Abstract

Every Environment Has Its Own Laws And Ethics Which Guide Behavior; However, It Does Not Mean That Anybody Is Able To Obey It And It Rises Three Consequences At Legal, Ethic And Social. This Research Is A Quantitative Research With Law In Action Approach, It Is A Non-Doctrinal And Empirical Social Science Study. Internet Brings The World To New Ways Of Thinking, And Communicating. Netiquette Is An Ethical Guide In Behaving / Communicating Among Netizens. Teachers’ Awareness To Communicate Well In Smk Bakti Purwokerto Is At A Poor Level. Bad Habits Communications In Real-World Are Brought Into Cyber Which Often Create Legal Issues. Although No One Has Proceeded To Justice, It Is Quite Worrying Since Their Position As Teachers Should Be Role Models For Their Students. It Is Necessary To Realize The Awareness Of Compliance With The Law And Ethics Of Cyber Communication For These Teachers.Keywords: Netiquette, Internet, Social Media, Law And Ethics, Communication.

Abstract

Ciptaan yang dibuat atau diciptakan oleh pencipta merupakan hasil karya kreativitasnya yang terjadi karena intelektual dari si pencipta. Hak cipta umumnya dimiliki oleh orang yang membuat ciptaan tersebut, namun ada beberapa pengecualian yaitu diantaranya ciptaan yang dibuat berdasarkan pesanan atau hubungan kerja. Pada umumnya pemberi kerja akan memiliki hak kekayaan intelektual yang dibuat oleh karyawannya selama masa kerja mereka. Karyawan yang menciptakan karya tanpa ada hubungannya dengan perusahaan dimana dia bekerja, maka kepemilikan hak cipta atas ciptaan tersebut ada pada si karyawaan. Konflik akan muncul jika lahirnya suatu ciptaan tanpa ada ketentuan yang jelas mengenai siapa pencipta dari karya tersebut. Tulisan ini bertujuan untuk mengungkapkan problematik kepemilikan hak cipta dimana ciptaan dibuat atas dasar pesanan atau hubungan kerja. Tulisan ini berdasarkan Penelitian yang dilakukan dengan metode pendekatan yuridis empiris. Spesifikasi yang dipergunakan dalam penelitian ini adalah deskriptif analitis. Lokasi penelitian ini adalah di Kota Semarang. Data penelitian dikumpul dengan cara wawancara, dokumentasi dan observasi langsung di lapangan. Pelaku usaha produk Batik di Kota Semarang selain memperjualkan produk batik buatan sendiri juga menjual produk berdasarkan pesanan dari sebuah perusahaan atau isntansi. Pesanan ini tidak hanya berupa kain tetapi dapat pula sampai berupa kain yang sudah dijahitkan menjadi sebuah pakaian jadi. Motif yang digunakan dapat bervariasi, umumnya atas permintaan dari pihak pemesan itu sendiri. Kegiatan sederhana ini menjadi tantangan bagi pelaku usaha maupun pihak pemesan. Manakala terjadi konflik penentuan siapa pemegang hak cipta atas motif tersebut. Jika perjanjian yang dilakukan antara pelaku usaha dengan pihak pemesan sudah membicarakan hal tersebut, hal ini akan lebih mudah untuk menentukan siapa pemilik hak cipta tersebut, namun jika perjanjian tidak menjelaskan siapa pemegang hak ciptanya maka akan terbuka konflik kepemilikan hak cipta atas motif produk batik pesanan tersebut. Abstract

This paper aims to describe and analyze the procedure for merging cooperatives in Indonesia based on applicable regulations and the legal consequences of merging these cooperatives. Cooperative is a form of cooperation in the economic area. Cooperation in cooperatives is generally conducted under the same goal: the necessities of life. In industrialized countries, cooperatives emerged as a reaction to the system of economic freedom in the 19th century, where a group of capital owners controlled people's lives. Cooperatives in several countries have merged to increase the existence and efficiency of improving their welfare. In Indonesia, the merger of cooperatives is necessary when the cooperative wants efficiency to improve welfare. Based on the study results, it can be seen that merging cooperatives was carried out to improve the welfare of members. The act of merging cooperatives was carried out with the legal provisions in Law Number 25 of 1992. It did not use the existing rules in the Law of the Republic of Indonesia No. 11 of 2020 on Job Creation.

Abstract

Globalization gives businesspeople opportunities to expand their marketing areas. However, it also triggers competitions among the businesspeople of either big, medium, small, or micro enterprises. It also impacts fisheries businesspeople, especially those belonging to small and micro enterprises since they mostly still apply traditional equipment when processing their fish or processed fish products. The application of the traditional equipment leads to the low product quality. The low quality of their fish or processed fish products induces some worries of the perishing fisheries business in Indonesia. Certification of Processing Feasibility (CPF) of fisheries and processed fish products is a means to improve fish and processed fish product quality. The implementation of the certification emerges a dilemma among the small and micro enterprises whose capital and human resources are limited. Therefore, to overcome the problem it necessary that there are some policies to protect and develop the businesses of the small and micro enterprises. The necessary policies can be in the form of business empowerment through partnerships using inti-plasma pattern.

Abstract

Jetis Village has SMEs that are engaged in modeste (sewing and embroidery) which are still implemented with conventional systems in terms of production, management and marketing. This makes SME Partners have some security when they have to face the big order season or when they have to compete with other similar SMEs that have developed modern management. UKM players who are mostly the attention in this service. This service method is 1) Observation; 2) Focus Group Discussions; 3) Dissemination; and 4) Evaluation. The results of this service are 1) activities focused on partner networking, managerial strengthening, and online marketing training through social media; 2) SME Partners understand the managerial processes that are recorded and monitored starting from financial managerial, human resources, and production raw materials; 3) SME Partners are facilitated by related agencies to have networks with raw material suppliers and potential market candidates; 4) SME Partners own and are able to assist Facebook Pages which are used for online marketing.

Abstract

Village funds are given to the village to be managed properly so that the village can provide welfare for the village community and village development. The management of village funds must be carried out gradually and carefully in its use, besides that it must be adjusted to the existing legal rules so that there is no misuse of village funds. Harjowinangun Barat Village is one of the villages in Batang Regency, where the village community still needs village funds to achieve community welfare. The village head and other village officials need to manage village funds properly following the rules and principles of good governance. The problems in this service are: (1) What are the obstacles for Harjowinangun Barat Village, Batang Regency in managing village funds? (2) How is the application of Good Governance principles in the management of Village Fund Allocation in Harjowinangun Barat Village, Batang Regency? Service activities are carried out by analyzing the problems in Harjowinangun Barat Village. After that, the team carried out a service program to realize the management of village funds following the principles of good governance. The team’s final activities were conducting discussions and forums for problem-solving around village fund management. This program aims to help government officials carry out government bureaucracy and provide assistance in managing village funds following the principles of good governance. Assistance in the transparent management of village funds for the development and development of productive economic enterprises. The West Harjowinangun BUMDes business in Batang Regency, which had been pioneered and has failed due to the pandemic, has begun to be rebuilt using village funds. In addition, the Village Fund in West Harwowinangun is planned for the construction of sports facilities.

Abstract

This paper aims to analyze the implementation of the Online Single Submission (OSS) with its advantages and disadvantages, as well as the obstacles in operating it. This study uses the socio legal method, where the legal aspect is related to the implementing OSS as a form of licensing transformation in the investment sector reduces investment processes and procedures in Indonesia, which have been considered convoluted, high-cost and do not guarantee legal certainty or the many institutions that have the authority to issue permits. Whereas the social aspect analyzes the advantages of the OSS system in displaying real time data from time to time related to business actor data, investor data that can be used as a basis for making a decision. The results shows that the constraints in the implementation of OSS are unstable internet networks in some parts of Indonesia and not all available human resources who operate the OSS system in the regions, which results in various policies made by local governments that contradict the OSS system.

Abstract

Litigasi perubahan iklim di Indonesia mengalami perkembangan cukup pesat, mengingat bertambahnya jumlah perkara dan putusan terkait gugatan litigasi perubahan iklim. Melihat praktik litigasi perubahan iklim, setelah dilakukan pemilahan serta identifikasi isu/motivasi, maka litigasi perubahan iklim di Indonesia, meliputi jenis litigasi dengan motivasi perubahan iklim bukan sebagai isu utama dan litigasi bukan motivasi perubahan iklim, namun berimplikasi pada mitigasi dan adaptasi perubahan iklim. Tujuan tulisan ini yaitu untuk menganalisis tindakan perbuatan melawan hukum yang dilakukan oleh pelaku pelanggaran hukum dengan mendasarkan kepada doktrin kesengajaan, kelalaian, pertanggungjawaban mutlak, dan tindakan faktual. Riset ini dapat memberikan pilihan advokasi kebijakan perubahan iklim melalui litigasi di pengadilan bagi para pencari keadilan.
