Abstract

ABSTRAK Kegiatan penyuluhan hukum tentang Pendaftaran Tanah Menjamin Kepastian Hukum di desa Desa Iringmulyo Kota Metro ini bertujuan untuk memberikan pemahaman dan pengetahuan kepada masyarakat Desa Iringmulyo tentang Pendaftaran tanah sesuai dengan Peraturan Perundang-undangan, hal ini dilakukan karena meskipun pada tahun 2019 telah diadakan program PTSL di Kota Metro, tetapi beberapa masyarakat di Desa Iringmulyo belum melakukan pendaftaran tanah. sehingga tim mengusul memiliki target setelah dilakukannya penyuluhan hukum ini, mengharapkan pengetahuan masyarakat tentang pendaftaran tanah sebagai jaminan kepastian hukum hak atas tanah dan meningkatkan kesadaran masyarakat dalam hal pentingnya pendaftaran tanah. Metode yang akan digunakan dalam penyuluhan ini adalah metode ceramah, diskusi dan demonstran. Metode ceramah dengan memberikan materi tentang pendaftaran tanah oleh tim pengusul, kemudian tim pengusul dan masyarakat melakukan diskusi terkait materi yang telah disampaikan serta memberikan gambaran mengenai tata cara melakukan pendaftaran tanah. Sasaran dalam kegiatan ini adalah masyarakat dan aparat desa tempat lokasi penyuluhan hukum yaitu Desa Iringmulyo Kota Metro dan tim pengusul berharap bahwa hasil dari kegiatan penyuluhan hukum tentang pendaftaran tanah sesuai dengan tujuan dari diadakan penyuluhannya. Kata Kunci: Pendaftaran tanah, Jaminan Kepastian Hukum, Desa Iringmulyo .

Abstract

Abstract — Problems activities: 1) How to improve understanding of the rights and obligations of landowners in the hamlet Simbaringin, Sidosari Village, District Natar, South Lampung regency,?; 2) How to improve the skills of the owner of the land in the manufacture and installation of boundary marks? Problem solving is done by communicating the law on the rights and obligations of land owners, especially concerning land boundary markers and installation process. Solution methods: lectures, discussions and demonstrations. The evaluation results increased knowledge and understanding, before the activities of the mean value of 55.25, and after the activities of the mean value of 73.75. Aspects of attitude before the event no one can prepare for the installation of boundary marks, after the intervention there were 22 (55%) of people who can. The results of the activities that: there is an increased ability knowledge and understanding of the law, and be able to change the attitude from which you can not, be able to prepare. Suggested activity is continued, so that increased knowledge and understanding of the land law, to reduce land disputes. Keywords — demonstration, dissemination, land boundary markers

Abstract

Abstrak: Pengaturan Hukum Pengelolaan Sumber Daya Air di Kota Bandar Lampung. Pasal 33 Ayat (3) Undang-Undang Dasar Negara Republik Indonesia (UUDNRI) Tahun 1945 sebagai dasar konstitusi pengelolaan sumber daya alam menyatatan bahwa pemanfaatan sumber daya alam termasuk air di dalamnya harus ditujukan untuk sebesar-besarnya bagi kemakmuran rakyat. Akan tetapi dalam prakteknya, tujuan pengelolaan air untuk kemakmuran rakyat masih menghadapi berbagai kendala yang membuat tidak semua masyarakat dapat terpenuhi kebutuhan akan air baik di perkotaan maupun di perdesaan. Oleh karena itu perlu dikaji dalam suatu penelitian mengenai bagaimana kewenangan pemerintah daerah dalam pengelolaan air dan bagaimana kebijakan pemerintah daerah Kota Bandar Lampung dalam pengelolaan sumber daya air di daerah. DOI: 10.15408/jch.v2i2.2322

Abstract

Environmental management and protection is currently a fundamental problem in Indonesia. The form of environmental protection regulation is Law Number 32 of 2009 concerning Environmental Protection and Management. One form of environmental pollution found in Way Kanan Regency is environmental pollution caused by the manufacture of liquid rubber waste. The research method used is a normative-empirical research method, using a statute approach and an in-depth interview approach related to environmental law enforcement against environmental pollution. The problems that will be discussed in this study are How is Law Enforcement by the Environmental Service against environmental pollution in Way Kanan Regency and what are the inhibiting factors for the Environmental Service in implementing environmental pollution law enforcement in Way Kanan Regency.

Abstract

In certain circumstances, the minister of land and the head of the land office can register the scavenging of land rights in a parcel of land, which in this case the act was not done by the Land Deed Making Officer or PPAT. It is inversely proportional to the provisions contained in Article 37 paragraph (1) Government Regulation or PP No. 24 of 1997 concerning Land Registration which stipulates that the transfer of title to a parcel of land can only be done if it can be proven by a deed made by the authorized PPAT according to the provisions of the prevailing laws and regulations. The problem that will be discussed in this research is how the legal implications of the policy of the head of the land office in land registration? This study uses a normative legal method, with the approach to the legislation and other literature.   Based on the results of research that the policy of registering the transfer of ownership of a parcel of land carried out by the head of the land office is contrary to the provisions contained in Article 37 PP No. 24 of 1997 concerning Land Registration, so the transfer of rights to a parcel of land carried out is not legal according to law. The implication applies as long as the head of the land office explicitly registers the ownership rights to a parcel of land in an urban area, so it can be ascertained not to be categorised as a remote area as intended under Article 37 PP No. 24 of 1997. Thus, the content needs to be changed in Article 37 PP No. 24 of 1997, concerning regulation in certain circumstances. It would be better if the situation in question is specified in the torso so as not to cause multi-interpretation which can be a gap of abuse of authority so that it has the potential to harm the community.
