Abstract

Land purchase binding agreement in practice is often made in the form of an authentic deed before a Notary, so that the Deed of Sale and Purchase Agreement is an authentic act that has the strength of evidence is perfect. It is intended by the parties to further provide protection and legal certainty for the parties to make. Because notaries in making an act impartially and safeguard the interests of the parties objectively. With the help of the notary of the parties make binding sale and purchase agreement will get help in formulating the things that will be agreed upon. The method used in this research is normative juridical approach to literature. Legal protection of the fulfillment of the rights of the parties where one party is in default under the agreement binding sale and purchase is dependent upon the strength of the agreement binding sale and purchase is made, that if made by deed under the hands of the protection in accordance with the protection of the deed under the hand, whereas if it is made by or in the presence of a Notary, the account will automatically become a notary deed so that the protection is in accordance with the power of protection against authentic deeds.

Abstract

Flats as a place to live with the hope of meeting the needs of the community, especially those who live in cities, there is no reduction in excessive land use and creating infiltration areas for water. With the increase in the number of people in 2010-2020 with an annual average of around 1.25%, it indirectly results in greater decent housing due to the dense population and limited land in the city, thus creating flats. The purpose of the study is to analyze the signing of the Sale and Purchase Binding Agreement (PPJB) for flats, the legal consequences if the developer of the flat goes bankrupt and dispute resolution if the settlement period by the developer defaults on the PPJB flats. The normative juridical method used in this study. With the results, the process of making PPJB flats must meet Article 1320 of the Civil Code as a condition for the validity of the agreement and be made before a Notary. Consequence with a declaration of bankruptcy against the developer resulting in general confiscation of the assets of all assets owned by the developer. Settlement of disputes caused by the inappropriateness of the apartment unit building or the lapse of the settlement period carried out by the developer, is carried out through a non-litigation process (out of court) and if there is no reconciliation, it can be continued with the litigation process (through the court process).

Abstract

The government established a Draft Law cipta Kerja has the aim of making it easier for businesses in Indonesia to set up their businesses.This draft law is one of the urgency that is expected to be a barometer increase in the business world where Indonesia is still fifth in ASEAN.This is what makes the government always make regulations so that the community is easier in setting up its business, especially for Micro and Small Businesses.The Work Copyright Bill contains many additional rules, especially those related to the founder of a business entity.One of the things that is considered by the government to facilitate the community in setting up a business is by forming a new type of business entity, namely Individual Limited Liability Company (Micro and Small Business) that can be established only by 1 (one) person.With the hope that it can make it easier for businesses, especially micro and small businesses in setting up their businesses by facilitating the terms and minimizing capital.

Abstract

The spread of promotional materials in the modern world is greatly helped by advances in technology. The wedding ran smoothly because of the actions of many people and groups, such as the wedding organizer (WO). This study aims to explain the regulation of criminal acts and criminal liability for WO business actors who advertise underage marriages through social media and websites, as well as possible criminal penalties and sanctions that can be used against those who are responsible for advertising violations. This investigation is based on methods for analyzing descriptive-analytic studies, legal-normative analysis, and qualitative data. This legal writing is largely about studying a statewide collection of literature, data, and documentation for legal instruments. The results of the discussion explained that companies that encourage underage marriages violate Article 59(2)(d) of Law No. 35 of 2014 concerning Child Protection. Law Number 16 of 2019 concerning Marriage Article 7 Paragraph 1 states that underage child marriage is invalid. This is because it is against the law because you have to be 18 years old to get married. Article 8 paragraph 1 letter an of Law Number 8 of 1999 concerning Consumer Protection states that WO business actors advertising underage child marriages is against the law. As stated in the first sentence of article 27 of Law Number 19 of 2016 concerning ITE, it is a crime to advertise in a way that is against the law and is not in accordance with statutory regulations. When the subjective and objective requirements of Article 20 jo. Article 60 paragraphs (1) and (2) of Law No. 8 of 1999 concerning Consumer Protection and Article 45 paragraph (1) of Law No. 19 of 2016 concerning Information and Electronic Transactions are fulfilled, the perpetrators can be held accountable for their actions.

Abstract

The three objectives of this study are to: (1) ascertain the parentage of children in unregistered marriages; (2) ascertain the legal ramifications if children in a marriage are not registered under Indonesian law; and (3) ascertain the judge's legal considerations in decision Number 483/Pdt.P/2023/PA.Krs. Empirical and normative legal research are the types of research used in this study. The source and secondary legal materials employed in the data analysis were literary techniques, which were then examined using qualitative approaches. The study's findings indicate that the legal framework dictating how the parentage of children born to unregistered marriages is determined is routinely reviewed. This study makes reference to the laws governing marriage, No. 1 of 1974, and population management, No. 23 of 2006. Marriages that are both registered and unregistered are still regarded as legitimate but are subject to legal repercussions because the unregistered marriage. Marriages that aren't formally recorded with the Civil Registry office. Marriages that are not officially recognized by the Civil Registry Office have an effect on the children as well as the husband and wife legally.

Abstract

Pelecehan seksual terhadap anak meningkat setiap tahun dapat dilihat dari data Tahun 2019 dengan jumlah 216 kasus sampai Tahun 2021 sebanyak 953 kasus. Tahun 2023 jumlah anak di Medan sebanyak 76.101 jiwa sehingga perlu upaya mencegah kekerasan seksual agar jumlah anak di Medan terhindar dari kekerasan seksual. Penelitian bertujuan menganalisis pengaturan penghapusan kekerasan seksual pada anak, menganalisis upaya penanggulangan kekerasan seksual pada anak. Metode penelitian menggunakan metode Yuridis Empiris, melakukan wawancara narasumber. Kekerasan seksual pada anak merupakan kejahatan kekerasan fisik dan nonfisik, diatur pada Pasal 4 huruf a, b, Pasal 5, Pasal 6 huruf a, b Undang-Undang TPKS No.12 Tahun 2022. Upaya penanggulangan kekerasan seksual sesuai Undang-Undang Perlindungan Anak diatur dalam Pasal 76D, 76E, Pasal 81 ayat 1, Pasal 82 ayat 1 dan pada Pasal 1 ayat (3), Pasal 5 Peraturan Pemerintah No. 70 Tahun 2020 tentang Kebiri Kimia merupakan upaya penanggulangan kekerasan seksual pada anak secara penal. Upaya penanggulangan kekerasan seksual terhadap anak secara non penal di sekolah dilakukan melalui sosialisasi penyuluhan kepada murid, peran orangtua memberi edukasi seks sejak dini, mengajarkan anak bagian tubuh yang tidak boleh disentuh, mengawasi penggunaan handphone, peran KPAI untuk memberikan pengawasan dalam memeriksa, memantau, mengevaluasi pelanggaran terhadap anak.

Abstract

Penelitian ini bertujuan untuk menganalisis kekuatan eksekutorial akta grosse notaris dalam penyelesaian sengketa perjanjian kredit antara bank dan nasabah. Akta grosse merupakan akta autentik yang memiliki kekuatan eksekutorial setara dengan putusan pengadilan yang telah berkekuatan hukum tetap. Namun, dalam praktiknya, pelaksanaan eksekusi atas akta grosse seringkali menimbulkan perdebatan hukum, terutama terkait validitas perjanjian pokok, pelaksanaan klausula wanprestasi, serta kewenangan pengadilan dalam menilai keabsahan akta tersebut. Metode penelitian yang digunakan adalah yuridis normatif, dengan pendekatan perundang-undangan, konseptual, dan kasus (case approach). Data diperoleh melalui studi kepustakaan, analisis terhadap putusan pengadilan, serta wawancara dengan notaris dan praktisi perbankan. Hasil penelitian menunjukkan bahwa kekuatan eksekutorial akta grosse hanya berlaku apabila akta tersebut memuat perikatan yang nyata dan tidak bersifat fiktif, serta dibuat oleh pejabat umum yang berwenang sesuai ketentuan Pasal 224 HIR dan UU Jabatan Notaris. Dalam praktik, hambatan muncul karena beberapa grosse tidak memenuhi syarat formil, seperti tidak adanya perjanjian pokok yang sah atau adanya pelanggaran asas kehati-hatian dalam pemberian kredit. Kesimpulannya, akta grosse notaris memiliki kekuatan hukum mengikat dan memaksa (executorial power) selama dibuat sesuai ketentuan hukum dan tidak bertentangan dengan asas keadilan serta perlindungan hukum bagi debitur. Implikasi penelitian ini menegaskan pentingnya peran notaris sebagai pejabat publik dalam menjamin kepastian hukum serta integritas perjanjian kredit.

Abstract

Practices resembling wali muhakkam in unregistered marriages remain prevalent across various regions of Indonesia despite lacking formal recognition under national law. Existing scholarship has largely focused on the doctrinal validity of such marriages. At the same time, insufficient attention has been paid to the broader legal implications arising from competing normative authorities and their compatibility with the objectives of Islamic law. The study examines the practice of wali muhakkam in East Aceh through the combined lenses of legal pluralism and maqasid al shari'ah. Employing a social-legal approach, it integrates doctrinal analysis of Indonesian marriage law with empirical data obtained through interviews with religious leaders, imeu gampong, officials of the office of Religious Affairs, and couples involved in unregistered marriages. The findings reveal that wali mahakkam functions as an alternative source of normative authority situated between state law, religious norms, and social legitimacy. While the practice contributes to the realization of hifz al-din by facilitating marriages regarded as religiously valid. It does not consistently secure the broader objectives of maqasid al-shariah, particularly the protection of lineage (hifz al-nasl), property (hifz al-mal), and dignity (hifz al-ird). This study argues that religious legitimacy should not automatically be equated with substantive legal protection. It therefore proposes a maqasid-oriented reconstruction of guardianship regulation aimed at reconciling legal certainty, religious legitimacy, and social realities within Indonesia's plural legal order. The study further demonstrates that the persistence of wali muhakkam cannot be explained solely through legal pluralism but must also be evaluated according to its capacity to realize the substantive objectives of maqasid al-shari'ah.

Abstract

Systematic Complete Land Registration (Pendaftaran Tanah Sistematis Lengkap/PTSL) constitutes a strategic legal instrument introduced by the Indonesian government to accelerate nationwide land registration while strengthening legal certainty, protecting property rights, and improving land governance. Despite its ambitious objectives, the implementation of PTSL continues to encounter institutional, administrative, and socio-legal challenges that affect the effectiveness of the National Land Agency's (Badan Pertanahan Nasional/BPN) authority in translating legal mandates into practice. This study aims to examine the legal authority of the National Land Agency in implementing PTSL, evaluate the gap between regulatory provisions and field implementation, and identify the principal factors influencing the effectiveness of the program. Employing an empirical juridical field research design with a socio-legal approach, this study collected primary data through semi-structured interviews with officials responsible for PTSL implementation within the National Land Agency, complemented by observations and document analysis. Secondary data were obtained from statutory regulations, government policies, scholarly literature, and relevant legal documents. Data were analyzed qualitatively using an interactive model involving data reduction, categorization, interpretation, and triangulation to ensure the validity and reliability of the findings. The results demonstrate that although the National Land Agency possesses a comprehensive legal mandate under the prevailing regulatory framework, practical implementation remains constrained by limited public awareness, financial burdens associated with taxation and administrative costs, inadequate boundary demarcation, low institutional trust, and insufficient budgetary support from both central and local governments. The study further reveals that inter-institutional coordination, community engagement, and adaptive public communication significantly enhance the effectiveness of PTSL implementation. This research contributes to the development of land law scholarship by bridging the normative framework of administrative authority with empirical implementation, offering recommendations for strengthening institutional governance, improving regulatory effectiveness, and promoting sustainable legal certainty in Indonesia's national land registration system.
