Abstract

Cara pemberantasan tindak pidana khususnya tindak pidana yang berkaitan dengan ekonomi seperti pencucian uang mulai terjadi pergeseran paradigma dari Follow The Suspect ke Follow The Money, sehingga lebih berupaya untuk mengembalikan uang negara (Asset Recovery) sebanyak-banyaknya. Salah satu caranya yakni dengan adanya Non-Conviction Based Asset Forfeiture, yaitu perampasan asset tanpa tuntutan pidana. Permasalahannya adalah untuk mengaplikasikan nya tentu memerlukan aturan-aturan yang berkenaan dengan hal itu, sehingga perlu mengkaji aturan tersebut dan bagaimana konsepsi Non-Conviction Based Asset Forfeiture sebagai langkah untuk mengembalikan kerugian negara dalam rangka penanggulangan kejahatan, jika dilihat pada teori analisis ekonomi terhadap hukum. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan meneliti data sekunder dan data dianalisis secara kualitatif. Kesimpulannya ketentuan telah diatur pada Pasal 65-67 UU TPPU didukung dengan PERMA Nomor 1 Tahun 2013 dan SEMA Nomor 3 Tahun 2013. Menggunakan mekanisme non-conviction based asset forfeiture sebagai langkah pengembalian kerugian negara dalam rangka penanggulangan kejahatan dibidang ekonomi dapat tercapai lebih cepat, efisien, dan efektif.

Abstract

The results of criminal case decisions greatly affect the eradication of the relevant criminal offenses. So it is necessary to examine these decisions to see whether or not such judges' decisions can eradicate corruption or not. Moreover, it is understood that one of the purposes of criminal giving is a deterrent effect for both the perpetrators and others. Therefore the focus of this study: first, What is the form of criminal sanctions imposed by the Judge of the Pekanbaru District Court on Corruption Cases during 2018; second, how the imposition of criminal sanctions by the Pekanbaru District Court Judge in the Corruption Case in 2018 is related to the eradication of corruption. This type of research is a normative legal research that is based on mere secondary data and supplemented with interviews with certain parties. The research results obtained are the form of criminal sanctions given by judges in cases of corruption in the Pekanbaru District Court is only in the range of one to four years, twenty cases and for five years to ten years there are three remaining cases are cases that the prosecution does not can be accepted and the defendant is released from punishment. The sentence given by the judge on corruption cases in the Pekanbaru district court is still far from being said to have an impact on the eradication of corruption itself. Because, from the form of the sentence alone there are still many light and only given a special minimum sentence. Even though the losses suffered by the State are quite large. Then, many cases are subject to Article 3 of Article 2, where the sentence is lighter than Article 2

Abstract

Abstrak Tingkat kasus tindak pidana kekerasan terhadap anak dan penyalahgunaan narkotika oleh anak masih berada pada posisi yang mengkhawatirkan. Salah satu upaya yang bisa dilakukan untuk mencegah terjadinya tindak pidana tersebut adalah dengan melakukan sosialisasi. Sehingga masyarakat dalam hal ini Desa Bukit Ranah bisa lebih memahami terkait larangan kekerasan terhadap anak dan larangan penggunaan narkotika. Metode yang digunakan adalah dengan melakukan sosialisasi yakni menjelaskan regulasi terkait tindak pidana tersebut dan diakhiri dengan tanya jawab dan diskusi. Setelah melakukan sosialisasi, pengetahuan masyarakat terkait tindak pidana tersebut menjadi lebih baik. AbstractThe level of crime against children and narcotics services by children is still in a frightening position. One of the efforts that can be made to prevent this crime is by conducting the socialization. So that the community, of Bukit Ranah Village, can better understand the prohibition of violence against children and the use of narcotics. The method is by explaining the regulations related to the crime and ending with a discussion. After conducting the socialization, the public's knowledge regarding the crime became better.

Abstract

The population of persons with disabilities in Indonesia that continues to increase if not handled properly has the potential to cause discrimination even though there are several laws and regulations on persons with disabilities. Moreover, the social paradigm towards persons with disabilities is often likened to the person's medical inability, hence disability is considered as a sick person who always needs assistance and unable to receive education, let alone work like humans in general. It is not surprising if to this day, there are still many obstacles experienced by persons with disabilities in getting public services. Of the many obstacles that exist, the most common ones encountered, even though its existence is very important in human life is the obstacle in getting access to justice. Admittedly, persons with disabilities still often face discrimination when dealing with the law in court. Therefore, in this study the author analyzed the legal protection of persons with disabilities by dealing with the law and the empirical conditions of fulfilling their rights in Pekanbaru District Court. This is a form of juridical-normative research. The results of the study conclud that the state is quite appropriately protecting the rights of persons with disabilities through the legislation. However, from the implementation aspect in Pekanbaru District Court, there are still obstacles in physical facilities, regulation, and knowledge

Abstract

ABSTRAK Sanksi bagi pelaku kekerasan seksual terhadap anak mengalami perkembangan, yaitu munculnya pengebirian kimia. Namun keberadaannya mengalami pro dan kontra.. Penelitian ini mengkaji masalah regulasi kebiri kimia, melihatnya dalam pandangan Hak Asasi Manusia dan Hukum Pidana Islam. Menggunakan metode penelitian hukum normatif yang didasarkan pada data sekunder. Hasil yang diperoleh, ketentuannya terkandung dalam Peraturan Pemerintah Pengganti Undang-undang No. 1 tahun 2016 Pasal 81 (7), (8), (9) dan 81 A. Perspektif Hak Asasi Manusia, pengebirian kimia dipandang sebagai hukuman tidak manusiawi yang berdasarkan dari regulasi internasional seperti  Deklarasi Universal Hak Asasi Manusia  dan lain-lain. Perspektif Hukum Pidana Islam, pemberian hukuman kebiri pada terpidana pedofilia bisa memberikan efek jera (zawajir) terhadap pelaku. Dalam hal ini penetapan sanksi hukuman kebiri dapat dikategorikan sebagai hukuman ta’zir (hukuman tambahan) yaitu hakim dapat berijtihad menemukan dan menetapkan suatu hukum yang tidak ada hukumannya baik dalam al quran maupun hadis dengan pertimbangan zawajir (efek jera). Kata Kunci: Kebiri Kimia, Kekerasan Seksual, Anak, Hak Asasi Manusia, Hukum Pidana Islam ABSTRACT Sanctions for perpetrators of sexual violence against children have developed, namely the emergence of chemical castration. However, its existence has pros and cons. This study examines the issue of chemical castration regulation, looking at it from the perspective of Human Rights and Islamic Criminal Law. Using normative legal research methods based on secondary data. The results obtained, the provisions are contained in Government Regulation in Lieu of Law no. 1 of 2016 Articles 81 (7), (8), (9) and 81 A. Human Rights Perspective, chemical castration is seen as an inhuman punishment based on international regulations such as the Universal Declaration of Human Rights and others. From the perspective of Islamic criminal law, the punishment of castration on pedophile convicts can provide a deterrent effect (zawajir) against the perpetrators. In this case, the stipulation of castration punishment can be categorized as ta'zir punishment (additional punishment), namely the judge can ijtihad to find and determine a law that has no punishment in both the Qur'an and Hadith with consideration of zawajir (deterrent effect).Keywords: chemical castration, sexual violence, child, human rights, islamic criminal law Keywords: Chemical Castration, Sexual Violence, Child, Human Rights, Islamic Criminal Law

Abstract

The process of law enforcement for the criminal acts of terrorism that should have been carried out from investigation to execution is often cut down to violations by the authorities, namely the Special Detachment (Densus) 88, such as arbitrary arrest, wrongful arrest and suspected death-shooting of terrorists without proper procedures. Based on these, the research will discuss two issues, first, how is the process of determining someone declared a terrorist suspect? Second, how is the implementation of the act of shooting to death suspected terrorists by Densus 88 in the perspective of due process of law? This study uses a normative juridical method which the data collection method is done through literature study and analyzed in descriptive-qualitative manner. The conclusions of this research are, first, the process of determining a person is declared a suspected terrorist is that a person suspected of having committed or attempted to commit, or participating in and/or facilitating a criminal act of terrorism is based on sufficient preliminary evidence, which is required at least 2 (two) valid evidence. Second, the execution of the act of death-shooting against the suspected terrorists by Densus 88 in the perspective of due process of law is when the authorities use firearms at the last step and may only be used for urgent conditions and preceded by a warning.

Abstract

Postulat terhadap penalaran hukum dalam pembuktian unsur tindak pidana kesusilaan merupakan hal penting. Perkara Nomor 46/Pid.B/2022/PN.Pbr merupakan kasus perbuatan cabul di perguruan tinggi yang diputus bebas, karena hakim menilai pasal dakwaan subsidairitas penuntut umum tidak memenuhi unsur tindak pidana. Ada dua tujuan penelitian yang dilakukan, yaitu mengetahui penalaran hakim dalam menerapkan doktrin hukum pembuktian dan memahami kebuntuan terobosan hukum (rule breaking) dari majelis hakim dalam menentukan postulat kesalahan terdakwa. Metode yang digunakan adalah metode penelitian normatif. Temuan penelitian dapat diketahui, bahwa penalaran hakim dalam menerapkan doktrin hukum pembuktian pada putusan bebas perkara perbuatan cabul, hanya terfokus pada pemeriksaan alat bukti keterangan testimoni para saksi terhadap tindak pidana. Keseluruhan alat bukti keterangan ahli yang bersifat saintifik-forensik sebagai pendukung fakta keterangan korban dikesamping hakim. Temuan kedua, bahwa penyebab dari kebuntuan terobosan hukum (rule breaking) dari majelis hakim dalam menentukan postulat kesalahan terdakwa disebabkan ketika hakim melakukan penalaran hukum perbuatan cabul hanya menitikberatkan pada bentuk batas-batas perbuatan nyata terdakwa. Implikasi penalaran dengan metode penafsiran restriktif yang ketat tidak dapat menemukan kausa unsur tindak pidana perbuatan cabul yang berkarakter tersembunyi. Kesimpulan penelitian, hakim memandang keterangan ahli forensik tidak relevan dalam pembuktian perbuatan cabul, dan memandang tidak perlu melakukan terobosan hukum dalam menentukan putusan bebas.

Abstract

Cases of criminal acts of corruption continue to increase every year and so it appears that there are problems in law enforcement. Lawrence M. Friedman said there are three components that can be studied to see whether good law enforcement has been implemented or whether a law is effective or not, namely legal substance, legal structure and legal culture. Therefore, it is necessary to study these three components regarding criminal acts of corruption to see how the law is enforced. The method used is normative legal research which is based on secondary data. Based on these three components, it was indeed found that there were problems in law enforcement regarding criminal acts of corruption. In terms of legal substance, the existing provisions are no longer in accordance with the current situation, for example in terms of types of criminal acts of corruption that have experienced development and provisions that still cause problems in their implementation. In terms of legal structure, several institutions have been involved, including KPK, but KPK's performance is far from good, in fact ICW said KPK's performance is still poor. Finally, in terms of legal culture, society still finds it difficult to let go of the habit of corrupt practices, as does law enforcement.

Abstract

The current Criminal Code is no longer in accordance with existing developments and is far from fulfilling the values ​​of the Indonesian nation. It is hoped that the 2012 Criminal Code Bill can answer this problem. The issue that is developing is that the Draft Criminal Code will adopt Islamic religious values, prostitution is an act that is also prohibited in the Islamic religion, therefore it should be regulated in the Draft Criminal Code. The problem is whether there is an opportunity for that and what challenges will be faced. If we do adopt Islamic religious values, how can we construct a good formulation regarding prostitution in the future? This research was carried out as a type of normative legal research, namely based on secondary data. The research results that the author found are that there are several challenges, in the form of: Indonesia is not an Islamic country and the population of Indonesia is not only Muslim. theoretical opportunities, namely that law is a fusion of interests, divine law theory, QS. Al-Ma'idah: 15-16, theory in the book "The Modern Trends Of Islam". Juridical opportunities, There has been an application of Islamic teaching values ​​in civil law. Apart from that, the values ​​of Islamic teachings are contained in the Al-Quran and Hadith, and are universal in nature and able to respond to existing developments in society. The Draft Criminal Code does not regulate recipients and providers of services in prostitution activities, and requires the construction of a new formulation.

Abstract

As a State Party to the Convention on the Elimination of All Forms of Discrimination against Women (CEDAW), Indonesia is legally obliged to adopt effective legislative measures to eliminate discrimination against women, including sexual violence. Despite this commitment, sexual violence remains prevalent, raising concerns regarding the adequacy of the existing legal framework. This study aims to re-examine Indonesia’s sexual violence regulations in light of CEDAW obligations and Feminist Legal Theory (FLT), particularly regarding their capacity to recognize and protect women’s lived experiences. The research employs normative legal research, analyzing secondary legal materials through conceptual and comparative approaches to legislation. The findings demonstrate that Indonesia’s regulatory framework on sexual violence remains fragmented and uneven. While the Criminal Code narrowly constrains the definition of sexual violence, the Criminal Procedure Code fails to adequately address women’s rights and gender-sensitive victim protection. Revisions to the Child Protection Law have strengthened prohibitions against sexual violence but remain limited in scope and apply exclusively to child victims. The Domestic Violence Law criminalizes sexual violence within the household context, yet its protection is confined to forced sexual intercourse and does not fully capture broader forms of sexual abuse. Conversely, the Women’s Empowerment and Child Protection Law represents a significant normative advancement, providing a more comprehensive prohibition of sexual violence and stronger guarantees for women’s rights. This study contributes to feminist legal scholarship by highlighting the persistence of gender-biased legal constructions and underscores the need for a coherent, victim-centered, and CEDAW-compliant legal framework to effectively address sexual violence in Indonesia
