issue a court order (aanmaning) to perform or cease a certain action, as well as award compensation to the harmed party for actions that violate the servitude right.

Abstract

AbstractTechnological advances which are also accompanied by awareness of the importance of protecting the environment are one of the reasons for the presence of electric buses in several cities in Indonesia. The presence of electric buses in big Indonesian cities should also be followed by clear regulations, this is important so that when carrying out transportation activities the parties involved will understand their rights and obligations. However, until now there are no clear regulations regarding the regulation of electric buses in Indonesia. For this reason, it is necessary to compare the legal regulations for electric bus vehicles as a mode of public transportation between Indonesia and Sweden. Sweden is the choice in comparing laws regarding electric buses because Sweden is a country that has clear regulations regarding electric buses. So it is hoped that it can provide input for law makers in Indonesia in making regulations regarding electric buses. This research uses normative legal research methods. Kehadiran electric bus di kota-kota besar Indonesia seharusnya juga diikuti dengan regulasi yang jelas, hal ini penting agar dalam menjalankan kegiatan pengangkutannya para pihak yang terlibat akan memahami hak dan kewajibannya. Namun sampai saat ini belum ada regulasi yang jelas terkait pengaturan electric bus di Indonesia. Untuk itu perlu kiranya melakukan perbandingan pengaturan hukum kendaraan electric bus sebagai moda angkutan umum antara Indonesia dan di Swedia. Swedia menjadi pilihan dalam perbandingan hukum terkait electric bus karena Swedia merupakan negara yang memiliki aturan yang jelas tentang electric bus. Sehingga diharapkan dapat menjadi masukan bagi pembuat undang-undang di Indonesia dalam membuat regulasi tentang electric bus. Penelitian ini menggunakan metode penelitian hukum normative. Pendekatan penelitian yang di gunakan adalah pendekatan peraturan perundang-undangan (statute approach), pendekatan konseptual conceptual approach dan pendekatan perbandingan hukum (comparative approach). Abstract

The Montreal Convention of 1999 establishes the legal responsibilities of carriers on international flights and has been ratified by numerous countries, including Indonesia and Australia. However, unlike Australia, Indonesia has yet to update its laws and regulations to align with the Convention’s provisions on carrier liability. This legislative gap may result in significant losses for air transportation service users who experience damages from aircraft accidents. This research examines the extent to which the liability provisions of the Montreal Convention have been incorporated into the national legal frameworks of Indonesia and Australia. The analysis employs three methodological approaches: statutory analysis, conceptual examination, and comparative study. The findings highlight the need for Indonesia to amend its regulations on carriers’ limited liability to comply with the standards set by the Montreal Convention, considering Australia’s best practices in its legal framework.
