Abstract

One important thing that must be considered in the use of nuclear and other radioactive materials is the process of transporting radioactive substances through the sea. This paper will analyze the optimization of the supervisory authority of BAPETEN in the transportation of radioactive substances, especially in the process of transporting radioactive substances by sea. Option to choose the sea because most of Indonesia's territory is the sea. If it has the authority, Bapeten's supervisory authority will then be analyzed in the process of transporting radioactive substances via the sea lane. Recommendations from this article are a form of juridical liability if an error occurs, which causes a loss in the process of transporting radioactive substances by sea. Because the process of transporting radioactive substances is essential in preventing the occurrence of radiation, the regulatory authority in the transportation process must be regulated in detail based on the precautionary principle, as well as the form of juridical accountability.

Abstract

Dialectically, previously the handling and settlement of state administrative disputes used Law Number 5 of 1986 concerning the Administrative Court Law which was twice revised with Law Number 9 of 2004 and Law Number 51 of 2009 as the legal instrument of the procedure ( thesis). However, currently, the procedural law used in resolving state administrative and government administrative disputes also uses the Supreme Court Regulation instrument. This is because the Administrative Court Law Law cannot accommodate the development of material administrative law requirements and administrative law enforcement provided by sectoral laws. Apart from that, in practice, there have been changes and shifts in most of the content of procedural law (material and formal) in the Administrative Court Law. This shift was influenced by the enactment of Law Number 30 of 2014 concerning Government Administration and sectoral laws which later became the basis for the formation of a Supreme Court Regulation. The two regulations later became guidelines for proceedings in the Administrative Court Law which had a paradoxical relationship. In one aspect, there is an interrelation between the law on Administrative Court Laws, the law on government administration, and the regulations of the Supreme Court, but in other aspects, it creates an antinomy of norms. Therefore, it is important in legal reform to encourage systematic thinking to synchronize and harmonize the material and formal content of the material and formal procedural laws that are unified as a synthesis.Keywords: dialectics, harmonization of law, shifting, state administration judicial procedural law

Abstract

Melihat ketimpangan antara jumlah kasus korupsi pejabat pemerintahan dengan jumlah permohonan pengujian penyalahgunaan wewenang pada pengadilan yang memiliki selisih cukup signifikan, maka perlu adanya perhatian serius dari berbagai kalangan. Hak mengajukan permohonan pengujian penyalahgunaan wewenang sebagaimana pasal 21 ayat (1) Undang-Undang Nomor 30 Tahun 2014 tentang Administrasi Pemerintahan, ternyata belum sepenuhnya dimanfaatkan oleh para pejabat pemerintahan. Tujuan dari penelitian ini adalah untuk menjelaskan aspek yuridis empiris terhadap implementasi hak pengujian penyalahgunaan wewenang oleh pejabat pemerintahan di lingkungan pemerintah Kota Malang guna mewujudkan good governance. Metode pendekatan pada penelitian ini adalah pendekatan analisis kualitatif yang berdasar pada data primer berupa wawancara dan observasi serta data sekunder berupa dokumen resmi dari lokasi penelitian, internet dan regulasi yang berlaku. Hasil penelitian menunjukan bahwa secara yuridis empiris, kurangnya pengetahuan dan pemahaman para pejabat pemerintahan akan eksistensi hak pengujian penyalahgunaan wewenang sebagaimana pasal 21 ayat (1) Undang-Undang Administrasi Pemerintahan berpengaruh terhadap tidak dimanfaatkannya sarana perlindungan hukum secara optimal.

Abstract

Jaminan sosial merupakan sebuah bentuk perlindungan sosial yang diselenggarakan oleh negara Republik Indonesia  guna menjamin warga negaranya untuk memenuhi kebutuhan hidup dasar yang layak sebagaimana yang terdapat dalam Pasal 22 Deklarasi Universal Hak-Hak Asasi Manusia. BPJS dibentuk untuk dapat memfasilitasi jaminan sosial untuk masyarakat. Namun, kerugian yang dialami oleh BPJS membuat pemerintah secara terus menerus menyuntikan modal kepada BPJS. Beberapa waktu lalu, pemerintah sempat menaikkan iuran BPJS yang banyak memancing gelombang protes dari masyarakat karena kenaikan iuran tersebut diperkirakan di lakukan untuk menutup kerugianyang di alami oleh BPJS. Oleh karenanya dalam tulisan ini penulis mengambil rumusan masalah apakah kerugian yang dialami oleh BPJS masuk dalam kategori kerugian negara? Dan apakah negara harus bertanggung jawab terhadap kerugian yang dialami oleh Badan penyelenggara Jaminan Sosial (BPJS). Metode dalam penelitian ini adalah yuridis normatif dengan menggunakan pendekatan perundang-undangan.     Jika melihat unsur-unsur dari kerugian negara maka kerugian yang di alami BPJS bukanlah kerugian negara, namun pada kenyataanya negara masih saja menyuntikkan modal kepada BPJS.

Abstract

Kini, dengan keterlibatan Indonesia dalam komunitas global lewat sejumlah instrumen perdagangan dan kesepakatan ekonomi global, kehadiran TKA dianggap sebagai konsekuensi logis dari relasi global. Karena itu, pada dasarnya penggunaan TKA dalam menjalankan roda bisnis bukan sesuatu yang dilarang sepanjang memenuhi aturan main dan ketentuan perundang-undangan yang telah ada. Dalam beberapa sektor industri, bahkan TKA menjadi kebutuhan yang tidak bisa dihindari. Salah satu yang menjadi hal penting dan merupakan suatu masalah adalah kedudukan TKA dalam hal pemberian kompensasi pada perjanjian kerja waktu tertentu. Ketimpangan pemberian kompensasi terjadi pada TKI dan TKA yang bekerja berdasarkan perjanjian kerja waktu tertentu (PKWT). Penelitian ini merupakan yuridis normatif dengan pendekatan perundang-undangan.

Abstract

The commissioner of the general election administration was discharged through the decision of the General Election Administrator Honorary Council (DKPP). The decision is not final and binding at the executive branch, considering that the decision can be cancelled by the Administrative Court. This study aims to define the authority of DKPP and PTUN in resolving ethical violations committed by election administrators and parse the implications and relationships of the decisions of the two institutions. This paper also proposes an ideal concept for the design of solving ethical violations of election administrators in the future. This study uses normative juridical methods. The results showed that the DKPP and PTUN have overlapping authority but with different decisions. DKPP purely adjudicates ethical issues, and the Administrative Court adjudicates the Presidential Decree, which is a follow-up to the DKPP decision. To avoid conflicting decisions on cases that intersect, violations of the code of ethics in the future must be resolved with a settlement mechanism by the judiciary.

Abstract

The enactment of Law Number 30 of 2014 expands the competence of the State Administrative Court in protecting members of the public but also state administrators. Law Number 6 of 2023 concerning Job Creation (Law on Job Creation) mentions fictitious-positive cases in Article 175 number 6, which has changed the provisions on fictitious-positive cases. This study aims to see that the judiciary examines fictitious-positive cases after the enactment of the Job Creation Law and how the public submits requests for review of cases after the Act comes into effect. The research is normative and has a legal and philosophical approach. The research data consisted of primary and secondary materials. The authority of judges to examine fictitious-positive cases has been lost after the enactment of the Job Creation Law, reducing the use of the General Principles of Good Governance in reviewing fictitious-positive cases. However, the enforcement of the Job Creation Law seems to leave legal uncertainty for justice seekers regarding fictitious-positive matters, indicating that the reinstatement of the judiciary's authority to review applications for these fictitious-positive cases needs to be taken into account

Abstract

This study aims to understand and analyze related changes to the provisions in the Law on Notary Office and the urgency of Reconstructing the Legal Reconstruction of Attaching Fingerprints in Minutes of Deeds for Persons with Physical Disabilities. The research method used in this study is a normative legal research method with a statutory and conceptual approach. The results of this study explain that there have been several changes in the UUJN. The points that have changed in the latest UUJN are: the existence of a Special Substitute Notary; notary candidate apprentice; notary retirement age and its relation to the extension of retirement age; Notary authority in making deeds related to land; the authority of the Notary in making the minutes of the auction deed; Notary who is appointed as a State Official; and Implementation of notary position supervision. The urgency of the need for legal reconstruction is in order to achieve legal certainty from the implementation of the contents of Article 16 paragraph 1 letter (c). By reconstructing the contents of this article, the implementation can be carried out properly by a notary who is required to attach his fingerprints, especially for appearers at a notary who has physical limitations, namely the disabled. Studi ini bertujuan untuk untuk memahami dan menganalisis terkait perubahan pada ketentuan-ketentuan dalam Undang-Undang Jabatan Notaris serta urgensi Rekonstruksi Hukum Pelekatan Sidik Jari Dalam Minuta Akta Bagi Penyandang Tuna Daksa. Metode penelitian yang digunakan dalam penelitian ini adalah metode penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Hasil dari penelitian ini menjelaskan bahwa Terdapat beberapa perubahan dalam UUJN, Adapun point-point yang ada perubahan dalam UUJN terbaru yakni: keberadaan Notaris Pengganti Khusus; magang calon Notaris; usia pensiun Notaris dan kaitannya dengan perpanjangan usia pensiun; kewenangan Notaris dalam membuat akta yang berkaitan dengan pertanahan; kewenangan Notaris dalam membuat akta risalah lelang; Notaris yang diangkat menjadi Pejabat Negara; dan Pelaksanaan pengawasan jabatan Notaris. Urgensi diperlukannya rekonstruksi hukum ini adalah agar mencapai kepastian hukum dari pelaksanaan isi pasal 16 ayat 1 huruf ( c ). Dengan di rekonstruksi isi dari pasal ini maka dalam pelasanaannya dapat dijalankan dengan baik oleh notaris yang diwajibkan melekatkan sidik penghadap nya, khususnya bagi penghadap di notaris yang memiliki keterbatasan fisik yakni tuna daksa.
