Abstract

In Indonesia, marriage is regulated by positive law and religious principles, making it a social agreement and a sacred covenant imbued with spiritual dimensions. The Marriage Law highlights the significance of physical and emotional bonds as the foundation for building a prosperous and enduring family life, grounded in devotion to God Almighty. Within Islamic law and the Compilation of Islamic Law (KHI), the presence of a nasab guardian for the bride is a fundamental requirement for the marriage's validity. This guardian, typically a male relative from the bride's lineage, plays a crucial role in ensuring the legality of the union according to Islamic tenets. However, challenges may arise regarding the availability or presence of the nasab guardian. For instance, in the marriage between Sadam Husen bin Aji Sena and Dwi Yanthi Pranatalia Sipayung, the absence of the nasab guardian was due to religious differences within the bride's family. Other common issues include the guardian's refusal or inability to attend the marriage ceremony. In such cases, some individuals appoint a wali muhakkam, a guardian selected through community consensus or custom. However, the role of wali muhakkam has yet to be formally acknowledged in Indonesian marriage law. This study employs a qualitative approach with descriptive analysis to explore the isbat nikah case in the Karawang Religious Court (Decision No. 248/Pdt.P/2021/PA.Krw), which validated a marriage involving a wali muhakkam. Through interviews, observations, and document analysis, findings suggest that isbat nikah is often utilized to address nasab guardian issues, though its application should be carefully regulated to prevent misuse. Premarital education is recommended to enhance public awareness and ensure adherence to legal marriage procedures

Abstract

The issue of interfaith marriage in Indonesia is rooted in the legal conflict between Article 2, paragraph (1) of Law No. 1/1974 on Marriage, which regulates the legality of marriage based on religious law, and Articles 34 and 35 of Law No. 23/2006 on Citizenship Administration. Articles 34 and 35 of Law No. 23/2006 state that a valid marriage is one that is reported and registered, with Article 35(a) stipulating that the court determines the validity of a marriage. The incompatibility of these regulations regarding interfaith marriages has affected legal interpretation, resulting in discrepancies in judicial decisions. In response, the Supreme Court issued Circular Letter No. 2 of 2023, providing guidance for judges in adjudicating cases involving the registration of marriages between individuals of different religions and beliefs. This circular aims to ensure certainty and consistency in the application of the law in such cases. However, this regulation has sparked debate among legal experts. This research adopts a qualitative approach and is analyzed descriptively. The findings indicate that conflicting legal interpretations regarding interfaith marriages lead to differences of opinion among judges on the validity of such marriages. Moreover, inconsistencies in the legal framework governing interfaith marriage in Indonesia result in conflicts of legal interpretation. The primary cause of the ineffectiveness of Indonesia's interfaith marriage law is due to substantive legal considerations. Disagreements between legal systems lead to disputes among legal entities and impact interfaith marriages within society.

Abstract

The phenomenon of nightlife among urban youth in Indonesia has shown remarkable escalation in line with the rapid processes of urbanization, modernization, and cultural globalization. Nightlife is no longer merely perceived as a form of leisure or entertainment but has evolved into a medium of recreation, self-expression, identity construction, and social existence. The presence of nightclubs, music concerts, bars, and even digital activities such as nighttime live streaming has become an inseparable element of contemporary urban lifestyles. Nevertheless, behind its popularity, nightlife frequently reflects fundamental problems faced by younger generations, namely nihilism and the crisis of meaning. As described by Friedrich Nietzsche, nihilism signifies a condition in which individuals lose their moral foundations, experience spiritual emptiness, and perceive life as devoid of clear purpose. Within the Indonesian context, this phenomenon has been intensified by increasingly individualistic, fragmented, and pleasure-driven lifestyles, where nightlife often serves as an escape mechanism from social pressures and existential confusion. This article employs a qualitative approach through a literature-based study to examine nightlife within the framework of nihilistic philosophy and Islamic ethics. The analysis highlights three dimensions: (1) the connection between nightlife and hedonistic lifestyles as manifestations of nihilism, (2) the crisis of meaning in urban culture that generates both social alienation and spiritual estrangement, and (3) the proposed solutions offered by Islamic ethics and law, particularly through maqāṣid al-sharī‘ah and Sufi spirituality, to restore moral awareness and meaningful life orientation. The findings suggest that nightlife represents a broader value shift in contemporary urban culture, carrying significant implications for the identity and spirituality of Muslim youth. Therefore, a critical and solution-oriented framework rooted in Islamic ethics is urgently needed to integrate recreational needs with spiritual direction, ensuring that Islamic values remain relevant amidst the challenges of modern urban life.
