Abstract

Abstact : Local wisdom is part of the field of community life that reflects the cultural values. Every region in Indonesia has its own local wisdom, some of which is still preserved today. For the example, one of the local wisdoms in Bengkulu community, Tabot festival which is routinely held every year that it has religious values and local culture. But in its implementation, there are things that are debated, especially regarding the tendency for practices that are contrary with the values of Islam. Therefore, in this article will discuss about  the local wisdom of the Bengkulu people in the Tabot Festival and the concept of the Tabot Festival based on the Receptio In Complexu theory.Keywords: Local Wisdom; Tabot Festival; Receptio In Complexu Theory.

Abstract

Penelitian ini bertujuan untuk mengetahui, mengkaji dan menganalisis, pelaksanaan dan model pemberian Bantuan Hukum bagi masyarakat miskin di Kota Bengkulu. Penelitian ini merupakan penelitian hukum empiris dengan melakukan wawancara langsung kepada Kantor Wilayah Kemenkumham Bengkulu dan Lembaga Bantuan Hukum Respublica. Hasil penelitian menunjukkan bahwa pelaksanaan pemberian bantuan hukum telah sesuai peraturan perundang-undangan namun anggaran Negara yang digunakan sebagai dana pemberian bantuan hukum kepada masyarakat tidak mampu masih sangat kurang. Prosedur pelaksanaan kegiatan yang dilakukan organisasi bantuan hukum yang ada di kota Bengkulu secara umum merujuk pada ketentuan yang diatur dalam peraturan pemerintah no. 42 tahun 2013, namun teknis pelaksanaannya dilakukan oleh masing-masing organisasi tersebut. This study aims to identify, study and analyze, the implementation and model of providing legal aid to the poor in Bengkulu City. This research is an empirical legal research by conducting direct interviews with the Bengkulu Regional Office of the Ministry of Law and Human Rights and the Respublica Legal Aid Institute. The results showed that the implementation of the provision of legal aid was in accordance with statutory regulations, but the State budget which was used as funds for providing legal aid to the poor was still lacking. In general, the procedures for implementing activities carried out by legal aid organizations in the city of Bengkulu refer to the provisions stipulated in government regulation no. 42 of 2013, but the technical implementation is carried out by each of these organizations.

Abstract

Abstract: Aside from being located as an autonomous region, it is also located as an administrative area; therefore, in addition to regulating the autonomous region, the Governor as the regional head also acts as the central representative in the regions. However, as the head of the region, the Governor is also responsible for regulating his autonomous region and also responsible to the people who elect him. The research objective is to discuss the constitutionality of the Governor's position as the representative of the central government in the region based on the 1945 Constitution of the Republic of Indonesia. The type of research used in this Studi is normative. The results showed that the Governor in carrying out his government in accordance with the mandate of the constitution performed its duties as regional head based on autonomy and assistance tasks. Based on the conclusions that can be drawn about whether the task is interpreted and the authority of the Governor is based on the principle of Deconcentration, the Position of the Governor is the Central Representative in the region and is an expansion of government in the administration of government.Keywords : Governor; Autonomy; Government

Abstract

Abstract: The Republic of Indonesia is a unitary state which in the implementation of governance in the regions is based on the principle of decentralization. Then this principle gave birth to the meaning of autonomy with the substance of the transfer of authority in the implementation of government in the regions. The district / city government in carrying out its government based on the principle of autonomy, does not rule out fraud or violations both in carrying out its duties and authorities and in making district / city regional policies, because in the current era of regional autonomy, there is a tendency for autonomy to be interpreted as regional freedom to do anything without intervention from the Governor as the representative of the central government in the regions.The purpose of research is to determine the supervisory authority and the provincial government's supervisory model for regency / city administration based on law number 23 of 2014 concerning regional governance. This is the normative law research. The results showed that the central government's supervisory function was present to prevent conflicts between authorities. Supervision from the central government to local governments is commonly carried out in the form of preventive supervision and repressive supervision. Considering this, so this is the importance of supervision from the provincial government to the administration of district / city governments in order to strengthen the implementation of regional autonomy in accordance with the mandate and objectives of regional autonomy. Keywords: Authority; Control; Local government

Abstract

ABSTRAKKetentuan Pasal 28H UUD NRI Tahun 1945 pada pokoknya menyatakan bahwa setiap orang berhak mendapatkan lingkungan hidup yang baik dan sehat, sebagai hak atas lingkungan yang wajib dipenuhi oleh negara. Namun, pada kenyataannya hadirnya korporasi pertambangan batubara di Provinsi Bengkulu sejak tahun 1986 menjadi ancaman serius bagi masyarakat dan lingkungan hidup. Dalam Kawasan Hutan Provinsi Bengkulu setidaknya terdapat sembilan korporasi, WIUP batubara tersebut merupakan Daerah Resapan Air yang tidak terpisahkan dari DAS Air Bengkulu. Pemberian Izin Pertambangan batubara yang tidak sesuai dengan Daya Dukung dan Daya Tampung Lingkungan Hidup menjadi penyebab kerusakan dan pemusnahan ekosistem yang berdampak terhadap bencana ekologis banjir dan longsor sepanjang tahun pada landscape hulu, tengah dan hilir DAS Bengkulu. Pemusnahan ekosistem akibat pertambangan ini dapat dikategorikan kedalam kejahatan Ecocide yaitu kejahatan kehancuran atau hilangnya ekosistem suatu wilayah tertentu, baik dilakukan oleh manusia atau penyebab lain, sehingga kenikmatan perdamaian penduduk di wilayah tersebut berkurang.Kata kunci: DAS; ECOCIDE; kawasan hutan.ABSTRACTThe provisions of Article 28H in the Constitution of the Republic Indonesia 1945 basically states that every person has the right to get a Good and Healthy Environment, this is a right to the environment that must be fulfilled by the State. However, in reality the presence of the coal mining corporation in Bengkulu Province since 1986 posed a serious threat to the community and the environment. Within the Bengkulu Province Forest Zone there are at least nine coal mining corporations, the coal mining permit area (WIUP) is a water catchment area (DRA) and an inseparable part of the Air Bengkulu River Basin. The granting of coal mining licenses that are not in accordance with the Environmental Support and Capacity is the cause of ecosystem damage and destruction that impacts on ecological disasters of floods and landslides throughout the year in the upstream, middle and downstream landscapes of the Air Bengkulu River Basin. Ecosystem destruction due to coal mining can be categorized into Ecocide crime, namely the crime of destruction or loss of ecosystem of a certain area, either done by humans or other causes, so that the enjoyment of peace of the population in the region is reduced.Keywords: ECOCIDE; forest are; watershed.

Abstract

After the amendment, there was a rearrangement of the constitutional system building towards a more democratic one in accordance with the demands of reform. This occurs as a result of a shift in the Indonesian constitutional system, one of which is a shift in the paradigm of state institutions. Changes in the position of state institutions have consequences on their duties and authorities. This research is a normative legal research that uses a conceptual and statutory approach. This research discusses and analyzes the problems of structuring the position and authority of the People's Consultative Assembly of the Republic of Indonesia; the existence and position of the People's Consultative Assembly as a State institution equal to other state institutions; and Amendments to the Constitution as stipulated in Article 37 of the 1945 Constitution of the Republic of Indonesia. The urgency of structuring the position and authority of the People's Consultative Assembly is a problem in itself in responding to Indonesia's current constitutional challenges. The 1945 Constitution of the Republic of Indonesia after the amendment did not place the MPR as the highest state institution, but was equal or equal to other state institutions. The MPR is also no longer the full actor of people's sovereignty, and its authority is very limited, including in amending the constitution, but the limited powers of the MPR do not mean that constitutional amendments cannot be made. Keywords: Arrangement; Position; Authority. AbstrakPasca amandemen, terjadi penataan ulang terhadap bangunan sistem ketatanegaraan kearah yang lebih demokratis sesuai tuntutan reformasi. Hal ini terjadi akibat dari pergeseran sistem ketatanegaraan Indonesia, salah satunya pergeseran paradigma kelembagaan negara. Perubahan kedudukan lembaga-lembaga negara mempunyai konsekuensi pada tugas dan wewenang. Penelitian ini merupakan penelitian hukum normatif yang menggunakan pendekatan konseptual dan perundang-undangan. Penelitian ini membahas dan menganalisis permasalahan penataan kedudukan dan kewenangan Majelis Permusyawaratan Rakyat Republik Indonesia; keberadaan dan Kedudukan Majelis Permusyawaratan Rakyat sebagai lembaga Negara sejajar dengan lembaga negara lainnya; serta Perubahan Undang-Undang Dasar sebagaimana diatur dalam Pasal 37 Undang-Undang Dasar Negara Republik Indonesia tahun 1945. Urgensi penataan kedudukan dan kewenangan Majelis Permusyawaratan Rakyat menjadi sebuah problematika tersendiri dalam menjawab tantangan ketatanegaraan Indonesia saat ini. UUD NRI 1945 setelah amandemen tidak menempatkan MPR sebagai lembaga Negara tertinggi, tetapi sejajar atau sederajat dengan lembaga-lembaga negara lainnya. MPR juga bukan lagi sebagai pelaku penuh kedaulatan rakyat, dan kewenangannya sangat terbatas termasuk dalam mengubah undang-undang dasar namun dengan terbatasnya kewenangan MPR bukan berarti tidak bisa dilakukannya perubahan konstitusi. Kata Kunci:  Penataan; Kedudukan; Kewenangan.

Abstract

ABSTRACTThis paper seeks to examine the urgency of harmonization of draft regional regulations by analyzing the challenges and strategies for the formation of Indonesian laws and regulations in the context of strengthening regional autonomy. The results of the discussion show how important the process of harmonization of regional regulations is, in order to avoid overlapping various other regulations so that later regional regulations comply with the principle of establishing regional regulations. In addition, there are challenges in the harmonization process where the long and non-uniform bureaucratic process causes the harmonization process to take a long time. So that a strategy is needed to overcome this where the importance of increasing knowledge of human resources in local governments is related to the preparation of regional regulations. Therefore, it is important to institutionalize institutions regarding the harmonization of legal products in the regions, so that regional governments in the context of carrying out regional autonomy and specialties are not held hostage and dependent on the central government.KEYWORDS: Urgency of Harmonization, Regional Regulations, Challenges and Strategies, Regional Autonomy. ABSTRAKTulisan ini berusaha untuk mengkaji Urgensi Harmonisasi Rancangan Peraturan Daerah dengan menganalisis Tantangan dan Strategi Pembentukan Peraturan Perundang-undangan Indonesia Dalam Rangka Penguatan Otonomi Daerah. Hasil pembahasan menunjukan betapa pentingnya proses harmonisasi peraturan daerah, agar menghindari overlapping berbagai regulasi lainnya sehingga nantinya peraturan daerah taat akan asas pembentukan peraturan daerah. Selain itu terdapat tantangan dalam proses harmonisasi dimana proses birokrasi yang panjang dan tidak satu pintu menyebabkan rentang proses harmonisasi memakan waktu yang cukup lama. Sehingga diperlukan sebuah strategi mengatasi hal tersebut dimana pentingnya meningkatkan pengetahuan sumber daya manusia di pemerintah daerah terkait dengan penyusunan peraturan daerah. Oleh karenanya penting melembagakan kelembagaan mengenai harmonisasi produk hukum di daerah, agar pemerintah daerah dalam rangka menjalankan otonomi dan kekhususan daerah tidak tersandera dan bergantung kepada pemerintah pusat.KATA KUNCI : Urgensi Harmonisasi, Peraturan Daerah, Tantangan dan Strategi, Otonomi Daerah.

Abstract

Freedom of religion or belief (FoRB) is one of the human rights stated in the 1945 Constitution. Article 29 paragraphs (1) and (2) of the 1945 Constitution. The recognition of religion guarantees the independence of each of its inhabitants to embrace their respective religions and to worship according to their religion or beliefs. The state guarantee on FoRB consists of assurance for the internal and external forums. Freedom to embrace religion or belief is an internal forum for everyone, an absolute right as regulated in ICCPR that Indonesia has also ratified. In fact, this provision is also regulated in Article 28 I paragraph (1) of the 1945 Constitution. The fulfillment of the right to FoRB is frequently discriminated against in Indonesia. The  issue of forcing to wear school uniforms with hijab for non-Muslim female students is still common in many public schools in Indonesia. The State has issued a joint decree (SKB) of 3 ministers to normalize the discriminatory status quo. However, the attempt to return it to its normal position was thwarted by the LKMM, which carried out the SKB test. Unfortunately, the Supreme Court (SC) canceled the SKB because schools have the right to carry out religious education and instilled values. The judges ratio decidendi made by the SC Justices were very dry from the perspective of freedom of religion or belief in canceling the 3 Ministerial Decrees. The judge saw the issue of forcing to wear hijab on non-Muslim students from the perspective of the majority religious thought without noticing that Indonesian society is very diverse. Therefore, the protection of the right to FoRB should also safeguard the religious minorities rights. This paper will examine decision made by judiciary power in term protecting the FoRB right. This verdict will be reviewing toward to justice consideration (ratio decedendi) and legal archicteture in filling the norm FoRB. Moreover, it will also appraise to judicial behavior based on breakfasting theory.

Abstract

The impact of legal uncertainty is not only limited to public confidence in the legal system, but also prolongs the process of resolving cases, thus burdening law enforcement agencies. The purpose of this study is to analyze the influence of legal certainty provided for in law no. 02 of 2002 on the effectiveness of law enforcement in Indonesia and describe the importance of legal certainty in creating a more effective and efficient law enforcement system. This research uses normative juridical methods, that is, research methods that examine legal norms contained in legal regulations as well as relevant legal theories. Legal certainty in law No. 02 of 2002 emphasizes the importance of clarity, consistency and accessibility of the law in the enforcement of police duties. Legal uncertainty can lower people's trust in the law and fuel injustice. Dampak dari ketidakpastian hukum tidak hanya terbatas pada kepercayaan masyarakat terhadap sistem hukum, tetapi juga memperpanjang proses penyelesaian perkara, sehingga membebani lembaga penegak hukum. Tujuan penelitian ini untuk menganalisis pengaruh kepastian hukum yang diatur dalam Undang-Undang No. 02 Tahun 2002 terhadap efektivitas penegakan hukum di Indonesia serta Mendeskripsikan pentingnya kepastian hukum dalam menciptakan sistem penegakan hukum yang lebih efektif dan efisien. Penelitian ini menggunakan metode yuridis normatif, yaitu metode penelitian yang mengkaji norma-norma hukum yang terdapat dalam peraturan perundang-undangan serta teori-teori hukum yang relevan. Kepastian hukum dalam Undang-Undang No. 02 Tahun 2002 menekankan pentingnya kejelasan, konsistensi, dan aksesibilitas hukum dalam penegakan tugas kepolisian. Ketidakpastian hukum dapat menurunkan kepercayaan masyarakat terhadap hukum dan memicu ketidakadilan.
