Abstract

Recidivism are repetion of criminal conduct by individuals on his/her life time. The Instrumen Penelitian Masyarakat or Litmas which been used by correctional system can only provide qualitative information regarding any offender to be use by judge in order to give sentence. Therefore, the need for quantitative determinant analysis to identify inmates re-offending risk factor emerge. The method use by this research gathering is survey method with inmates from Class I A Cipinang Correctional Facility. The process to analyse and identify risk determinant of an inmate for re-offending can give benefit for rehabilitation process given to the inmates. The findings shonw that drugs and/or alcohol abuse, and also emotional or personality problems are factors that correlate to criminal records

Abstract

Part of this article were input material for academic paper in renewing the Indonesian Correctional Law. This efford was conducted in 2009. The main idea of the article is stressing social reintegration as the philosophy of Indonesian corrections (Pemasyarakatan). As a philosophy, Pemasyarakatan first established in 1963-1964 period. The idea of social reintegration in Pemasyarakatan, which is influenced by Bentham and Mills utilitarianism, is not fully mean as a theory for offender treatment in prisons. In practice, the idea of community based correction is compatible with social reintegration. In order to renew the correctional law, some clause in correctional administration are important. In order to achieve the main purpose of social reintegration, whether institutionalized in prison or community based, Pemasyarakatan need appropriate fascilitative support, as well as human resource. The future law need to state the correctional administration explicitly.

Abstract

Geng Klitih di Kota Yogyakarta pada umumnya bukanlah merupakan suatu tren kekerasan yang baru. Meski demikian, hingga saat ini belum ditemukan pola pengendalian terhadap fenomena yang mendasarkan kejahatan sebagai budaya kelompoknya. Dinamika geng klitih yang cepat serta digawangi oleh para remaja di bawah umur nyatanya hanya salah satu dari banyak faktor rumitnya menangani kasus street crime tersebut. Fenomena ini tidak semata dilihat sebagai kelompok kekerasan remaja yang dikendalikan secara represif. Di dalam kriminologi budaya, klitih sebagai subkultur menyimpang yang memilih jalan bahwa kekerasan telah menjadi budaya atau crime as culture dalam lingkup pergaulan mereka. Agen kontrol sosial yang kemudian menjadi perhatian dalam penelitian ini melibatkan aparat penegak hukum sekaligus partisipasi masyarakat. Strategi pengendalian kejahatan melalui pelatihan kerja dan sejenisnya atau community based diperlukan sebagai upaya resosialisasi.

Abstract

This journal discusses Correctional Information Systems as a system that produces information from systems that work manually transitioning to computeized and online system. Correctional information system is essentially generated from fact-sourced data that is developed into information. In its development, the penal information system also developed along with the times. The Correctional System Database that has been utilized by the Directorate General of Corrections is a material for researchers to see the urgency and challenges in the development of correctional information systems at this time. The complexity of the tasks and functions of correctional requires good data management. Fact or evidence as data are collected, processed to produce information for decision making/leadership policies. This research is a qualitative research with exploratory type. Data merging technique used is the study of literature, interviews with Delphi techniques with expert speakers. The results of this study indicate the fact that there is a transition to the development of correctional information systems from several aspects (based on functions). Constraints greater than human resources. The purpose of the emergence of correctional information system is the challenges faced and the problems that will arise due to the prevention of information generated from the system.

Abstract

The research discusses the coping stigma mechanism by drug correctional clients at Class I Correctional Center South Jakarta. Research is a qualitative study and uses the method of unstructured interviews, which are conducted by interviewing narcotics correctional client and correctional supervisor who are directly related to correctional client in providing social guidance. Guidance provided to correctional clients is an effort of correctional institutions to achieve successful social reintegration. The social reintegration program in the penal system in Indonesia regarding planning assistance and supervision of criminals so that they stop committing crimes and can successfully return to the community. However, the results of the study indicate that stigma in the community towards ex-convicts still leads to negative stigma. As one of the extraordinary crimes, drugs abuse have a large impact and multi-dimensional against social, cultural, economic, and political. This makes former drug convicts more vulnerable to negative stigma in society. The results also showed that each correctional client had a different view of the stigma in the community regarding ex-convicts. Because they have different views on stigma, the coping stigma mechanism by the drug correctional client are also different. Stigma on ex-convicts in the community is seen as adversity. To overcome the adversity, correctional clients will go through resilience process including coping stigma mechanism. In the resilience process found support from the community and having a stable job will helps correctional clients overcoming the stigma given by the community.

Abstract

Incest adalah fenomena yang ternyata masih banyak terjadi dalam masyarakat. Menurut data dari Komnas Perempuan, kasus incest menempati posisi paling tinggi yang dilaporkan, yaitu sebanyak 1071 kasus dalam jangka waktu satu tahun selama tahun 2018. Korban biasanya masih di bawah umur, kemudian secara mental dia akan merasa sangat tertekan psikologisnya, ditambah dengan adanya anggapan masyarakat yang negatif terhadap diri dan juga keluarganya. Seperti kasus yang terjadi di Muara Bulian, WA (15), seorang anak yang masih dibawah umur, dimana dia menjadi korban kekerasan seksual oleh kakak kandungnya sendiri hingga menyebabkan WA hamil. Dalam keadaan yang tidak stabil secara psikologis WA dibawah pengaruh ibu kandungnya melakukan tindakan aborsi. WA dan ibu kandungnya kemudian menghadapi vonis hukuman penjara atas perbuatan mereka. Apa yang menjadi dasar pertimbangan hakim untuk menjatuhkan hukuman 6 bulan penjara terhadap WA, yang bisa dianalogikan dengan pepatah “sudah jatuh tertimpa tangga?” mengingat WA adalah korban yang seharusnya mendapat perlindungan dari Negara. Oleh karena itu penulis ingin membahas mengenai apa yang menjadi pertimbangan hakim dalam menjatuhkan hukuman terhadap korban kekerasan seksual Incest di bawah umur yang melakukan aborsi menurut teori penghukuman? Bagaimana penghukuman tersebut dapat memenuhi tujuan penghukuman terhadap korban? Kajian ini menggunakan kajian perpustakaan. Diharapkan agar dengan tulisan ini dapat menggugah pembaca untuk lebih peduli dan memperhatikan kondisi sosial masyarakat disekitar kita.

Abstract

This article aims to provide an understanding of the analysis of narcotics crime from the perspective of the economic of crime from the perpetrators point of view and to provide suggestions on how to model the prosecution of narcotics criminals from the perspective of the economic of crime. The problem is focused on the perspective of the perpetrator against the consideration of costs and benefits in narcotics crimes. To approach this problem, references are used, namely the rational choice theory from Becker, the deterrence theory from Beccaria, and the principle of utilitarianism from Bentham. The data were collected through library research and field studies, namely interviews and analyzed qualitatively. The results of the study state that the market situation for methamphetamine in Central Java Province provides benefits to perpetrators, with small capital generating large profits. Actors are not exposed to market risk but legal risk. Therefore, the distribution is carried out in small packages and the sales system is in a mineed or addressed mode so that it is safe and disconnected. This study concludes that the perpetrators have assessed the costs and benefits so that the model for overcoming narcotics crime from the perspective of the economic of crime which is analyzed with consideration of costs and benefits from the perspective of the perpetrators in committing crimes in the jurisdiction of Central Java is carried out in two ways, namely repressive and preventive.

Abstract

The Ngruki area has been in the spotlight after the Bali bombings and several acts of terrorism. Causes there are perpetrators who are caught by police in Ngruki. Also, there is a boarding school led by Abu Bakar Bakar Ba'asyir who become convicts of terrorism. This puts Ngruki Muslims associated with, even often accused of radicalism and terrorism. Ultimately, it made them uncomfortable with the behavior. The problem is accused of the Ngruki community by other people, making them perceive suffering. It is indicate that they experience victimization. This paper aims to describe the experience of the Ngruki people, who received victimization. The question is, how is the victimization experienced by the Ngruki community?. This study uses the conceptual approach of critical victimology initiated by Sandra Walkalate. This study uses a qualitative method to explore the victimization experiences of from the Ngruki community. by conducting in-depth interviews with five people who experience bad behavior due to their Ngruki identity. This study finds that their identity as Ngruki makes them victims. They get bullying, ribbing, and even discrimination from other people. Nevertheless, there are no resistances, and realize that is normal. Its shows that found "misrecognize” such as symbolic violence.

Abstract

The criminogenic organizational dynamics within the financial crime of Indonesia are reflected in the increased criminality cases from 2012 to 2020. Criminogenic organizations support the situations for both corporations and individual corporations to commit their crimes. This research identified the contributions of the criminogenic organizational aspect of financial crime in Indonesia. The applied method was the qualitative grounded theory. The researchers took the cases occurring within the period of 2012 and 2020. Then, the researchers comprehended the primary data with in-depth interviews. The researchers found the criminogenic organizational indicators within the corporate crimes were: profit-oriented ambition, expansion, and domination; business continuity and individual 'secured' position; fear of failure to reach the target; certain group loyalty; ethical perception and business morals; the bias of responsibility distribution; and tendency to promote ethnocentric approach. The results could be the initial stage to composing criminal policy in preventing corporate crime by prioritizing the corporate cultures with excellent corporate ethics.

Abstract

The enactment of Law Number 22 of 2022 concerning Corrections (Pemasyarakatan), which replaces the previous Law Number 12 of 1995, significantly changes the implementation of Correctional functions, mainly the functions carried out by Probation and Parole Offices. If in the 1995 Law Corrections is only referred to as the final part of the Criminal Justice System, the new Law emphasizes the position of Corrections which are more integrated with the entire criminal justice process, so that Correctional functions are carried out at the pre-adjudication, adjudication, and post-adjudication stages. This amendment to the law is also interesting to be studied conceptually, especially to find out what principles are contained in it that form the basis for implementing the functions of Corrections. In line with this, it is also essential to identify what kind of policy changes should be carried out regarding the functions of Probation and Parole Offices in the future with the existence of new principles and differences of provisions in terms of the implementation of corrections functions. By using conceptual analysis methods, particularly policy detection analysis, which is technically carried out in two stages; first, the analysis stage of the content of the law and second, the theoretical coherence analysis stage, this paper comes to two conclusions. First, this paper finds an affirmation of new principles in Law Number 22 of 2022, namely the principle of restorative reintegration, the principle of evidence-based treatments, the principle of individualization, the principle of continuity, and the principle of collaboration. Second, this paper identifies 5 (five) policy changes that need to be made regarding the function of the Probation and Parole Office according to those principles. The policies that must be implemented can be divided into three groups—first, the need for further operationalization of the restorative reintegration concept described by this law. Second, the need for reformulation of various instruments needed in implementing functions, especially social inquiry reports. Third, the need for facilitative strengthening, especially the quantity and quality of probation and parole officers and other facilitative supports.
