Abstract

Batok kelapa merupakan limbah yang dihasilkan dari penggunaan kelapa itu sendiri. Pemanfaatan asap cair pada batok kelapa mampu menghambat pertumbuhan bakteri/jamur dan dapat digunakan dalam pengobatan luka luar. Asap Cair didapatkan dari hasil pirolisis batok kelapa setelah melalui pemanasan pada variasi suhu 300oc, 400oc dan 500oc. Hasil asap cair dari pirolisis kemudian dimurnikan dengan metode distilasi dengan variasi suhu 80-100oc dan 100-110oc. Setelah didapatkan asap cair murni dilakukan pengujian dengan menggunakan GC-MS, uji antibakteri antara asap cair dan obat merah menggunakan bakteri Staphylococcus aureus dengan metode difusi dan uji ph. Diketahui dari hasil GC-MS hasil optimum pada suhu pirolisis 400oc dengan suhu distilasi 100-110oc dengan kandungan fenol sebesar 13,55%. Pada uji antibakteri diketahui efektivitas antibiotik berhubungan dengan zona inhibisi pertumbuhannya, makin luas diameternya, maka makin besar potensi sampel antibiotik tersebut, dengan menggunakan pembanding obat merah diperoleh diameter terluas yaitu sebesar 15,6 mm yang terdapat pada asap cair dengan suhu pirolisis 400oc dengan suhu distilasi 100- 110oc. Hasil penelitian menunjukkan bahwa kandungan fenol dalam asap cair dari batok kelapa dapat berperan dalam pngobatan penyakit infeksi seperti luka lecet dan koreng. Hal ini merupakan solusi alternatif yang cukup mudah pembuatannya dan tidak mengeluarkan biaya yang besar.

Abstract

The purpose of this study is to get an idea of how the principles in Islamic and modern government systems compare, both similarities and differences. Researchers use descriptive-qualitative research. Data obtained through literature reading, analyzed and critically compromised for further narrative description. This research uses descriptive-qualitative analysis, data and information about matters related to this research are studied, reviewed, classified carefully, then the analysis process is carried out by deduction, the analysis process takes place continuously from beginning to end with the aim of finding answers to the rumplations of problems carried by the research.  Based on the analysis of this research data concludes that  the leader in the early Islamic and contemporary government system is a powerful and influential figure, the establishment of the State of Medina on the basis of the agreement of diverse nations, this is the same as the establishment of many countries in the world today, the State of Medina is a state of law because it has a Medina Charter or Medina Constitution,  as many countries in the world declare as State of law. Muhammad as a central figure has always been open in accepting the opinions of others for the benefit of the country, his style of government is fiber with domocracy. Muhammad also at one time became the leader of the State as well as the leader of the government and had full authority just like  the current presidential system of government.

Abstract

Tujuan penelitian ini mengetahui tata cara pelaksanaan ritual pra nikah di Desa Air Meles Atas Kecamatan Selupu Rejang Kabupaten Rejang Lebong dan bagaimana pandangan hukum Islam terhadap ritual pra nikah. Adapun metode penelitian yang digunakan dalam penelitian kualitatif. Dari penelitian yang dilakukan maka penulis mendapatkan hasil penelitian bahwa pelaksanaan ritual pra nikah di Desa Air Meles Atas Kecamatan Selupu Rejang Kabupaten Rejang Lebong terdiri dari puasa, wakaf, ziarah kubur dan genduren. Tidak ada dalil mengenai semua ritual yang dilakukan masyarakat Desa Air Meles Atas sebelum nikah. Namun ada yang tetap boleh dilakukan dan ada juga yang tidak boleh. Ritual yang tetap boleh dilakukan seperti puasa, wakaf dan ziarah kubur. Karena puasa dan ziarah kubur merupakan tradisi yang baik, sedangkan wakaf untuk kemaslahatan orang banyak. Adapun ritual yang tidak boleh dilakukan adalah ritual genduren. Karena di dalam pelaksanaannya terdapat sajen yang dipersembahkan untuk Dewi Padi yang diyakini sebagai Dewi penjaga beras pada saat acara pernikahan nanti. Dalam Islam sendiri ini termasuk menyekutukan Allah dan termasuk dosa besar apabila tetap dilakukan.

Abstract

The purpose of this study is to find out what are the implementation of contemporary waqf investment models, then solve how Islamic law views the implementation of contemporary waqf investment and review in detail how the principles and signs of shari'ah for control of the implementation of contemporary waqf investment. This research is a descriptive-qualitative research. Data obtained through literature reading, analyzed and critically compromised for further narrative description.  The primary object of this study is the text, which in turn what is contained in the text will be reviewed in depth with the methodology of taking Islamic law. This research uses descriptive-qualitative analysis, data and information on matters related to this research are studied, reviewed, classified carefully, with the aim of finding legal provisions and principles of control over research problems. Based on data analysis, this study concludes that contemporary waqf investment law is permissible with various provisions according to the investment pattern applied. The sharia principle for contemporary investment control is that the form of investment must be in accordance with sharia and invested in lines that do not contradict the shari'a, should invest in various lines to reduce the possibility of losses that occur, written and officially written and insured with sharia insurance, investment must not conflict with the requirements of the waqf and not harmful to the benefit of the waqf itself.

Abstract

This study aims to analyze the reformulation of progressive fiqh of Talak (divorce), with a focus on SEMA No. 1 of 2022, which emphasizes the principle of making divorce more difficult in the interest of protecting women. In the context of Islamic law, divorce has often been considered a unilateral right controlled by the husband, potentially neglecting the rights of women. SEMA No. 1 of 2022 was introduced as a response to this issue, offering a fairer and more just approach for all parties involved. This research employs a library research method, reviewing legal literature, official documents, as well as the views of legal scholars and practitioners regarding the implementation of this policy. The analysis results show that the reformulation of the fiqh of divorce in SEMA No. 1 of 2022 provides a better platform for protecting women's rights in divorce proceedings, including encouragement for mediation and peaceful dispute resolution. Furthermore, this study identifies challenges in the application of this principle on the ground, including cultural and social resistance. This research is expected to contribute to the development of family law in Indonesia that is more responsive to the needs of women, as well as to raise awareness of the importance of justice for all parties in the context of divorce. This study serves as an important reference for further research on fiqh of divorce and women's protection policies within the framework of contemporary Islamic law.

Abstract

This article examines siyasah in classical Sunni fiqh as a form of jurisprudential reasoning, rather than as a theory of state institutions. This study employs a normative qualitative approach using comparative fiqh analysis and contextual jurisprudential interpretation to analyze authoritative classical fiqh texts from the Hanafi, Maliki, Shafi’i, and Hanbali schools pertaining to governance, political authority, public policy, and legal discretion. The comparative method is used to identify patterns of similarities and differences across schools in conceptualizing the relationship between law, political authority, and the public interest, while contextual interpretation is applied to situate fiqh arguments within their historical and methodological contexts. The research findings indicate that doctrinal differences regarding political discretion reflect the plurality of legal rationalities operating within a shared normative horizon, namely justice ('adl) and the public interest (maslahah). Political flexibility in this article is conceptualized as the juristic logic of political flexibility, namely an internally structured and ethically bound legal logic, not a value-free space of political power. This article concludes that siyasah syar'iyah is an integral form of bound discretion within the Islamic legal system, offering a historical, contextual-methodological, and non-reductionist framework for contemporary studies of Islamic law and politics.

Abstract

Purpose: This article aims to examine the historical transformation and codification of waqf jurisprudence in Indonesia and to analyze the legal challenges arising in its implementation within a plural legal system. This study seeks to explain how Islamic law, state law, and customary law interact and negotiate in shaping national waqf regulations. Design/Method/Approach: This study employs a qualitative juridical-normative approach combined with historical analysis. Based on the theoretical framework of taqnīn al-fiqh (codification of Islamic law) and the theory of legal pluralism, the research analyzes legislation, classical fiqh texts, and relevant academic literature. Data is examined using content analysis and historical-critical analysis methods. Findings: Research indicates that the codification of waqf in Indonesia has developed gradually, beginning with pre-colonial religious practices, continuing through colonial administrative interventions, and culminating in the enactment of Law Number 41 of 2004 on Waqf. The plural legal system has significantly influenced the substance and direction of waqf codification through processes of negotiation and normative compromise. Nevertheless, its implementation still faces normative, institutional, and socio-cultural challenges. Originality/Values: This research contributes to the development of contemporary Islamic legal theory by demonstrating the dynamic and negotiative relationship between Islamic law and the modern state within the context of plural law. The study fills a gap in waqf studies by positioning codification as a historical-juridical process, rather than merely a normative or regulatory phenomenon, while also offering policy implications for strengthening waqf governance within a plural legal system.

Abstract

This article reconceptualizes Siyāsah Syar‘iyyah as a dynamic normative-epistemological framework in contemporary state governance. Despite the growing body of literature on Islamic governance, prior studies have largely remained at the descriptive or compatibility level, without offering a systematic methodological reconstruction capable of bridging classical jurisprudence and modern political realities. Addressing this gap, this study repositions Siyāsah Syar‘iyyah as an ijtihād-based model grounded in maqāṣid al-sharī‘ah, with an emphasis on public interest (al-maṣlaḥah al-mu‘tabarah), justice (taḥqīq al-‘adl), prevention of harm (raf‘ al-mafsadah), and consideration of long-term consequences (i‘tibār al-ma‘ālāt). Using a normative-doctrinal qualitative approach, this research examines the jurisprudential thought of al-Māwardī, al-Qarāfī, and Ibn al-Qayyim alongside contemporary debates on law and the state. This study argues that governance belongs to the domain of revisable norms (aḥkām mutaghayyirah), so that institutional forms such as constitutionalism and democracy can be understood as evaluative instruments, not fixed Islamic models. The findings indicate that Siyāsah Syar‘iyyah is compatible with modern political systems — including democracy and constitutionalism — as long as they are oriented toward justice and the public good, since such systems function as evaluative instruments (wasā‘il), not fixed Islamic models. The contribution of this research lies in the reconstruction of Siyāsah Syar‘iyyah as a contextual, maqāṣid-based, and outcome-oriented normative framework, operationalized through three strategic mechanisms: (1) the institutionalization of collective ijtihād in governance; (2) maqāṣid-grounded legislation; and (3) the operationalization of Islamic political ethics in public administration. In the Indonesian context, this framework demonstrates that Islamic governance values can be substantively embedded within constitutional practice, religious court jurisprudence, and sharia-based legislation — such as the KHI, KHES, and regulations on zakat and waqf — without necessitating a formal Islamic state

Abstract

The association of Islamic politics with radicalism has become a dominant narrative in contemporary discussions on religion and politics in Indonesia. Existing studies have largely focused on radical movements, religious extremism, and political Islam. At the same time, insufficient attention has been given to the intellectual traditions that have historically shaped moderate Islamic political engagement. This study examines how Shafi'i jurisprudence provides a normative and adaptive framework for political moderation and explores its relevance in challenging radicalism-centered interpretations of Islamic politics. Using qualitative library research, the study analyzes classical Shafi'i political texts, particularly the works of al-Mawardi, al-Juwaynī, and al-Ghazālī, alongside the historical experiences of Hasyim Asy'ari, Mohammad Natsir, and Nahdlatul Ulama in negotiating the relationship between Islam, politics, and the nation-state. The findings reveal that political moderation in the Shafi'i tradition is constructed through five interconnected principles: public welfare (maṣlaḥah), consultation (shūrā), preservation of social order (ḥifẓ al-niẓām), legal realism, and public accountability. These principles enable a flexible and context-sensitive approach to governance, allowing Indonesian Muslim scholars to selectively adapt classical doctrines while rejecting elements incompatible with democratic pluralism. The study argues that the Indonesian experience demonstrates an adaptive model of Shafi'i political thought that reconciles Islamic normative commitments with constitutionalism, democracy, and national unity. This article contributes to the literature by proposing Adaptive Shafi'i Political Theory, a theoretical framework introduced in this study, to explain how classical Shafi'i political principles are selectively adapted to support constitutionalism, democracy, and national unity beyond the dominant radicalism narrative.
