Abstract

OJK telah mempraktikkan model penyelesaian sengketa dengan fasilitasi. Tujuan penelitian ini adalah untuk mengetahui efektifitas penyelesaian sengketa perbankan syariah melalui OJK dan implementasi model penyelesaian sengketa yang diterapkan. Penelitian ini merupakan penelitian hukum normatif dan empiris yang menggunakan analisis kualitatif dengan paradigma konstruktif. Otoritas Jasa Keuangan (OJK) dalam praktiknya telah efektif menerapkan model penyelesaian sengketa yang dikenal dengan teknik fasilitasi, dengan melakukan klarifikasi kepada para pihak, dengan capaian seluruh pengaduan yang diterima OJK melalui bagian edukasi dan perlindungan konsumen di OJK DIY maupun Jawa Tengah dapat diselesaikan sesuai dengan jangka waktu yaitu 20 (dua puluh) hari kerja dengan perpanjangan hingga 30 (tiga) puluh hari kerja dengan tingkat keberhasilan 100 %.

Abstract

The existence of marriage law in Indonesia has involved various interests such as religion, state, and women. In this sense, Indonesia expects to have a uniform marriage law in order to reduce gap and tension among the existing legal systems, namely Civil Law (Dutch Law), Adat law and Islamic law (fiqh). The research aims to study critically the reasons behind the gap between Fiqh Munakahah and Marriage Law Act in cause of marriage under age, to find out alternative policy resolving the gap. The research is normative legal research with non-doctrine approach. Both library and field research are conducted. The research find out that the alternative policy to overcome the gap is by enforcing legal sanction in marriage law, promoting more intensive legal awareness in the society and formulating a clearer provision in the marriage law act. Particularly on minimum age for marriage, therefore society might accept the law sociologically and philosophically.

Abstract

Abstrak: Keberadaan nadzir yang kompeten dan kredibel dalam melaksanakan tertib administrasi perwakafan yang baik adalah kunci utama (conditio sine quanon) dalam mewujudkan pengelolaan wakaf yang tepat guna dan berhasil guna.  Saat ini Pimpinan Cabang Muhammadiyah Kasihan Bantul telah  mengelola 109 objek dari 191 objek (57,06 %) tanah wakaf yang telah bersertifikat se-Kecamatan Kasihan. Sayangnya, keterbatasan jumlah pengurus PCM/Majelis Wakaf, telah menimbulkan persoalan diantaranya pengelolaan aset wakaf yang tersebar di ranting-ranting tidak ditangani langsung oleh Pengurus Majelis Wakaf, tetapi dikelola oleh tokoh-tokoh Muhammadiyah di tingkat Ranting yang pada umumnya tingkat pengetahuan dan keterampilan mereka tentang perundang-undangan wakaf, fiqh wakaf, pengadministrasian   wakaf tidak sama/ tidak merata dan cenderung masih kurang. Oleh karena itu pengabdian ini bertujuan untuk meningkatkan wawasan dan pengetahuan nadzir di lingkungan PCM Kasihan tentang tugas dan fungsinya dalam mengelola amanah aset wakaf dari wakif sesuai dengan ketentuan fikih maupun peraturan perundang-undangan wakaf yang berlaku. Hasil dari pengabdian yang telah terselenggara menunjukkan adanya peningkatan wawasan peserta pengabdian yang sangat signifikan dari semula 35% menjadi 77% yang diukur sebelum (Pre-Test) dan sesudah kegiatan berlangsung (Post-Test). Abstract:  The existence of a competent and credible nadzir in carrying out an orderly good waqf administration is the primary key (conditio sine quanon) in realizing the effective management of waqf. Currently, The Branch of Muhammadiyah Management of Kasihan Bantul has managed 109 objects out of 191 items (57.06%) of the certified waqf land in Kasihan District. However, the limited number of Wakaf Council administrators at PCM level has caused the management of waqf assets are scattered in branches at 4 sub-districts by Muhammadiyah figures.   These figures generally lack competencies and skills about waqf legislation, fiqh waqf and administration of waqf assets. Therefore, this community service aims to increase the competency and knowledge of nadzir (waqf administrators) in PCM Kasihan Bantul regarding their duties and functions in managing the trusted waqf assets from waqif following the provisions of fiqh and the prevailing waqf legislation. The community service results show that there is a very significant increase in the participants' insight from 35% to 77%, which is measured before (Pre-Test) and after the activity takes place (Post-Test).

Abstract

One of the most significant concerns in the practice of Sharia Rural Banks is Islamic compliance. This is necessary to guarantee that the policies, provisions, processes, and procedures, as well as the Sharia Rural Bank’s (BPRS) business activities, are in accordance with the provisions and Sharia Principles. The aim in this paper is to extensively evaluate whether Sharia rural banks have completely implemented and conformed with Sharia norms and values, particularly when it comes to Murabaha financing practices. It elaborates on the compliance assessment from the initial application of Murabaha to its complete execution. It also explores the BPRS debt settlement plan, which is in accordance with the DSN-MUI Fatwa, and discusses the OJK Policy on the restructuring process during the Covid-19 crisis. The paper used a normative-empirical research method with employing statutory and conceptual approaches. The análysis of data is described in qualitative-descriptive where the data was obtained from library and empirical research. The findings show that, with a few outliers, the DSN-MUI Fatwa and OJK Policy are implemented in the execution of Murabaha contracts at BPRS. Even during a pandemic crisis, when many customers were unable to settle their debts, the bank was compelled to postpone the debt while still adhering to Sharia principles. However, certain features, particularly the application of the Murabaha contract that is preceded by a wakalah contract, are thought to be in contradiction of the DSN-MUI fatwa on Murabaha.

Abstract

Sharia digital payments have lately emerged as one of the most significant innovations and breakthroughs in the field of Islamic economics in Indonesia. However, behind the positive side of the use of sharia e-wallets, there is one thing that all parties involved need to pay attention to, which if ignored can become a double-edged sword for its users, namely compliance, security, and personal data protection. The paper aims to investigate how the Indonesian government regulates data privacy for Islamic e-wallet users. It also investigates the potential risks and challenges of Islamic digital payments particularly in regard to data protection. Besides, it also investigates whether or not the sharia e-wallet has complied with the Fatwa of National Sharia Council (DSN-MUI). The study used normative research methods employing statutory, case, and conceptual approaches. This study reveals that the use of sharia e-wallets in Indonesia is essentially in compliance with Islamic principles as stated in the Fatwa of the National Sharia Council. As for the protection of personal data, in fact, this has been regulated in a comprehensive manner by the government and related state institutions such as Bank Indonesia and the Financial Services Authority. However, the government still has work that must be considered in regard to the compliance of sharia digital payment operators with established laws and regulations, where in the event of the operators violated the use of data privacy, thus they will face a severe sanctions stipulated by the prevailed rule.
