Abstract

On March 2, 2020 Indonesia recorded the Covid-19 case for the first time. Since then the trend in the number of infections has continued to increase. Likewise, the number of deaths. To anticipate the spread within the Penitentiary (Lapas), the Ministry of Law and Human Rights is releasing prisoners, through accelerating assimilation and parole. Similar policies have also been carried out by other countries in the world and are recommended by international institutions, such as the World Health Organization and the United Nations Office on Drugs and Crimes. However, the main problem behind this policy is the overcrowding condition in Lapas. The number of prisoners and detainees is always increasing, while the capacity of prisons remains. This increase is inseparable from the tendency to criminalize and imprison perpetrators of crimes. Overcrowding is the beginning of various problems in imprisonment institutions. In this paper the focus is given to the poor health problems in imprisonment. As a closed institution, prisons are places that are vulnerable to the spread of infectious diseases. The Covid-19 pandemic only further proves the potential of prisons to be a humanitarian catastrophe.

Abstract

Pidana mati di Indonesia merupakan warisan kolonial Pemerintah Belanda. Sejak Indonesia merdeka hingga sekarang, pidana mati tetap ada bahkan tersebar dalam berbagai peraturan perundang-undangan. Eksistensi pidana mati ini sesungguhnya menimbulkan polemik di kalangan ilmuwan hukum Indonesia. Ada kalangan ilmuwan hukum yang menyetujui dan ada yang menolak eksistensi pidana mati tersebut. Penelitan ini menganalisis diskursus normatif pidana mati dari kalangan ilmuwan hukum Indonesia yang menyetujuinya. Metode penelitian ini menggunakan analisis diskursus Foucault untuk melihat adanya diskursus dominan dari pidana mati. Perspektif counter-colonial criminology juga digunakan dalam tulisan ini untuk mengkaji bagaimana pengaruh teori penghukuman Barat terhadap diskursus normatif pidana mati tersebut. Hasil penelitian ini menunjukkan bahwa teori penggentarjeraan yang dipengaruhi filsafat utilitarianisme Barat sangat mempengaruhi diskursus normatif pidana mati dari kalangan ilmuwan hukum yang menyetujuinya.

Abstract

This study highlights that the practice of Public-Private Partnership (PPP) in prison, based on the experiences of various countries such as the United States, England, Australia, France, Japan, and Canada, does not have a single pattern. The diversity of PPP practice patterns in prison is identified by this study in various prison PPP models consisting of: 1) the "private governance" model; 2) the "hybrid management" model; 3) the "service infrastructure" model; and 4) the "contracting out certain limited functions" model. Through a literature study combined with an analysis of policy design theory, this study explains that the diversity of prison PPP models is based on a diverse implementation process in which there are various considerations for the implementation of each model. The various considerations for the implementation of those models are generally grouped into instrumental and political explanations. The implementation of the "private governance" model is a political and administrative decision. The implementation of the "hybrid management" and "service infrastructure" models are administrative decisions with political support. The implementation of the "contracting out certain limited functions" model is an administrative decision.

Abstract

The problem of deficit social capital within the village community has given rise to a mode of corruption related to the village. One vulnerable contribution is in the Village Head Election. This is based on the role of the community in their daily activities, which are often at stake to find village leaders to implement democracy in the village. This study discusses the importance of the role of the village community in determining the village head by looking at the village head candidates through their abilities, achievements, and integrity because this will determine the direction of a village to surrender the head of government affairs in the village so that the fulfillment of the rights and obligations of the village community can be fulfilled by using qualitative methods and case studies related to village heads who are suspects in corruption cases, as well as comparative analysis with villages that have received awards as anti-corruption villages. The research results show that strengthening social capital is the foundation for implementing meritocracy. The meritocracy built in the community is based on Leadership, service to the community, managing good village governance, strengthening supervision through local wisdom, and participation in society. So, the evaluation of village head candidates must apply a meritocracy system to prevent corruption at the village level. The community must see that village head election are a means to build village change in a better direction.

Abstract

The examination of riots in Correctional Institutions and Detention Centers has so far only revealed the triggers of the riots, without exploring how riots can occur in Correctional Institutions and Detention Centers in Indonesia. This research was conducted on riots in the period 2001-2021 which had an impact on the riots, both in terms of casualties and large material impacts. Research on 8 (eight) Correctional Institutions and Detention Centers was aimed at exploring more fundamental problems in order to understand how riots can occur in Correctional Institutions and Detention Centers. Qualitative methodology was carried out in this research in order to obtain an in-depth study of the causes of the riots that occurred. The findings of this research indicate that the cause of the riots lies in the fundamental problem, namely the existence of corrupt practices in the structures that are formed formally and informally in the operationalization of Correctional Institutions and Detention Centers in Indonesia.

Abstract

Delinkuensi anak merupakan fenomena multidimensi yang dipengaruhi oleh faktor internal dan eksternal, termasuk tanggung jawab kolektif antara keluarga, masyarakat, dan negara. Penelitian ini bertujuan untuk menganalisis: (1) kontribusi faktor keluarga (pola asuh, struktur keluarga) dan lingkungan sosial (status ekonomi, pengaruh teman sebaya), (2) tanggung jawab perkembangan kognitif anak berdasarkan kelompok usia (0-12 tahun dan 12-18 tahun), serta (3) implikasi kebijakan holistik. Metode penelitian menggabungkan tinjauan literatur sistematis dan analisis teoritis dari perspektif kriminologi (Teori Disorganisasi Sosial Shaw McKay, Teori Kontrol Sosial Hagan, dan Teori Subkultur Cohen). Hasil penelitian menunjukkan bahwa 70% kasus delinkuensi terkait dengan faktor eksternal seperti keluarga broken home (OR=2.1; p0.05) dan kemiskinan (β=0.34), sementara anak usia 12-18 tahun memiliki tanggung jawab parsial (15-20%) sesuai perkembangan kognitifnya (Piaget, 2010). Solusi efektif memerlukan pendekatan terpadu, termasuk program parenting berbasis bukti, rehabilitasi komunitas, dan revisi kebijakan perlindungan anak. Temuan ini memperkuat argumen bahwa delinkuensi anak adalah kegagalan sistemik, bukan semata kesalahan individu

Abstract

Several regions in Indonesia such as Aceh, Central Sulawesi, NTB and Maluku have experienced conflict situations with ethnic, religious, racial and inter-group backgrounds. This background carries the risk of conflict triggering acts of violence-based extremism and radicalism which of course have an impact on the development of children born and growing up in conflict areas. Extremist behavior that leads to radical actions and acts of terror involving children has occurred in Indonesia in cases of family suicide bombings. Effective interventions are needed to control the potential for radicalization in children. This research uses a qualitative approach using data collection methods through literature studies to understand and detail the dynamics related to children involved in radicalism and violent extremism, especially in the context of acts of terrorism in Indonesia. Data from literature studies are used to analyze the role of family, environment and education in building children's resilience against the threat of radicalism. Through a qualitative approach, this research explores the practice of social control modes, the role of Restorative Justice (RJ), and its implications. Analysis of the classification of children involved in terrorism based on factors such as affiliation, province of origin, age, level of radicalization, and conviction provides an in-depth understanding of their characteristics and patterns of involvement. The research results provide an overview of the potential threat of exposure to radicalism and violence-based extremism targeting children.

Abstract

The belief that consuming violent media will lead someone to commit violence is a longstanding societal concern. This concern manifests in the phenomenon of 'antis' within fandoms, which began to emerge around 2016. Initially driven by shipping conflicts, the issue of social justice and the increasing use of social media have allowed this phenomenon to spread easily across various fandoms worldwide. Antis' behavior can be seen as a form of moral panic in several ways: by associating pro-shippers—those who do not agree that consuming violent content will turn someone into a perpetrator or supporter of violence—with sexual offenders and pedophiles, antis use an 'us versus them' mentality to uphold their moral standards and portray themselves as the most moral group.

Abstract

The Ngruki area has been in the spotlight after the Bali bombings and several acts of terrorism. Causes there are perpetrators who are caught by police in Ngruki. Also, there is a boarding school led by Abu Bakar Bakar Ba'asyir who become convicts of terrorism. This puts Ngruki Muslims associated with, even often accused of radicalism and terrorism. Ultimately, it made them uncomfortable with the behavior. The problem is accused of the Ngruki community by other people, making them perceive suffering. It is indicate that they experience victimization. This paper aims to describe the experience of the Ngruki people, who received victimization. The question is, how is the victimization experienced by the Ngruki community?. This study uses the conceptual approach of critical victimology initiated by Sandra Walkalate. This study uses a qualitative method to explore the victimization experiences of from the Ngruki community. by conducting in-depth interviews with five people who experience bad behavior due to their Ngruki identity. This study finds that their identity as Ngruki makes them victims. They get bullying, ribbing, and even discrimination from other people. Nevertheless, there are no resistances, and realize that is normal. Its shows that found "misrecognize” such as symbolic violence.
