Abstract

Polder Liang yang berletakak ada di sebelah barat kota Martapura di desa tambak baru Kabupaten Banjar, Provinsi Kalimantan Selatan. Luas polder lebih dari 900 Ha dikelilingi jalan sebagai tanggul polder liang berada di tiga kecamatan yaitu Kecamatan Matapura, Karang Intan, Astambul. Polder liang memiliki beberapa pintu air yaitu 6 pintu air utama dan 29 pintu air kecil. Sistem pintu air yang ada di sekitaran polder masih bersifat manual. Perhitungan ini menggunakan metode Nreca untuk perhitungan debit andalan dan debit nreca dan metode panmen dan standar KP-01 untuk perhi tungan kebutuhan air pada BAB IV dan menghitung pengembangan lahan pertanian berdasarkan neraca air.Hasil Perhitungan kebutuhan air yang ada di desa tambak baru kecamatan martapura kabupaten banjar kebutuhan air tertinggi pada bulan juni II berjumlah dengan rata-rata 0,442 m3/detik ketersedian air dihitung dengan debit andalan 80% didapat rata-rata ketersedian air 31,095 dengan awal pola tanam digunakan juni II perhitungan neraca air yang ada di petak sawah pada bulan juni II 5,384 m3/detik.perhitungan perkembangan lahan yang awalny tercatat 638 Ha bisa di kembangkan menjadi 845 Ha.

Abstract

Haryono No. 169 Malang e-mail: udin_fahrudin@student.ub.ac.id Abstrak Penelitian ini bertujuan untuk menganalisa, mendeskripsikan, dan menemukan kewenangan pemerintah daerah dalam melakukan pendataan masyarakat miskin di luar DTKS, dan menemukan keabsahan penggunaan data penanganan kemiskinan oleh pemerintah daerah di luar DTKS dalam menangani kemiskinan. Penelitian ini merupakan penelitian yuridis normatif dengan menggunakan pendekatan perundang-undangan, dengan sumber bahan hukum primer, sekunder, dan tersier. Teknik analisis yang digunakan dalam penelitian ini adalah teknik penafsiran sistematis, yaitu interpretasi yang menghubungkan pasal yang satu dengan pasal yang lain dalam suatu peraturan perundang-undangan yang bersangkutan sehingga mengerti apa yang dimaksud. Pembahasan dari hasil penelitian yaitu kewenangan pemerintah daerah dalam penanganan fakir miskin terkait pendataan masyarakat miskin berdasarkan ketentuan peraturan perundang-undangan berkaitan dengan verifikasi dan validasi data. Pemerintah daerah tidak memiliki kewenangan melakukan penetapan data fakir miskin di luar DTKS dalam penanganan kemiskinan. Pemerintah daerah yang melaksanakan penanganan kemiskinan di luar DTKS, tidak sah dan data tersebut batal demi hukum karena tidak memiliki dasar hukum, sehingga pemerintah daerah yang menyalurkan bantuan sosial di luar DTKS yang menggunakan APBN harus mengembalikan uang ke kas negara. Kata Kunci: Pemerintah Daerah, Kewenangan, DTKS Abstract This research aims to analyze, describe, and find out the authority of local governments to collect data on poor people outside the integrated data of social welfare (henceforth referred to as DTKS), and the validity of data use regarding the mitigation of poverty by local governments outside DTKS in mitigating poverty. This research employed normative-juridical methods and a statutory approach with materials involving primary, secondary, and tertiary data, further analyzed based on systematic interpretation by connecting related articles of legislation. The research studies that the authority mentioned above is related to data verification and validation. The local regulation, however, does not have any authority to set poverty data outside the DTKS in poverty mitigation. The data outside the DTKS is deemed invalid and null and void since it does not have any legal ground. That is, local governments giving social aid to those not registered in DTKS with State Budget must refund the money to the state. Keywords: local governments, authority, DTKS

Abstract

The defence and security of the Indonesian state is a very crucial thing in the practice of the state so that it requires a component of citizens to participate in efforts to maintain state security in addition to the Indonesian National Army (TNI) and the Indonesian National Police (Polri), the Supporting Component is needed in efforts to defend and secure the state but in practice the community thinks that it is contrary to Human Rights (HAM). The purpose of this study is to carefully examine and analyse the Establishment of the Reserve Component as a State Supporting Defence Viewed from a Human Rights Perspective. The legal research method used is normative juridical legal research method by conducting research on library materials and using a statute approach. The results of the research are that in the Indonesian constitution, the rights and obligations to defend the country by citizens have been regulated through the 1945 Constitution of the Republic of Indonesia, Law No. 3 of 2023 concerning State Defence, Law No. 23 of 2019 concerning Management of National Resources for State Defence, as well as the embodiment of patriotism in the state that can be carried out by a citizen who is then made by the Indonesian Government a state defence system in order to support national defence, namely by implementing a Reserve Component system stipulated in the PSDN Law and the formation of the Reserve Component is not an element of coercion or a form of human rights violation.

Abstract

The 1945 Constitution of the Republic of Indonesia stipulates that Indonesian citizens must participate in efforts to defend the country. This is contained in article 27 paragraph 3 which reads, "Every citizen has the right and obligation to participate in efforts to defend the country". Developing and attitude of defending the country can be done with several efforts, such as providing compulsory military education which has been implemented in several countries such as South Korea. Basic military training in Indonesia is only given to Indonesian National Soldiers, which in essence is something that is directly related to the profession they are undertaking. This journal seeks to explain how the public perceives the implementation of military service in Indonesia the form of a komponen cadangan (komcad) as part of the country’s defense and security system.

Abstract

The issue of plastic bags continues to be a significant topic globally in waste management. Their relatively low cost, ease of use, and accessibility have made plastic bags an integral part of human life. With increasing plastic bag usage, inevitably comes an increase in plastic waste. Moreover, the rapid usage cycle of plastic bags, as they are typically single-use items used only temporarily, exacerbates the problem. If plastic waste is not optimally managed, it will have negative environmental impacts. To address this, the retail company Alfamart has begun employing green marketing strategies to promote the "Plastic Bag Diet" by offering environmentally friendly shopping bag products (Eco Bags). This aims to raise awareness and concern among the public for environmental sustainability by reducing plastic bag usage during shopping. Apart from Alfamart, other competing retail companies have also adopted similar strategies and offer eco-friendly bag products. The intensifying competition among retail companies forces managers to reconsider their strategies to win market share. The issuance of the Bali Provincial Regulation on Limiting Single-Use Plastic Waste is based on Article 12 paragraph (3) and Article 13 paragraph (2) of Bali Provincial Regulation Number 5 Year 2011 concerning Waste Management. This reflects the negative impacts that can arise if waste is not properly managed. The enactment of local regulations prohibiting the use of single-use plastic indicates a legal policy direction towards environmental conservation. The research method used in this study is a juridical normative method with a literature review approach, focusing on legal norms including principles, norms, rules, regulations, agreements, and doctrines. Therefore, this study aims to analyze the effects of green marketing on attracting purchasing interest and persuading the public to make purchasing decisions on Eco Bag products at Alfamart as alternatives to plastic bags.

Abstract

This research aims to analyze the optimization of legal protection and risk mitigation for PT ASDP Indonesia Ferry (Persero) as the lender in a Shareholder Loan (SHL) Agreement with PT Indonesia Ferry Properti, and to examine the legal implications of the PT ASDP directors' liability in the SHL decision-making process. The research method employed is normative juridical with a literature study approach. The findings indicate that although the SHL execution has procedurally met legal principles and Good Corporate Governance (GCG), the optimization of legal protection for PT ASDP requires the enhancement of more proactive post-disbursement fund supervision clauses and, crucially, the implementation of specific collateral to mitigate credit risk, considering the current agreement is still reactive and lacks specific collateral. Furthermore, the directors of PT ASDP bear responsibilities under Article 97 of the Company Law and the principle of fiduciary duty. The Business Judgment Rule (BJR) doctrine can shield directors from personal liability if decisions are made in good faith, with due care, without conflicts of interest, and accompanied by risk mitigation efforts, wherein the implementation of GCG principles is fundamental. Violations may lead to civil, criminal, or administrative liability. This research concludes the importance of contractual strengthening of the SHL and strict adherence to GCG to protect company assets and directors.
