Abstract

Abstract: Marriage is an inner and outer bond between the bride and groom to weave a happy and eternal family. Marriage has a goal to reach a happy, sakinah, mawaddah, and rahmah. The selection of a bride and groom is very important to achieve the goal of marriage. Because in fact, the chosen candidate is a person who will keep him a full day of his life. The ijbar right of a guardian who can force a daughter to marry a chosen prospective husband, is considered not in line with the purpose of marriage itself. Using a social history approach, this paper will describe the concept of ijbar rights in islamic boarding school families in Pamekasan. Descriptions of ijbar rights will be discussed in several sections, continuity and changes, causal explanation, and the implications of change.Abstrak: Perkawinan adalah ikatan lahir batin di antara calon mempelai untuk merajut keluarga yang bahagia dan kekal. Perkawinan mempunyai tujuan untuk mencapai keluarga yang bahagia, sakinah, mawaddah, dan rahmah. Pemilihan calon mempelai meru­pakan hal yang sangat penting untuk mencapai tujuan perkawinan. Karena sejatinya, calon yang dipilih adalah orang yang akan membersamainya sehari penuh seumur hidup­nya. Adanya hak ijbar seorang wali yang bisa memaksakan anak perempuan untuk kawin dengan calon suami yang dipilihkan, dianggap tidak sejalan dengan tujuan perkawinan itu sendiri. Dengan menggunakan pendekatan sejarah sosial, tulisan ini akan mendeskripsikan konsep hak ijbar pada keluarga pesantren di Pamekasan. Deskripsi hak ijbar akan dibahas dalam beberapa bagian, yaitu perkembangan dan perubahan, faktor-faktor yang mem­pengaruhi, dan implikasinya perubahan.

Abstract

Ekonomi syariah adalah suatu cabang ilmu pengetahuan yang merupakan yang berupaya untuk memandang penting, mengalisis, dan akhirnya juga menyelesaikan permasalahan-permasalahan ekonomi dengan cara yang islami, yaaitu atas dasar ajaran agama islam yaitu al-quran dan sunnah nabi, ekonomi syariah memiliki dua hal pokok yang menjadi landasan hukum system ekonomi syariah yaitu al-quran dan sunnah rasulullah saw, hukum-hukum diambil dari landasan pokok tersebut secara prinsip dan konsep tidak dapat berubah kapanpun dan dimanapun. Ekonomi syariah selaran dengan tujuan syariat islam, yaitu maqashid syariah hal tersebut bertujuan untuk mencapai kebahagian duania dan akhirat melalui suatu  tatana kehibupan yang terhormat. Tujuan tersebut yang ingin dicapai oleh ekonomi syariah meliputi aspek kecil maupun besar.  Ada tiga sasaran untuk menunjukan bahwa islam diturunkan secara rahmat bagi semua manusia, satu penyucian jiwa agat semua muslim bisa menjadi salah satu sumber kebaikan  bagi lingkungan dan masyarakat, dua tegaknya keadilan dalam bermasyarakat. Keadilan yang diamaksud meliputi aspek kehidupan dibidang muamalah dan hukum. Tiga tercapainya maslaha merupakan tujuan utama.

Abstract

Masifnya penyebaran dan penularan virus covid-19 sangat berdampak pada setiap aspek dalam kehidupan manusia sekaligus mengantarkan pada kondisi dan situasi yang menakutkan. Tidak sedikit ikhtiyar yang dilakukan oleh pemerintah dan msyarakat dalam rangka menanggulangi virus ini. penelitian ini mengkaji tentang realitas social keagaman masyarakat pamekasan di masa pandemi melalui pembacaan burdah. Peneliti menggunakan metode penelitian kualitatif dengan pendekatan sosial keagamaan. Adapun analisis penelitian ini menggunakan analisis deskriptif dengan menganalisis pelaksanaan pembacaan kitab burdah pada masa pandemi dalam rangka membangaun ketahanan spiritual masyarakat Pamekasan. Penelitian ini menunjukkan hasil bahwa selain mengikuti ikhtiyar fisik seperti mengikuti protokol kesehatan, ketahanan spiritual merupakan faktor intern yang sangat berperan bagi individu atau masyarakat dalam memelihara kesehatan sekaligus juga sebagai bentuk keseimbangan antara usaha dhahir dan batin.

Abstract

This research was aimed at examining the response made by the ulama (Islamic religious scholars) of the Madura Branch of the NU and to find out their reactions to the MUI fatwa concerning cash wakaf. This research was classified as qualitative. The sample for this research consisted of 101 religious scholars of the Madura branch of the NU. The research was conducted in the form of surveys and interviews with these Madura NU members, to ascertain their arguments. The results of the research obtained showed convincingly that the majority of NU religious scholars accept and agree with the MUI Fatwa concerning cash wakaf, in that the response “agree” (Setuju – S) received the highest percentage return for all items, recording positive results between 40% and 60%, whilst the percentages for the response “strongly agree” (sangat setuju - SS) was the second strongest, receiving between 19% and 48% support. Based upon the results of the interviews conducted by the researchers with the NU Madura theologians, it was their opinion that the MUI Fatwa concerning cash wakaf fulfils the requirements of Islamic religious law. Not only that, but these scholars were also of the opinion that a cash wakaf can be a beneficial social instrument and may assist in overcoming social problems in their regions. The implication of this study is that the validity of the MUI fatwa can be widely accepted among local scholars, providing a strong legal foundation for the development of cash waqf in Indonesia, particularly in Madura. This fatwa is not only recognized as valid according to Islamic law, but also serves as a basis for the acceptance of cash waqf by the public as a legitimate and effective charitable instrument Keywords: Nahdhatul Ulama’, Fatwa Commission, Cash Wakaf, Madura.
