Abstract

The disputes resolution in the sharia financial institution gives opportunity and challenge for the Religious Court. Society tends to use ash-shulh by conducting deliberation in solving every dispute. This dispute resolution is taken because of the given legal freedom for society. Its purpose is to analyze the information on opportunities and challenges of the Religious Court as the judicial institution that has absolute authority in solving sharia economic disputes. This is qualitative research by studying secondary data and doing online and offline interviews with the informant. The Religious Court also plays a role in solving the disputes in the sharia microfinance institutions which generally choose the alternative way in disputes resolution by doing the negotiation. The study reveals that the sharia microfinance institutions depend on alternative ways in their dispute resolution such as negotiation and mediation by involving religious figures like Kyai. Madura society puts their trust in the religious figures more than the official institutions appointed in the Supreme Court Regulation No. 1 of 2016 concerning the Mediation in Court. However, the disputes resolution taken by society with the involvement of Kyai, is still based on the decree of the Religious Court in solving sharia disputes as a legal reference and a procedure taken by the judges.Penyelesaian sengketa di lembaga keuangan syariah memberikan peluang dan tantangan tersendiri bagi Pengadilan Agama. Masyarakat memiliki kecenderungan menggunakan ash-shulh dengan cara musyawarah mufakat dalam menyelesaikan setiap sengketa. Upaya penyelesaian sengketa ini dipilih karena kebebasan hukum bagi masyarakat untuk memilih jalan penyelesaian sengketa. Penelitian ini dilakukan dengan menggunakan metode kualitatif melalui data sekunder serta wawancara kepada informan, baik secara online maupun offline. Hasil dan pembahasan menunjukkan bahwa lembaga keuangan mikro syariah memilih jalur alternatif penyelesaian sengketa seperti perundingan dan mediasi dengan melibatkan melibatkan seorang tokoh agama seperti Kyai. Masyarakat Madura lebih percaya terhadap tokoh agama dibandingkan lembaga resmi yang telah ditetapkan oleh Peraturan Mahkamah Agung Nomor 1 tahun 2016 tentang Mediasi di Peradilan. Namun, penyelesaian sengketa yang diambil masyarakat dengan melibatkan Kyai, tetap mengacu pada keputusan pengadilan agama dalam menyelesaikan sengketa syariah sebagai acuan hukum dan cara yang diambil oleh para hakim.

Abstract

Aktivitas dakwah Islam harus disesuaikan oleh era perkembangan masyarakat, karena aktifitas dakwah merupakan bentuk komunikasi yang menimbulkan interaksi sosial. Komunikasi dalam dakwah tidak hanya sekedar penyampaian informasi akan tetapi, juga sebagai pengendali tingkah laku. Sehingga dakwah sangat vital dilakukan untuk bisa mengendalikan melalui pembentukan karakter, begitu hal-nya yang dilakukan pemuda dalam melakukan dakwah sesuai era 4.0 di Madura. Madura merupakan daerah dengan masyarakat mayoritas Islam namun, transaksinya tidak banyak sesuai ekonomi syariah. Sehingga perlu peran dakwah pemuda untuk mengenalkan konsep ekonomi syariah dalam transaksi perekonomia masyarakat. Dari hal ini peneliti merasa perlu untuk meneliti revitalisasi dakwah pemuda era 4.0 serta bentuk dakwah dalam membentuk karakter ekonomi syariah di Madura dengan metode kualitatif. Perbedaan penelitian ini dengan beberapa penelitian sebelumnya, yaitu penelitian ini fokus pada dakwah pemuda era 4.0 yang dilakukan oleh organisasi masyarakat ekonomi syariah di Madura. Penelitian ini menemukan bentuk dakwah pemuda Madura dengan menggunakan revolusi 4.0 ada dua metode pertama, metode langsung  yaitu program cut generation, MES goes to camps, MES go to scool, MES goes to society kedua menggunakan media sosial antara lain group WhatssApp, web site, Istagram, Facebook, dan tweeter.

Abstract

ABSTRACT This paper focuses on the study of a phenomenon that has just emerged due to the rapid development of technology, namely the e-sport competition which is much favored by millennials. The purpose of this study is to analyze how the law of e-sport competition is viewed from the arguments of the Al-Qur'an and Hadits, and how the law of the professional player profession, as well as maqashid sharia stipulation of a law. This research is a type of qualitative research whose data sources come from primary data sources through direct interviews with one of the professional players, and secondary data sources through studies of various literature such as books, articles in journals, and others. The results of this study indicate that: First, e-sport competitions are included in prize competitions that are forbidden in Islam because they have violated all the provisions contained in the Al-Qur'an and Hadith. Second, with the prohibition of e-sport competition, it will have implications for the law of the professional player profession which causes it to become an unlawful profession. Third maqashid sharia regarding the determination of a law is to protect and maintain the needs that are essential for humans, namely: religion, soul, mind, offspring, and property. So that this research makes an important contribution to the development of contemporary fiqh and Islamic law studies that are relevant to new phenomena in the digital era related to e-sport competitions. ABSTRAK Tulisan ini berfokus pada kajian mengenai fenomena yang baru muncul akibat pesatnya perkembangan teknologi yaitu tentang kompetisi e-sport yang banyak digemari oleh kalangan milenial. Tujuan penelitian ini adalah untuk menganalisis bagaimana hukum kompetisi e-sport ditinjau dari dalil Al-Qur’an dan Hadits, dan bagaimana hukum profesi professional player, serta maqashid shariah penetapan suatu hukum. Penelitian ini merupakan jenis penelitian kualitatif yang sumber datanya berasal dari sumber data primer malalui wawancara secara langsung kepada salah satu professional player, dan sumber data sekunder melalui kajian dari berbagai literatur seperti buku, artikel dalam jurnal, dan lain-lain. Hasil dari penelitian ini menunjukkan bahwa: Pertama, kompetisi e-sport termasuk ke dalam kompetisi berhadiah yang diharamkan dalam Islam karena telah melanggar semua ketentuan yang terdapat dalam Al-Qur’an dan Hadits. Kedua, dengan diharamkannya kompetisi e-sport maka akan berimplikasi kepada hukum profesi professional player yang menyebabkannya menjadi profesi yang bathil. Ketiga maqashid shariahmengenai penetapan suatu hukum adalah untuk menjaga dan memelihara kebutuhan yang sifat nya esensial bagi manusia yaitu: agama, jiwa, akal, keturunan, beserta harta. Sehingga penelitian ini memberikan kontribusi penting terhadap pengembangan kajian fikih dan hukum Islam kontemporer yang relevan dengan fenomena baru di era digital terkait kompetisi e-sport.

Abstract

Aktor berperan untuk menjembatani antara cerita dengan penonton, dibutuhkan keterampilan yaitu teknik sebagai cara seorang aktor dalam mengoptimalkan dirinya menjadi peran yang dimainkan, terutama pada keaktoran Ubrug yang membutuhkan aktor handal seperti Mang Brosot, namun tidak memahami tentang Mang Brosot pada media sosial serta ketidaktahuan terkait teknik yang dilakukan Mang Brosot dalam keaktorannya. salah satunya yaitu Teknik Alienasi yang mengupayakan penerapan pada diri aktor dengan peran yang dimainkan, serta membuat sesuatu yang biasa menjadi sesuatu yang tidak biasa. Penelitian ini bertujuan untuk mengetahui Gambaran Umum Mang Brosot dan untuk mengetahui, mendeskripsikan serta menganalisis teknik Alienasi Brecht pada keaktoran Mang Brosot dalam pertunjukan Ubrug. Penelitian ini dilakukan di Kampung Kemayungan RT/RW 003/001 Desa Sukajaya, Kecamatan Pontang, Serang dengan subjek penelitian Mang Brosot. Metode penelitian yang digunakan yaitu kualitatif. Keaktoran Mang Brosot ditemukan teknik Alienasi berupa keluar masuk peran, serta membuat sesuatu yang biasa menjadi tidak biasa/asing.Kata Kunci: Aktor, Mang Brosot, Alienasi, Ubrug

Abstract

Many MSME producers of processed food put halal writing on the packaging, either only with ordinary Latin and Arabic writing, or accompanied by the MUI halal logo and in terms of the main raw materials or additional ingredients, it is difficult to declare the origin of the ingredients to be halal. In fact, the clarity of a food product is the most important thing so that consumers know that the product they are consuming is a halal product and the origin of the ingredients is clear. This study uses a type of normative legal research with a statute approach and a textual approach. This research was approved to be conducted on 19 November 2021, while this research took place on 1 March 2022 BPJPH established a new halal label that applies nationally. For this reason, with this stipulation there is a transfer of the authority of the institution that issues halal certificates from the LPPOM-MUI institution to BPJPH under the Ministry of Religion, this design change is part of the transfer of authority for halal certificates to BPJPH. The results of the study show that: First, the production activities of the three SMEs in Pamekasan, namely UD. Nayla AZ, Kitchen AIM Talang Siring, in the process of procuring materials to distribution, which was carried out in practice, there were no activities and facilities contaminated with unclean/unlawful objects, apart from that no critical activities were found that could cause a product to be unlawful. Whereas at Tarqiyah in its critical activity it was found that the use of raw materials in the form of petis did not have a halal label. Second, the results of the analysis that the researchers carried out using MUI fatwa No. 4 of 2003 concerning the standardization of halal fatwa indicates that MSME products at Tarqiyah, namely BAPER, do not comply with 100% halal principles in accordance with LPPOM-MUI principles. Because the raw materials used are not labeled halal, so the origin of the materials, processes, and facilities used is not known, not only that, materials that are not labeled halal are also included in critical activities that cause a product to be non-halal.

Abstract

Whether it is recognized or not, there are many things in society problems related to the economy,especially not equal distribution of income between one group and another others that cause social and economic disparities.To overcome this problem, zakat is the obligation of every Muslim for those who have fulfilled the requirements to accomplish this, become an alternative solution for overcome this problem. In this case distribution Zakat funds are the most important part of building shared prosperity. But in this era of globalization of course. The distribution of zakat requires new innovations through application of QS interpretation. at-taubah verse 60 effectively, efficiently and relevant to the development of the times by doing various collaborations and modern distribution models. Tree The discussion in this article is the application of QS interpretation. At-Taubah verse 60 which emphasizes the concept of caring, justice and economic equality by combining new innovations to create a more effective system in building economic prosperity, of course can be realized by applying eight groups mustahiq who has the right to receive and utilize funds zakat.

Abstract

Commonly, people pay their zakāt to aṣnāf groups based on their preferences and considerations. However, in Madura, the distribution of zakāt continues to adhere to the traditional notion, wherein it is mainly allocated and prioritized to kiai. This faces a debatable phenomenon whether Kiai could be zakāt recipients or not. Therefore, this research aims to explore the diversification role of Kiai in zakāt payment and describe the theological and social construction among zakāt payment in Madura. The present study employed qualitative research methodologies, specifically utilizing interviews as the primary data collection technique. The participants in this study included kiai, community members, and leaders from Madurese community. This research study indicates that the Madurese Muslim community designates kiai as mustahīqq zakāt under masākīn, fī sabīlillāh, and amīl categories. The diversification of the Kiai’s role is predicated upon the theological perspective held by Madurese Muslim community which posits that the kiai is a rightful recipient of zakāt. Additionally, Madurese Muslim community keeps a social perception that kiai is a revered individual deserving of compensation. Consequently, even though Madurese people understand the existence of religious doctrine to whom they have to spend zakāt, they still prioritize giving zakāt to kiai as the result of their typical social construction.

Abstract

This research was aimed at examining the response made by the ulama (Islamic religious scholars) of the Madura Branch of the NU and to find out their reactions to the MUI fatwa concerning cash wakaf. This research was classified as qualitative. The sample for this research consisted of 101 religious scholars of the Madura branch of the NU. The research was conducted in the form of surveys and interviews with these Madura NU members, to ascertain their arguments. The results of the research obtained showed convincingly that the majority of NU religious scholars accept and agree with the MUI Fatwa concerning cash wakaf, in that the response “agree” (Setuju – S) received the highest percentage return for all items, recording positive results between 40% and 60%, whilst the percentages for the response “strongly agree” (sangat setuju - SS) was the second strongest, receiving between 19% and 48% support. Based upon the results of the interviews conducted by the researchers with the NU Madura theologians, it was their opinion that the MUI Fatwa concerning cash wakaf fulfils the requirements of Islamic religious law. Not only that, but these scholars were also of the opinion that a cash wakaf can be a beneficial social instrument and may assist in overcoming social problems in their regions. The implication of this study is that the validity of the MUI fatwa can be widely accepted among local scholars, providing a strong legal foundation for the development of cash waqf in Indonesia, particularly in Madura. Abstract

Penelitian ini bertujuan untuk menganalisis pengaruh Peer Corrective Feedback (PCF) terhadap keterampilan menulis siswa dalam teks eksposisi hortatori pada pembelajaran bahasa inggris, menggunakan desain kuasi-eksperimental dengan metode non-equivalent pre-test dan post-test pada kelompok kontrol. Penelitian ini diharapkan dapat menjadi acuan bagi pendidik dalam menerapkan strategi pembelajaran yang lebihi menjadi dua kelompok: kelompok eksperimen yang menerima perlakuan PCF dan kelompok kontrol yang tidak mendapat perlakuan. Data dikumpulkan melalui observasi dan tes keterampilan menulis sebelum dan sesudah perlakuan. Hasil analisis menunjukkan bahwa kelas eksperimen mengalami peningkatan keterampilan menulis yang signifikan, dengan rata-rata skor post-test mencapai 82,57, sementara kelas kontrol hanya 74,20. Uji t-sampel berpasangan mengindikasikan perbedaan signifikan antara kedua kelompok, dengan nilai signifikansi 0,000. Temuan ini menunjukkan bahwa penggunaan PCF berkontribusi positif terhadap peningkatan keterampilan menulis siswa, menekankan pentingnya pendekatan interaktif dan kolaboratif dalam pembelajaran menulis. Penelitian ini diharapkan dapat menjadi acuan bagi pendidik dalam menerapkan strategi pembelajaran yang lebih efektif
