Abstract

Notary and Land Registrar (i.e. Pejabat Pembuat Akta Tanah [PPAT]) are general officials authorized to make authentic deeds. If someone is serving as a notary as well as being able to carry out his position, then he must be replaced by someone else temporarily. During the leave period, the land certificate they make is not authentic. The certificate sourced from and made by Notary or PPAT Deed is an authentic one that has perfect verification power. Therefore, every Notary or PPAT in carrying out the position should always be careful and aware of the consequences that can be caused on each deed he makes.

Abstract

Abstract This study aims to analyze the implementation of PPAT obligations in APHT registration and the implications of APHT registered by PPAT more than 7 (seven) working days. This research was conducted using empirical research methods. The data obtained, both primary and secondary data, were categorized according to the type of data. Then the data was analyzed using qualitative methods, namely analyzing data related to the problem under study, then selected based on a logical mind to avoid errors in the data analysis process. The results of this study indicate that: 1) Mortgage registration is carried out by the Land Office by making the Mortgage Land Book and recording it in the Land Rights Book which is the object of the Mortgage Rights and copying the notes on the relevant Land Title Certificate. After the entry into force of PMATR No. 5/2020, APHT registration is done online. Mortgage registration is carried out by means of PPAT submitting APHT and supporting documents to the land office, deed and warkah documents are only submitted in scanned form through the electronic mortgage system and the land office no longer accepts physical documents. 2) The delay in APHT registration will affect the birth of Mortgage Rights. In essence, the laws and regulations provide a time limit for the registration of APHT and other documents with the aim of legal certainty for the guarantee itself and certainty of legal protection for creditors. Abstract

The beach is the junction between the highest tide and the mainland, while the coastal area is the transition between terrestrial and marine ecosystems that is affected by changes in land and sea. The utilization of coastal areas and small islands in Indonesia is regulated in Act Number 27 of 2007 on the Management of Coastal Areas and Small Islands that is last amended into Act Number 1 of 2014, and is also based on Basic Act on Agrarian. Utilization of coastal waters is given in the form of rights to enterprise the coastal waters, namely the rights on certain parts of the coastal waters to enterprise marine resources and fisheries, as other business related to the utilization of coastal resources and the small islands covering sea level and water column over surface of the sea floor at a certain breadth limit. The coastal land in the coastal areas can essentially be owned by or be the right of a person or legal entity. Owning and authorizing the coastal land and utilizing the coastal areas should certainly pay attention to and be compatible with the spatial planning of regencies or cities.

Abstract

The strength of the proof of detail as the basis for land rights. This study was conducted to analyze the position of the detail as the basis for land rights in proving community ownership of land and to analyze the legal protection of land tenure by the community based on the detail as the basis for their rights. This research uses empirical legal research. The results of the study show that (1) the position of detail as the basis for land rights in proving land ownership by the community, namely before the issuance of the UUPA, detail was proof of ownership of land rights. Along with the enactment of the UUPA and Government Regulation Number 24 of 1997 concerning Land Registration, the Details are no longer as evidence of land rights, but as evidence of a person's control over the controlled land, so that if it is not corroborated with other evidence, the Details cannot be used absolutely as a tool. proof of ownership of land in the trial; and (2) legal protection of land tenure by the community based on details as the basis for their rights, namely that they have not yet fully received legal protection. So that in order to obtain legal certainty and protection.

Abstract

Penelitian ini bertujuan untuk menganalisis dan memahami tentang mekanisme kerja Notaris dalam persekutuan perdata notaris serta tanggung jawab Notaris yang tergabung dalam persekutuan perdata notaris. Tipe penelitian ini adalah penelitian empiris yang membahas tentang mekanisme kerja serta tanggung jawab Notaris dalam persekutuan perdata notaris, dengan mengumpulkan data primer berupa hasil wawancara dan data sekunder yang diperoleh melalui studi kepustakaan. Data yang diperoleh lalu dianalisis secara kualitatif. Hasil penelitian ini menunjukkan bahwa, meskipun Notaris tergabung dalam satu persekutuan perdata notaris, tetap hanya akan ada satu Notaris yang bertanda tangan dalam satu akta. Hanya Notaris yang membuat akta yang dapat membubuhkan tanda tangan pada akta, baik pada Minuta akta dan Salinan akta, mulai dari awal akta hingga akhir akta. Notaris yang tergabung dalam persekutuan perdata notaris dalam menjalankan jabatannya tetap bertindak secara sendiri-sendiri dan segala tanggung jawab atas akta yang dibuat oleh atau dihadapan Notaris, menjadi tanggung jawab secara pribadi, termasuk pula segala dokumen protokol yang disimpannya.
