Abstract

Abstention is indirectly related to feelings of distrust towards potential leaders or contesting political parties. Golput is also often seen as a form of protest or dissatisfaction with the political system. This research examines the legal review of abstention from the perspective of the laws of the Republic of Indonesia and perspective of siyasah dusturiyah. The research method used is library research with a qualitative approach. The data source used is based on the results of a review of Law no. 39 of 1999 concerning human rights, Law no. 7 of 2017 concerning the holding of general elections, as well as the 2009 MUI Fatwa and opinions from contemporary ulama. The results of the research show that Indonesian legislation states that abstention is a constitutional right granted by the government to the people. so that the people have authority over voting rights and are allowed to exercise these rights or not. Meanwhile, from the siyasah dusturiyah perspective, choosing a leader is obligatory. If all Muslims in Indonesia abstain from voting then they are sinning, because the law requires fardu kifayah. Abstentions have the potential to give unqualified or unfit people the chance to become leaders. So it gives rise to mafsadat against Islamic law. However, in conditions where Muslims live in non-Muslim countries, abstention is recommended because it does not give loyalty or trust to the wrong people.

Abstract

Membangun bangsa dengan kebijakan Jakarta sebagai ibukota Indonesia sudah terbukti gagal dan tidak berkesinambungan dari dulu sampai sekarang dalam perspektif syari’ah. Untuk itu perlu ada antisipasi awal pembangunan bangsa dengan konsep syaricah yang syumul dan kaffah. Sejarah sudah membuktikan bahwa pembangunan bangsa dengan syaricah dapat memunculkan negeri ini di dunia internasional, bahkan khusus untuk Aceh pernah menjadi salah satu negara super power dunia di zaman Sultan Iskandar Muda dahulu kala berbarengan dengan kerajaan Turki Usmani, kerajaan Isfahan, kerajaan Mongul dan kerajaan Akra. Mengingat kondisi seumpama itu maka sangatlah perlu pembangunan bangsa kedepan harus dengan konsep syaricah seratus persen, sebab bangsa ini sudah sangat ambruk dalam berbagai dimensi kehidupan berbangsa dan bernegara selama wujud wilayah Indonesia. Syaricah menawarkan sistem pembangunan dua arah untuk bangsa; pertama arah yang memihak kepada khaliq sebagai creator dan kedua yang mengarah kepada human being sebagai makhluq. Arah pertama menganjurkan kita untuk membangun bangsa dengan mengikuti rambu-rambu ‘aqidah, syaricah, dan akhlaq, sehingga pembangunan bangsa kedepan tidak ada satu komponen masyarakatpun yang merasa dirugikan. Sementara arah kedua menawarkan nilai ukhuwwah, nilai mu’amalah dan nilai siyasah menjadi pegangan sehingga hasil dari pembangunan bangsa kedepan memenuhi persyaratan yang ditawarkan Al-Qur’an, yakni; ḥablumminallāh wa ḥablumminannās. paper ini disajikan mengikut metodologi kualitatif yang menggambarkan rumusan-rumusan dan format pembangunan bangsa kedepan dengan dua dimensi; dimensi khaliq dan dimensi makhluq. Teknik pengumpulan data lebih diutamakan melalui perpustakaan (library research). Kepada para penguasa negeri ini kapan saja mereka berkuasa kami anjurkan untuk membangun bangsa kedepan dengan konsep pembangunan syaricah.

Abstract

The implementation of a clean and effective government aspired to by the community, public services and law enforcement are two inseparable aspects of efforts to create a democratic government that aims to improve people's welfare, justice, legal certainty, clean and transparent government (clean government and good governance).  governance). In fact, there are still many maladministration carried out by public services. The formulation of the problem in this research is how is the Islamic perspective related to supervision and how is the process of public supervision and what factors are the obstacles experienced by the Aceh Ombudsman.  This type of research is classified as field research, which is descriptive in nature, namely research that describes and describes data sourced from primary data through interviews, observations and reports in the form of documents and secondary data by conducting library research in the form of Al-  Qur'an, Hadith, opinions of scholars, laws and regulations, documents and books and other scientific works.  Based on the results of the study, it can be concluded that there is maladministration in Bireuen Regency regarding the misuse of public service facilities in the field of BPBD damkar, so that the Ombudsman conducts an investigation of the service.  Fiqh Siyasah's review of the supervision carried out by the Ombudsman does not conflict with the Shari'a, but the supervised service is not responsible for its service to the needs of the community.

Abstract

At the commencement of Indonesian independence, the Masyumi Party was the sole prominent Islamic party. It attempted to include Islam as the foundation of the Indonesian state into its constitution. This study aims to investigate the effort of the Masyumi during their active participation and administration of the government throughout the Old Order period in the context of fiqh al-siyāsah. This research is a qualitative legal study employing the approach of fiqh al-siyāsah or Islamic politics. Meanwhile, data collection techniques were carried out through literature studies and in-depth interviews. The results of this study indicate that Masyumi's efforts in the Constituent Assembly, whose task is to draft the Indonesian State Constitution, were carried out very seriously and earnestly, causing the work of the Constituent Assembly members to drag on because there was no point of convergence between the Masyumi Islamic Party and the national parties. As a result of the absence of a meeting point, President Soekarno, with the support of the Indonesian Army, issued a decree on July 5, 1959, dissolving the Constituent Assembly and reverting to the 1945 Constitution. It turned out that the failure of Masyumi's hard work to make Islam the basis of the state was due to internal factors: communist, nationalist, and secularist ideology. In addition, it was also influenced by several external factors: the infiltration of the global superpowers and Islamophobia.  Despite the fact that Masyumi was deemed a failure, various contributions in the context of fiqh al-siysah in Indonesia, particularly resistance to communism, contributed color to an Islamic state administration system as well as adherence to the constitution and theistic democracy.

Abstract

Jamaluddin al-Afghani merupakan seorang tokoh pembaharu islam yang hidup pada abad ke-19. Al-Afghani mengusung konsep Pan-Islamisme, yaitu persatuan islam untuk menumbuhkan semangat persaudaraan islam (ukhuwah islāmiyah) ditengah kemunduran islam karna ummat yang terpecah. Dalam perkembangannya, konsep Pan-Islamisme berhasil tersebar ke banyak negara di dunia, bahkan hingga Indonesia. Aceh merupakan salah satu provinsi di Indonesia, yang memiliki keistimewaan untuk menegakkan Syariat Islam secara menyeluruh. Tujuan penulisan artikel ini adalah untuk melihat relevansi antara konsep penerapan Syariat Islam di Aceh dan konsep Pan-Islamisme yang diperkenalkan oleh al-Afghani. Metode yang digunakan adalah kualitatif dengan pendekatan analisis historis, kemudian jenis penilitian yang dilakukan adalah studi kepustakaan. Hasil penelitian menunjukkan terdapat dua relevansi antara konsep penerapan Syariat Islam di Aceh dengan konsep Pan-Islamisme Jamaluddin al-Afghani, yaitu sama-sama menghendaki kesatuan paham keislaman agar terciptanya suatu persatuan dan juga praktik mengedepankan ukhuwah islāmiyah sebagai landasan persatuan.

Abstract

The implementation of the nazhir registration requirement under Article 14 of Law Number 41 of 2004 on Waqf continues to reveal a gap between legal norms and practice. Although every nazhir is legally required to be registered with the Minister of Religious Affairs and the Indonesian Waqf Board (BWI), in practice many are registered only with the Office of Religious Affairs (KUA), while others remain unregistered with both institutions. Previous studies have primarily examined waqf governance, whereas research developing a typology of the legal status of nazhir based on registration practices remains limited. This study aims to formulate a legal status typology of waqf nazhir and identify the factors hindering registration with the Indonesian Waqf Board. Employing a qualitative socio-legal approach, data were collected through in-depth interviews, observation, and document analysis and were analyzed thematically. The findings identify three legal status typologies of waqf nazhir: formal, registered with both the KUA and BWI, semi-formal, registered with the KUA but not with BWI; and informal, registered with neither the KUA nor BWI. The study further reveals that overlapping institutional authority, weak inter-agency coordination, limited legal awareness among nazhir, and the institutional and budgetary constraints of BWI constitute the main barriers to registration. This study contributes by proposing a legal status typology of waqf nazhir as a conceptual framework for understanding the implementation gap in waqf law and underscores the need to strengthen institutional coordination, harmonize regulations, and develop a digital registration system to enhance legal certainty and the effectiveness of waqf governance in Indonesia.

Abstract

This study examines the Indonesian government's policy of increasing tobacco excise rates from the perspective of fiqh siyasah, specifically the principle of Tasharruful Imam 'Ala Ra'iyah Manuthun BilMaslahah, which asserts that every action of a leader must be oriented toward public welfare. The main focus of this research is to analyze the effectiveness of the exercise policy in reducing cigarette consumption, minimizing health impacts, and increasing state revenue amid the growing circulation of illegal cigarettes. This study employs a normative legal method with a juridical-normative approach through library research that reviews relevant regulations, academic literature, and data from official institutions. The findings indicate that, normatively, the policy has a strong legal foundation, namely Law Number 39 of 2007 concerning Excise and Government Regulation Number 28 of 2024 concerning the Control of Addictive Substances. Theoretically, this policy is effective through the mechanism of price elasticity; however, in practice, its effectiveness is hindered by the widespread distribution of illegal cigarettes, weak enforcement, complex tax structures, and low public awareness. Therefore, optimizing the tobacco excise policy requires simplifying the excise structure, strengthening law enforcement against illegal cigarettes, and implementing cross-sectoral educational campaigns grounded in Islamic ethics and social justice. Through these comprehensive measures, the excise policy can function not only as a fiscal instrument but also as a tangible manifestation of public health protection and societal welfare.
