Abstract

This study purposes to analyze the issue of character assassination in perspective of Islamic Jurisprudence and Indonesia’s Law. Many people get involved in the criminal case on character assassination. Different ways in understanding and interpretating the meaning of character assassination are main problem in this article. It particularly focuses on the measurement of character assassination in Islamic Jurisprudence and Indonesia’s Law. This study is based on library research referring to books, journal articles, and official sites related to the topic. The data was then described and analyzed with the approach of Islamic Jurisprudence and Indonesia’s Law. The result of the study shows that character assassination should have measurements, as a standard of evident in which any practice of character assassination issue must be referred to. Additionally, there are some exceptional cases in which the practice of character assassination is permissible juridically and legally for Maslahah (advantage).

Abstract

A marriage where the woman is pregnant due to adultery is considered uncommon and taboo in Muslim society. The pregnancy is always kept secret by the prospective married couple and their families. The pregnant Muslim women marriage rate in Lintau Buo Utara is quite high. This study focuses on the case of pregnant women's marriages, specifically how the Office of Religious Affairs (KUA) officers may learn about the prospective bride's pregnancy and the family's actions after the prospective bride gives birth. The research was carried out in the form of a field study using the socio-legal research method with interviews conducted with relevant parties in this case. The results concluded that the majority of pregnant marriages at KUA Lintau Buo Utara were predominantly experienced by young couples at elementary and junior high education levels. KUA officials could discover about the future bride's pregnancy by observing the attitude of the prospective partner or their families during the registration process, the answers of the partner throughout the interview session,  and the results of the examination done by the Public Health Center staff. The family's stance towards the pregnant woman's marriage is that the couple will hold a remarriage after the bride gives birth. The new findings in this study are related to the way KUA officers reveal the state of the prospective bride's pregnancy, which was originally kept secret. This is very important to be applicable to KUA officers in other areas.

Abstract

This study explores the controversy of SIGMA (Konsultasi Agama or Religious Consultation) at Bhasa Radio 93.1 FM Situbondo as the representation of how grassroots Muslims perceive Islamic law. SIGMA is an aired interactive forum discussing current issues of Islamic law engaging a host, a speaker, and listeners. However, it sparks controversy particularly because of the stigma of a liberalist. This research, therefore, focuses on the typology of SIGMA perspective through the opinion of its speakers, genealogy beyond their thought, and the controversy that comes along. As a qualitative field study with a socio-philosophical approach, it used interviews with 14 informants consisting of SIGMA speakers and staff as well as listeners from diverse backgrounds. It turns out that; firstly, SIGMA’s perspective indicates a progressive type of thought rather than liberal as stigmatized because of the employment of maqas{id al-syari’ah during discussing the issue and making decisions afterward. Secondly, the thinking model can be traced back historically to NU (Nahdlatul Ulama’) reformists who likely use maqas{id al-syari'ah to examine Islamic law along with a progressive mindset. SIGMA speakers furthermore tend to employ advancement of ijtihad and contextual fiqh like what bahs| al-masa'il forums typically do. Thirdly, the controversy stems mainly from the negative stigma which tends to be loudly and sporadically expressed making sympathetic voices unheard. This implies how grassroots Muslims interact with Islamic law in both textual and contextual realms particularly when coping with the changing situation and dynamic methodologies.
