AbstractIndonesia maintains the commitment to strengthen economic growth and to promote financial stability in the ASEAN region. However, the differences of the economic growth among the ASEAN members become an obstacle for the ASEAN Banking Integration Framework (ABIF). The ABIF promotes the gap-reduction to enhance the ASEAN members’ capacity to get benefits from the integration framework. However, some countries make some exceptions for the ABIF agenda. One of the benefits of ABIF is that Indonesia Banks can have access to broader market. To get the access, Indonesia has to fulfill as Qualified ASEAN Banks (QABs). One of the criteria is sufficient capital of banks. QABs requires bilateral agreement between state parties and promote the reciprocity and gap reduction principles. For instance, according to a schedule of specific commitment for banking sector, Indonesia and Malaysia had launched commercial presence on July 2017. One of the Indonesian Bank that comply with the criteria of QABs is PT. Bank Mandiri (Persero). It has established a branch office in Malaysia by the end of 2017. Thus, it proves that the Indonesian banking industry is ready to compete in the ASEAN Market.AbstrakIndonesia berkomitmen untuk tetap memperkuat pertumbuhan ekonomi dan meningkatkan stabilitas keuangan di wilayah ASEAN. Namun demikian, perbedaan pertumbuhan ekonomi diantara Negara-negara anggota ASEAN menjadi hambatan terlaksananya ASEAN Banking Integration Framework (ABIF). ABIF pada dasarnya dibentuk dengan tujuan untuk mengurangi kesenjangan dan meningkatkan kapasitas Negara-negara anggota ASEAN sehingga mendapatkan manfaat dari ABIF, walaupun beberapa negara masih dikecualikan dari beberapa agenda yang disepakati dalam ABIF. Pelaksanaan ABIF didasarkan pada perjanjian bilateral. Berdasarkan schedule of specific commitment Indonesia dan Malaysia meluncurkan kegiatan komersial banking pada July 2017. Salah satu Bank dari Indonesia yang memenuhi kriteria QABs adalah PT. Bank Mandiri (Persero) dan akan mengoperasikan kantor cabang penuh di Malaysia pada akhir 2017. Various kind of capital market violations show the characteristics of capital market violations that the loss is rarely realized by the investor. Currently, the regulation provides a way to resolve investor loss of capital market and the practice of resolving violations of the law in the capital market through the investor protection regulation is sometimes not satisfactory for the harmed investors. As a step to strengthen the law enforcement instruments, the Financial Services Authority (Otoritas Jasa Keuangan / OJK) issued a Draft Regulation (RPOJK) on OJK regarding Disgorgement and Disgorgement Fund to facilitate investor’s legal protection against losses internally by itself. The purpose is to analyze the disgorgement mechanism regulation plan through the study of RPOJK so that it can be applied as a new settlement in the capital market and suitable with existing ways. The research method uses a normative juridical approach that is through the existing study of the rule of law that apply primary, secondary and tertiary legal materials, also from existing electronic literature. Based on the result of the study, it is concluded the plan of the disgorgement mechanism regulation as a form of refund through administrative mechanism is different from civil compensation and it can be applied as one of the investor’s legal protections because the form of the order in disgorgement as a refund is considered effective, proportional and can be preventive.

Islamic bank has a huge potential to involve in large project financing such as infrastructure. The demand for infrastructure provision in Indonesia is growing rapidly, so the Islamic bank should become one of the financial institutions for a financing infrastructure project. One of the products of Islamic bank is lease based contract or ijarah. In 2016, the Indonesian Islamic Scholars Council (MUI) enacted Fatwa that allowed ijarah contract for a forward obligation or called al-ijarah al-maushufah fi al-dzimmah (IMFD). IMFD has some characteristics that equitable for infrastructure project needs, such as for long term financing. The main issues in this research are to drawn a model for infrastructure project financing by applying IMFD and observe the readiness of Indonesian regulation to support the implementation of IMFD on infrastructure project financing. The type of research is the normative study, and the approach of this research having four methods approach among others are statute approach, conceptual approach, cases approach, and comparative approach. The results of this research are model for infrastructure project financing by applying IMFD is by combining musharakah-istishna’-ijarah (IMFD) and regulation in Indonesia is not ready enough to support the implementation of IMFD on infrastructure project financing because combination of three contracts like musharakah-istishna’-IMFD, implementation of liquidated damages in istishna’ contract, and allowance IMFD in infrastructure project are not regulated in Indonesia.

ABSTRAK Digitalisasi perbankan mendorong munculnya Open Application Programming Interface (Open API) yang memungkinkan bank untuk berkolaborasi dengan pihak ketiga yaitu fintech dan/atau e-commerce dengan membuka data transaksi nasabah. Hal ini dapat menimbulkan implikasi pada layanan perbankan dan keamanan data nasabah. Maka dari itu dilakukan penelitian ini guna untuk mencari tahu implikasi pelaksanaan Open API terhadap layanan perbankan dan upaya perlindungan data nasabah pasca berlakunya Peraturan Dewan Gubernur Nomor 23/15/PADG/2021 tentang Implementasi Standar Nasional Open API Pembayaran. Metode penelitian yang digunakan adalah metode penelitian yuridis normatif. Penelitian ini menggunakan spesifikasi deskriptif analitis pada sumber hukum primer dan hukum sekunder. Data yang telah diperoleh selanjutnya dianalisis menggunakan metode normatif kualitatif. Berdasarkan hasil penelitian ini, diperoleh bahwa Implementasi pelaksanaan Open API terhadap layanan perbankan memberikan kemudahan dan kenyamanan dalam bertransaksi serta dapat melengkapi ekosistem produk. Ekosistem produk yang terafiliasi menjadi lebih beragam dengan adanya layanan perbankan yang dapat diakses melalui aplikasi pihak ketiga. Selanjutnya, bentuk perlindungan hukum telah diberikan guna melindungi data nasabah yang menjadi alat tukar dalam kolaborasi yang dijalin oleh bank dan pihak ketiga .Kata kunci: open api; open banking; implikasi hukum. ABSTRACT The Covid-19 pandemic demands that all activities be carried out digitally using information and communication technology, including banking activities. Banking digitization encourages the emergence of the Open Application Programming Interface (Open API) which allows banks to collaborate with third parties, namely fintech and/or e-commerce by opening customer transaction data. This can have implications for banking services and customer data security. This study aims to explain the implications of implementing Open API for banking services and efforts to protect customer data after the entry into force of the Board of Governors Regulation Number 23/15/PADG/2021 concerning Implementation of the Payment Open API National Standard.The research method used is normative juridical research method. This study uses analytical descriptive specifications on primary and secondary legal sources. The data that has been obtained is then analyzed using qualitative normative methods. Based on the results of this study, it was found that there were implications for all financial transactions after standardization, namely PBI SNAP. So banks are required to adjust their service activities in accordance with PBI SNAP where banking as a financial institution is a PJP. Furthermore, a form of legal protection has been provided to protect customer data which is a medium of exchange in collaborations established by banks and third parties. Usaha Mikro, Kecil, dan Menengah atau yang lebih dikenal dengan UMKM mempunyai peranan yang strategis dalam pembangunan ekonomi domestik, karena terbukti berhasil menyumbang angka yang besar terhadap PDB. Menyerap banyak tenaga kerja dan berperan dalam pertumbuhan ekonomi daerah karena lokasinya yang tersebar hingga ke pelosok daerah. POJK Nomor 19/POJK.03/2014 tentang Layanan Keuangan Tanpa Kantor telah disahkan sejak tahun 2014 untuk salahs atunya mendukung perkembangan UMKM dari segi permodalan yang merupakan salah satu kendala perkembangan UMKM di pelosok daerah saat ini, namun hingga saat ini tahun kelima POJK Laku Pandai berjalan, OJK mengklaim penyaluran kredit mikro ini belum optimal. Hal ini berimplikasi kepada belum terpenuhinya target Keuangan Inklusif di Indonesia yang menetapkan UMKM menjadi salah satu sasaran utama dalam Strategi Nasional Keuangan Inklusif. Tujuan dari penelitian ini adalah mengetahui implementasi POJK Nomor 19/POJK.03/2014 tentang Layanan Keuangan Tanpa Kantor dalam hal penyaluran kredit mikro sehingga diharapkan dapat mengubah pandangan masyarakat bahwa Laku Pandai bukan hanya sebatas layanan simpanan, pembayaran atau bertransaksi namun lebih dari itu, Laku Pandai jika dikelola dengan tepat juga mampu menjadi pionir keuangan inklusif bagi UMKM di Indonesia dan masyarakat secara umum. Metode penelitian yang digunakan penulis adalah yuridis normatif. Hasil penelitian adalah minimnya penyaluran kredit mikro Laku Pandai disebabkan oleh minimnya edukasi Agen dan UMKM masih belum memenuhi kriteria penilaian pengajuan kredit, karena Bank tetap harus memperhatikan prinsip kehati-hatian sebagaimana amanat Pasal 8 Undang-Undang Perbankan.

Nominee agreement as development of agreement is an implementation of the unnamed agreement (innominaat) regulated in Article 1319 of the Civil Code. The existence of this agreement in Indonesia does not constitute a form of agreement that violates the provisions of contract law even though it has not been regulated expressly and specifically. However, if the agreement is made in conflict with or not in accordance with the provisions of the laws in force in Indonesia, then this would cause legal problems. This research method was carried out using a normative juridical approach with descriptive analytical research specifications. The results of this research show that the position of the nominee agreement in the transfer of share ownership is null and void. By making the agreement null and void, it returns the parties to their original state and has implications for the company.

Waqf is a financial and social instrument in Islam that has significant purposes and functions. The purpose of waqf is for promote public welfare according to the potential and economic benefits of waqf assets, one of which is stock waqf. To achieve the objectives of share waqf, legal certainty is needed to ensure that the transfer of shares through waqf can be carried out in accordance with the will of the waqif. Shares that can be endowed are shares from companies whose business activities do not conflict with sharia principles. Waqf shares must be set out in a Deed of Pledge of Waqf which will then be submitted to the Board of Directors, if it is a closed company, or to an investment institution if the waqf shares are listed on the stock exchange. It is this Deed of Pledge of Waqf that guarantees legal certainty and becomes the basis for transferring the rights to the shares into the name of the nazhir.

The practice of pawning in Indonesia, especially in the context of customary law, namely selling pawns, is often still used by the community today, but this practice is considered irrelevant along with the development of pawn practices in Indonesia. New regulations from PT Pegadaian (Persero) through pawning with pawn objects in the form of land in Sharia Pawnshops with the aim of providing financing for the community and to micro, small and medium enterprises and farmers who use productive land. The development of pawn practices in Indonesia is also marked by the existence of an online pawn mechanism that is rampant among the public today. On the other hand, online pawning is also considered to provide convenience for the pawn giver because it can be done anytime and anywhere and the pawn giver can also estimate for himself how much the value of the pawn object is, but of course on the other hand this online pawn also has several weaknesses. This research uses normative juridical research methods to describe problems and solutions in the context of the development of pawn practices in Indonesia and uses qualitative research methods and is balanced by conducting interviews with the Padasuka branch of Sharia Pawnshops, Bandung City.

Peran perbankan sebagai perantara dalam penghimpunan dan penyaluran dana memegang peranan penting dalam proses ini. Pemberian kredit dilakukan melalui perjanjian antara bank dan nasabah, dengan jaminan fidusia sebagai upaya preventif. Meskipun pembuatan akta jaminan fidusia harus dilakukan di hadapan notaris untuk keabsahan hukumnya, namun terkadang penandatanganan akta dilakukan di luar kantor notaris, yang dapat memengaruhi keabsahan hukumnya. Dana atau uang yang dibutuhkan guna pelaksanaan dan pengembangan usaha umumnya dapat diperoleh dengan cara pinjam-meminjam atau kredit yang salah satunya melalui jasa perbankan Penelitian ini menggunakan metode penelitian deskriptif analitis dengan pendekatan yuridis normatif, Data dan informasi dianalisis sehingga memperoleh gambaran mengenai Jaminan Fidusia. Hasil penelitian menunjukan bahwa keabsahan Akta Jaminan Fidusia yang tidak ditandatangani oleh Notaris di hadapan para pihak, maka kekuatan akta tersebut menjadi akta dibawah tangan. Ketentuan Pasal 5 ayat (1) Undang-undang Jaminan Fidusia artinya akta tersebut batal demi hukum dan tidak dapat didaftar di Kantor Pendaftaran Fidusia. Perlindungan hukum bagi kreditur yang dirugikan adalah dapat menuntut ganti rugi, biaya, dan bunga kepada notaris apabila notaris terbukti melanggar ketentuan dalam Undang-Undang Jabatan Notaris.
