Abstract

Protecting children today, means protecting society, country and nation in the future. In general, every children without any exception have an equal right to be protected by law, whether children as a victim, or children as an offender as well. Sometimes,  people ignore protection need of children who is involved some cases in law, because they think children such as that category will bring some problems to their society, and has been labeled as a criminal. Absolutely, their opinion is wrong indeed. We do not generalize or juxtapose children such as that category as well as a criminal. According to Children Rights Convention (CRC), Children in a conflict with the law has set as one of  category children who is in need a special protection. Children in a conflict with the law or in other words called by “Juvenille delinquency” need a prior protection more than any normal children. Protection of  normal children,  children as a victim, and children in conflict is regulated by and based on any  different regulations/instrument Internationally and nationally. One of International regulation/instrument is called by Beijing Rules, Whereas  there are several regulation which is implemented to give some protection  to children In Indonesia, such as Undang-undang Nomor 5 Tahun 1997. Abstract

The purpose of the research is to identify legal regulations, filing procedures, and obstacles to filing compensation for victims of criminal acts. This research was also carried out with a normative legal approach using secondary data processing data from primary legal materials, secondary legal materials and tertiary legal materials. Based on the results of normative research with a legal approach, it can be concluded that 1) The rules on the rights of child victims of criminal acts have been regulated in detail in various Indonesian regulations and laws. 2) The effectiveness of implementing the law for child victims of criminal acts by making government regulations as additional penalties in criminal case decisions, in addition to corporal punishment and fines as the main penalties, will be difficult to achieve, so that legal certainty for the Implementation of Restitution for Child Victims of Criminal Acts cannot be implemented.

Abstract

Era globalisasi saat ini telah mempercepat perkembangan bisnis, industri, dan teknologi, yang berdampak pada peningkatan jumlah barang dan jasa yang ditawarkan kepada konsumen. Dalam konteks ini, merek memegang peranan penting sebagai identitas dan simbol reputasi produk, serta menjaga persaingan usaha yang sehat. Merek bukan hanya sekadar simbol, tetapi juga mencerminkan janji produsen terhadap konsumen tentang kualitas produk. Oleh karena itu, merek termasuk dalam ruang lingkup Hak Atas Kekayaan Intelektual (HAKI) yang memberikan perlindungan hukum terhadap pemilik merek terdaftar. Namun, meskipun pendaftaran merek memberikan hak eksklusif, tidak menutup kemungkinan adanya pelanggaran atau pemalsuan merek yang dapat merugikan pemiliknya serta merusak reputasi merek di mata konsumen. Peraturan mengenai perlindungan merek tercantum dalam Undang-Undang No. 15 Tahun 2001 tentang Merek, namun dalam implementasinya, tindakan pidana pelanggaran merek sering kali menjadi delik aduan, yang mengharuskan adanya laporan dari pihak yang dirugikan sebelum penegakan hukum dapat dilakukan. Penelitian ini bertujuan untuk menganalisis alasan pembatalan terhadap pelanggaran merek serta penanggulangan pelanggaran merek dengan menggunakan sarana hukum pidana. Penelitian ini menggunakan pendekatan yuridis normatif dan yuridis empiris dengan mengkaji peraturan perundang-undangan dan studi kasus terkait tindak pidana pemalsuan merek. Hasil penelitian diharapkan dapat memberikan pemahaman yang lebih mendalam mengenai perlindungan hukum terhadap merek dan sanksi pidana yang diterapkan pada pelanggaran merek. Kata kunci: Merek, Pelanggaran Merek, Perlindungan Hukum, Hak Kekayaan Intelektual, Sanksi Pidana.

Abstract

Amendments to environmental regulations under Law No. 11 of 2020 on Job Creation have generated significant implications for the environmental licensing framework, particularly in the management of Hazardous and Toxic Substances (B3). This study aims to provide a comprehensive examination of the technical procedures for implementing B3 management permits at PT Futai Tanjung Merah, Bitung City, in accordance with Law No. 32 of 2009, Government Regulation No. 74 of 2001, and Government Regulation No. 101 of 2014. It also analyzes the administrative, technical, and institutional barriers that affect the effectiveness of implementation. Employing a descriptive qualitative design with a juridical-empirical approach, this research utilizes interviews, field observations, and legal document analysis as its primary data collection methods. The findings reveal that, while the implementation of B3 permits generally complies with existing regulations, their overall effectiveness remains constrained by policy overlaps, inadequate supervision, and limited public participation. The study concludes that achieving efficient environmental permit governance requires stronger synergy between legal certainty, institutional capacity, and public transparency.
