Abstract

Tujuan pembentukan DPD RI secara filosofis lebih didorong oleh kepentingan mewarnai kebijakan pemerintah nasional dengan memberikan ruang baru bagi kepentingan masyarakat daerah. Pengertian daerah di sini tentu bukanlah daerah per daerah, melainkan wilayah geokultural dalam bingkai yang majemuk. Dalam penelitian ini diuraikan beberapa rumusan masalah antara lain ; Bagaimana Politik Hukum Pembentukan Dewan Perwakilan Daerah dalam sistem ketatanegaraan di Indonesia, Bagaimana kedudukan Dewan Perwakilan Daerah dalam pembentukan Undang-undang, Bagaimana Konsep pengaturan kedudukan fungsi Dewan Perwakilan Daerah dalam pembentukan Undang-undang ke depan. Penelitian yang digunakan adalah penelitian hukum normatif, Pendekatan yang digunakan adalah Pendekatan perundang-undangan, Pendekatan konseptual, pendekatan doctrinal. Tehnik pengumpulan bahan hukum Sesuai dengan penggunaan bahan sekunder dalam penelitian ini, maka pengumpulan bahan pun dilakukan dengan cara mengumpul, mengkaji, dan mengolah secara sistematis bahan-bahan kepustakaan serta dokumen-dokumen yang berkaitan. Data sekunder baik yang menyangkut bahan hukum primer, sekunder dan tersier diperoleh dari bahan pustaka, dengan memperhatikan prinsip pemutakhiran. Data tersebut disusun secara sistematis, sehingga diperoleh gambaran relatif lengkap dari klasifikasi secara kualitatif. Berdasarkan hasil penelitian ini disarankan agar, pengaturan tentang kewenangan di bidang legislasi dari Dewan Perwakilan Daerah sebagaimana yang diatur menurut Pasal 22 D ayat (1) dan (2) Undang-Undang Dasar Negara Republik Indonesia tahun 1945 bertentangan dengan status dan kondisi yang dikehendaki dari pembentukan Dewan Perwakilan Daerah tersebut, maka pengaturan tentang kewenangan di bidang legislasi tersebut perlu untuk dilakukan perubahan untuk disesuaikan dengan status dan kondisi Dewan Perwakilan Daerah yang merupakan lembaga perwakilan daerah. Dan Sebagai langkah konkrit dari pengaturan yang ideal terhadap eksistensi dan kedudukan Dewan Perwakilan Daerah tersebut, maka perlu untuk dilakukan perubahan terhadap ketentuan Pasal 22 D ayat (1) dan (2) Undang-Undang Dasar Negara Republik Indonesia tahun 1945, oleh Majelis Permusyawaratan Rakyat yang diberikan wewenang untuk mengubah dan menetapkan Undang-undang Dasar.

Abstract

The Village Head Dispute Resolution Mechanism should be regulated in detail and clearly in the norms that apply as law, which should also contain provisions regarding the Village Head dispute resolution mechanism, because these provisions are very important, where each region is required to make a Regional Regulation, related to the issue of the settlement of the village head election, which regulates the election of the village head, including providing arrangements for the settlement of village head election disputes. The Regional Regulation is the juridical basis used by the Head of government at the regional level, namely the Regent and Deputy Regent. This research is a nomative law research in which the approach used is the library or statutory approach through a study of the decisions on the results of the dispute over the village picades. The technique of collecting legal materials is carried out by means of library research. The analysis of legal materials is carried out in a qualitative deductive manner so that a conclusion can be drawn according to the needs of what has been studied. What has been researched is the regent's responsibility as a regional head which is carried out in accordance with the Regional Regulation to form an Election Committee, a Sub-District Supervisory Committee, a District Research Committee, and a Dispute Resolution Team formed directly by the East Lombok Regent. The pattern of village head election dispute resolution carried out by the local government is through deliberation with the roles of negotiator, mediator and conciliator.

Abstract

The business concept in the digital era is now changing all lines from offline buying and selling transactions to online buying and selling transactions. Through this business concept, the existence of the internet or e-commerce only makes buying and selling transactions or legal relationships that occur shorter, easier and simpler. An agreement in the e-commerce transaction takes place, will relate to the parties who make the transaction. The purpose of this study is to find out how buying and selling online transactions on online websites, such as Bukala, Bukalapak, Shopee, Facebook, WahatsApp. etc. during the covid 19 pandemic and to find out the positive and negative impacts that arise in online buying and selling transactions according to business concepts in the economy. Digital banking and e-banking are bank products that are currently in great demand by the public. Especially in the midst of this COVID-19 pandemic. The PSBB policy issued by the government has limited physical economic activity. This makes many people who want to carry out economic activities that on average depend a lot on banks, being unable to do it smoothly. In general, people make buying and selling transactions by meeting directly between the seller and the buyer, and even before the existence of currency as a means of payment, buying and selling transactions were carried out by bartering or exchanging goods between people who needed the goods with each other. Along with the times, new technologies began to emerge that make it easier for someone to do their work. One such technology is the Internet. The internet has brought changes to human activities in an effort to fulfill all their needs, because the internet can open up a world that is so wide and is able to provide various information and facilities needed. The method used in the research uses normative research, namely a library research by examining library materials related to the object under study. This study uses a statutory approach and a case approach. The analysis used is in the form of qualitative analysis, namely data analysis by providing a description of the findings to answer the problems that occur. One of the facilities provided by internet media is buying and selling activities through electronic media or commonly called E-commerce. E-commerce is mostly done by anyone, especially the modern business community because it is felt that it can streamline time, so that someone can transact with anyone and at any time without meeting face to face or know each other in trade. They only base buying and selling transactions on mutual trust, so that the sale and purchase agreements that occur between the parties are also carried out electronically, therefore there is no agreement file as in conventional buying and selling transactions. Although there are conveniences provided by e-commerce, it turns out that there is also a factor that hinders the implementation of e-commerce which turns out to be problematic for the implementation of e-commerce itself. One of them is the seller's responsibility if he defaults in buying and selling through e-commerce.

Abstract

Pendekatan yang digunakan adalah Normatif melalui pendekatan Undang-Undang (Statute Approacht). Adapun tujuan nya untuk mengetahui Prosudur Pendaftaran Hak Atas Tanah dan untuk mengetahui perlindungan hukum Pendaftaran Hak Atas Tanah Menurut Peraturan Pemerintah (PP) No. 24 Tahun 1997 Tentang Pendaftaran Hak Atas Tanah. Terkait dengan pendaftaran hak atas tanah di Kantor Badan Pertanahan Nasional Kabupaten Lombok Timur Sesuai. Pendaftaran hak atas tanah di jalankan sesuai dengan ketentuan yang berlaku dan setelah melalui Badan Pertanahan Nasional (BPN) baru didaftarkan kepada Pejabat Pembuat Akta tanah (PPAT) yang sudah ditunjuk dan resmi oleh pemerintah. Mengenai perlindungan hukum pendaftaran hak atas tanah Dalam PP Nomor 10 Tahun 1961, tujuan pendaftaran tanah tidak dinyatakan dengan tegas. Pendaftaran tanah yang dinyatakan dalam Pasal 3 PP Nomor 24 Tahun 1997 bertujuan untuk, 1). Untuk memberikan kepastian hukum dan perlindungan hukum kepada pemegang hak atas suatu bidang tanah, satuan rumah susun, dan hak-hak lain yang terdaftar, agar dengan mudah dapat membuktikan dirinya sebagai pemegang hak yang bersangkutan, 2). Untuk menyediakan informasi kepada pihak-pihak yang berkepentingan termasuk Pemerintah agar dengan mudah dapat memperoleh data yang diperlukan dalam mengadakan perbuatan hukum mengenai bidang-bidang tanah dan satuan- satuan rumah susun yang sudah terdaftar, 3). Untuk terselenggaranya tertib administrasi pertanahan; ABSTRACT The approach used is the normative approach through law (Statute Approacht). As for his goal to know Prosudur the registration of land rights and to know the legal protection the registration of land rights, according to the Government Regulation (PP) No. 24 Year 1997 On registration of land rights. Related to the registration of land rights in the Office of the national land Agency East Lombok Regency accordingly. Registration of land rights is run in accordance with the applicable provisions and after going through the national land Agency (BPN) has registered to the land deed official (PPAT) who have been appointed and authorized by the Government. Concerning the protection of the legal registration of land rights in the PP No. 10 Years 1961, land registry purposes not stated unequivocally. Land registry is stated in article 3 PP Number 24 year 1997 aims to 1). To provide legal certainty and legal protection to the rights of a holder of land, units, flats and other rights listed, in order to easily be able to prove himself as the holder of the right in question, 2). To provide information to the parties concerned including the Government so that it can easily obtain data required in legal deeds held concerning fields of land and flats units that are already registered , 3). Abstract

Abstract Judicial Pardon is a concept of punishment in which a defendant is proven guilty, but is not sentenced by the Judges. This concept is interesting to study after several cases arose because it was considered not to reflect a sense of justice for the ordinary people, due to the rigid approach of law enforcement due of our criminal system which is closer to punishment. Using a qualitative normative approach, the author tries to examine the concept of Judicial Pardon into the Indonesian penal system, the conclusion obtained is with the current legal system, the application of Judicial Pardon is not yet possible until criminal law reform is implemented. Key Word: Judicial Pardon, Non imposing of penalty , Criminalization Abstrak Judicial Pardon merupakan suatu konsep pemidanaan dimana seorang terdakwa terbukti bersalah, tetapi tidak dijatuhkan pemidanaan oleh Majelis Hakim. Konsep ini menarik untuk di telaah setelah beberapa kasus mencuat karena dianggap tidak mencerminkan rasa keadilan bagi rakyat kecil, karena pendekatan yang kaku dari penegak hukum akibat sistem pemidanaan kita yang lebih dekat pada penghukuman. Menggunakan pendekatan normatif kualitatif, penulis berusaha mengkaji konsep Judicial Pardon ini kedalam sistem pemidanaan Indonesia, kesimpulan yang didapat adalah dengan sistem hukum yang ada sekarang, penerapan Judicial belum dapat diterapkan sampai pembaharuan hukum pidana terlaksana.
