Abstract

Online-based transportation was created with the aim of making it easier for someone who wants to travel easily to order, be efficient and effective. In carrying out its activities there are problems that harm the online transportation companies, namely fictitious orders. Fictitious orders are classified as fraudulent acts. Online transportation companies have the right to obtain legal protection. The form of legal protection that must be given to online transportation companies is: compensation, termination of employment and punishment. This study uses legal normative juridical research. The results of this study indicate that those who bear the loss of the company are those who have committed fictitious order fraud, namely the online driver. So that in this case the company can sue the driver regarding the fictitious order.

Abstract

That, if the Labour Law protects laid-off workers where workers still get full wages during layoffs. This is regulated in section 93 of article 2 letter f of Labour Law Number 13 of 2003 concerning Labor which states that employers are obliged to pay workers' wages, if workers are willing to do the work promised, but employers do not employ either their own mistakes or obstacles that should be avoided Company. But in practice there are still many workers who are laid off without receiving wages and do not know about their own rights and obligations as discussed in the decision Number 491 K / Pdt.Sus-PHI / 2017 where laid-off employees do not get rights and obligations a permanent work agreement during the lay down period. The purpose of this journal is to find out whether permanent work agreement can be laid off or not, to find out the rights possessed by employees during laying off by the company and the suitability of judges' consideration in giving such decisions to employees laid down based on Labour Law Number 13 of 2003 concerning Labor. The study was conducted using normative juridical research methods with secondary data legal material sources in the legislation and decisions and circulars related to employment with the nature of descriptive legal research. Based on the analysis of the results of the study, it can be concluded that the term laying off permanent work agreement can be carried out under conditions where the rights and obligations of workers are required to be fulfilled in accordance with the law.

Abstract

In the event of a worldwide pandemic,the government will of course continue to draft laws to address the problems caused by the corona virus in Indonesia's tax system.Some of its policies,particularlyi nthe area of taxation,are designed to create incentives.Incentives to collect taxes and levies are additional money  offered in exchange for a certain level of performance in enforcing taxes and levies.Government incentives are intended to boost the country's economy.This study uses a descriptive research design and empirical normative research techniques.This research includes some original data,such as source interviews,as well as secondary data,such asprimary,secondary,and tertiary legal publications.The government through the Directorate General of Taxes has developed a reporting system for the use of tax incentives for taxpayers that facilitates reporting.However,there are still many obstacles in its implementation at KPP Pratama Medan,and many taxpayers are not aware of the tax incentives available during theCOVID-19 pandemic.Keywords: Economic Stimulus,Tax Incentives,Corona Virus Pandemi

Abstract

This study aims to answer three main problems, namely: (1) How the provisions of the deadline for execution on the death row prisoners in the Indonesian justice system?; (2) What method of execution on death row prisoners in the Indonesian justice system?; and (3) How is the policy of capital punishment in Indonesia in the future?. This research uses the primary, secondary and tertiary legal materials. The research methods being used in this research is normative method with the application of the statute approach, the case approach and the comparative approach. The results of this study shows the following conclusions: (1) the criminal law system in Indonesia is not set the deadline for execution on death row prisoner who had obtained a court decision that is legally binding and or the clemency petition has been rejected signal by the president; (2) The method of execution that has been implemented in Indonesia is a method of firing squad the u.s. stipulated in Law No. 2/Pnps/1964; (3) The policy the SE for the death penalty law in Indonesia in the future will not be shifted away from the current state.

Abstract

Health of the Republic of Indonesia Number: 10 of 2021 concerning the Implementation of Vaccination in the Context of Combating the Corona Virus Disease 2019 (Covid19) Pandemic which refers to Law Number: 36 of 2009 concerning Health , Law Number: 4 of 1984 concerning Outbreaks of Infectious Diseases and Law Number 6 of 2018 concerning Health Quarantine. According to the regulation of the minister of health that vaccination is carried out at health facilities, however, vaccination can be carried out outside health facilities; The government's responsibility for the side effects of the covid-19 vaccine has not yet been seen in the community so that it has the impact of refusing vaccination because the most fatal side effect of the covid-19 vaccination is that it can cause death apart from concerns about the halalness of the covid-19 vaccine In addition, there is no specific rule regarding compensation as referred to in the existing regulations for people who die after being vaccinated;The legal impact if the community refuses to be vaccinated can be given sanctions based on the Regulation of the Minister of Health of the Republic of Indonesia Number: 10 of 2021 concerning the Implementation of Vaccination in the Context of Combating the 2019 Corona Virus Disease (Covid19) Pandemic which is linked to Article 14 paragraph (1) of the Republic of Indonesia Law Number: 4 1984 concerning Outbreaks of Infectious Diseases, but the narrative of the article in question is not in line with the intention of refusing vaccines so that it can lead to multiple interpretations in enforcing sanctions on people who refuse to be vaccinated.

Abstract

Perekonomian merupakan sistem yang dipakai sebuah negara guna mengontrol dan mendistribusikan sumber dayanya, layanan dan produk ke individu-individu dan organisasi yang ada dalam negeri. UMKM menjadi salah satu penyumbang devisa negara dan lapangan kerja bagi masyrakat Indonesia, tanpa terlepas dari bantuan pemerintah, baik aspek perizinan, pembangunan usaha dan sampai keberlangsungan usaha. Dimasa pandemi Covid-19 media elektronik menjadi wadah yang digunakan banyak masyarakat Indonesia sebagai tempat untuk melakukan kegiatan bisnis, dihitung dari modal, waktu, kemudahan berjualan dan keefektifan. Aplikasi Facebook menjadi salah satu akun media sosial yang digunakan masyarakat untuk melakukan kegiatan bisnis, baik dilakukan dengan cara membuat beranda, status dan platfrom yang sudah disediadakan oleh Facebook untuk kegiatan bisnis. Tujuan dari penelitian ini adalah bagaimana masyarakat paham perkembangan dan peran pemerintah pada kegiatan bisnis online dan UMKM. Metode yang dimanfaatkan pada penelitian ini ialah yuridis normatif, yakni sebuah penelitian hukum yang mengkaji data sekunder sebagai bahan dasar untuk penelitian. Hasilnya, peran pemerintah terhadap UMKM dan bisnis online telah diatur dalam UU dan PP, tinggal bagaimana meningkatkan dan mengembangkan peran tersebut dimasa pandemi Covid-19. Abstract

Health has a broad meaning and dimension according to the definition according to WHO and the Health Law, namely a healthy state which includes physical, mental, spiritual and social aspects and can be socially and economically productive. This shows that a person's health status is not only measured from physical and mental aspects, but is also assessed based on social or economic productivity. In early 2020 the world was shocked by the outbreak of a new virus named by the World Health Organization (WHO) Severe Acute Respiratory Syndrome Coronavirus-2 and the name of the disease as corona virus disease 2019 (Covid-19). One way to suppress its growth rate is that the Central Government will take action to vaccinate people in Indonesia so that the spread of the Covid 19 virus does not increase. However, Recently, there have been several reports related to the administration of vaccines with the type of vaccine that experiences a lot of Post-Immunization Adverse Events (AEFI) such as fever, chills, headache, and body aches and weakness. For the impact of the AEFI, the public often blames health workers and even accuses them of medical malpractice In the implementation of the COVID-19 vaccination, it is also obligatory for every citizen to vaccinate. Regulation of the Minister of Health of the Republic of Indonesia Number 10 of 2021 concerning the Implementation of Vaccination in the Context of Combating the 2019 Corona Virus Disease (Covid-19) Pandemic Article 46 Paragraph (1), Paragraph (2), and Paragraph (3) then the government has legal responsibility, if the vaccine organizers follow the Operational Standards that have been established.It is recommended to the central government in issuing new rules related to the handling of Covid 19 and the implementation of vaccinations must be in line with and must not conflict with existing laws and regulations, especially regarding Human Rights (HAM) and the rights of citizens to determine systems and procedures. ways to maintain their health in a responsible manner, including vaccination, which should be one of the choices in health care society and not to be forced.

Abstract

The type of fintech peer-to-peer lending that has experienced the most growth in Indonesia is a type of financial technology that allows customers to get loans with simple, easy and fast procedures and does not require them to have collateral. But in reality, this fintech presents a very high credit risk. This is due to the efforts of fintech companies. as a coordinator when other financial institutions' standards are not met when evaluating buyers. Consequently, there is a need for preventive legal prescriptions and protection, especially for lenders. This is managed in the Financial Services Authority regulation Number.77.01.2016 regarding the implementation of information technology-based money lending and the Financial Services Authority regulation Number.1.07.2013 regarding Consumer Protection in the Financial Services Sector. Both of these regulations can be found on the official website of the Financial Services Authority (OJK). Lenders have sufficient legal protection thanks to these two POJKs, but additional legal protection is needed, particularly in the area of ​​credit risk reduction.

Abstract

Permasalahan dalam penelitian ini adalah bagaimana prosedur perjanjian pemberian kredit, bagaimana menganalisis akibat hukum suatu perjanjian kredit yang didasarkan pada perbuatan melawan hukum, Pertimbangan Hukum Hakim Dalam Putusan Adanya Perbuatan Melawan Hukum Atas Suatu Perjanjian Kredit dengan jaminan kepemilikan tanah yang belum terpisah dari sertifikat induk tanah berdasarkan Putusan Nomor 388 PK/Pdt/2020. Metode penelitian secara normatif dan Penelitian bersifat deskriptif. Analisa data  dilakukan kualitatif. Prosedur perjanjian pemberian kredit diantaranya pengajuan berkas, penyelidikan berkas pinjaman, wawancara, kegiatan pemeriksaan ke lapangan dengan meninjau berbagai objek yang akan dijadikan usaha atau jaminan. Akibat hukum melakukan perbuatan melawan hukum, para Tergugat II dan III tidak lagi melanjutkan kerjasama untuk pembangunan rumah. Atas tindakan perbuatan melanggar hukum dari Para Tergugat I,II, dan III juga mengalami kerugian immaterial, dan tanpa menyerahkan sertifikat tanah yang dialokasikan untuk perumahan Pamalayu Metro Politan kepada Tergugat II tanpa memberitahukan dan seizin Penggugat merupakan Perbuatan melanggar hukum. Pertimbangan Hukum Hakim Dalam Putusan Nomor 388 PK/Pdt/2020 sudah mengabulkan permohonan peninjauan kembali dari Pemohon Peninjauan Kembali.Tergugat I/Terbanding I menyerahkan Sertifikat Tanah Hak Milik yang dialokasikan untuk perumahan Pamalayu Metropolitan kepada Tergugat II/Terbanding II dan perbuatan Tergugat II/Terbanding II menerima Sertifikat Tanah Hak Milik tanpa seizin Penggugat/Pembanding merupakan perbuatan melawan hukum.
