Abstract

This research is to address human trafficking in Myanmar is a deeply councerning issue. The situation is exacerbated by the ongoing conflict and the lack of effective governance in many areas. Human trafficking is a serious transnational crime threatening global security, particularly in Southeast Asia. Economic factors like poverty and job scarcity make many individuals vulnerable to exploitation. Indonesia, as a major labor supplier, often serves as a source, transit, and destination for human trafficking. ASEAN has implemented measures like the ASEAN Plan of Action Against Trafficking in Persons, but challenges remain due to legal disparities among member states. Indonesia's laws, including the Anti-Trafficking Law, provide a framework to combat this crime, yet improvements in enforcement and victim support are needed. This is a dogmatic normative juridical method, which involves exploration, examines, and explanation of legal doctrines and rules to address the legal issues.T he research concludes that regional and international cooperation is vital, including information sharing and law enforcement collaboration. ASEAN should consider revising the principle of non-intervention and establishing a regional human rights court. Firm actions, such as economic sanctions, may be needed against those involved in trafficking, including Myanmar's military junta. Effective law enforcement and cooperation are essential for ASEAN members to collectively address human trafficking, ensuring security and legal certainty for all.

Abstract

This paper discusses the proper gold pawn procedure to protect creditors and legal protection for PT Pegadaian against third-party gold pawn objects. Research on this gold pawn procedure provides an overview of how gold pawn is formed that is in accordance with the principles of contract law and the legal requirements of an agreement when compared to the distribution and settlement/auction mechanism for gold pawn products at PT Pegadaian. Ownership of movable objects, in this case gold pawn collateral, refers to Article 1977 of the Civil Code which states that anyone who brings movable objects is considered the owner of the movable objects and is entitled to carry out legal acts, including gold pawn transactions in. Meanwhile, legal protection for PT Pegadaian against third-party gold pawn objects provides an overview of risk mitigation efforts before the distribution of gold pawn products and legal steps after legal problems occur at PT Pegadaian. The legal basis of PT Pegadaian contained in the Financial Services Authority Regulation Number 31 of 2016 and others provides legal certainty and legal protection for PT Pegadaian as a creditor in carrying out company operations and distributing gold pawn products to the public.

Abstract

Conflicts over inherited company shares underscore ongoing legal uncertainties and highlight the need for a thorough legal review. The inheritance of shares in a Limited Liability Company (PT) is classified as a transfer of rights by operation of law (rechtsverkrijging onder algemene titel) as stipulated in the Indonesian Civil Code (KUHPerdata) and Law Number 40 of 2007 concerning Limited Liability Companies (Company Law). In principle, company shares are inheritable assets, and heirs have the right to receive them in accordance with inheritance laws. However, in practice, legal issues frequently arise when other shareholders object to heirs entering as new shareholders. This matter becomes more intricate when the company’s Articles of Association include clauses that limit the transfer of shares to external parties without the approval of current shareholders. This study aims to investigate the legal framework and practical application of share inheritance in limited liability companies in Indonesia. It employs a normative legal research method with statutory and conceptual approaches, drawing on secondary legal materials. The findings demonstrate that the inheritance of shares necessitates balancing the civil rights of heirs with the company’s interest in preserving business stability and continuity. This study presents a legal harmonization framework that has not been extensively explored in prior research. The innovation lies in its suggestion to harmonize inheritance law and corporate law to address potential conflicts and improve legal protection for both heirs and corporate stakeholders.

Abstract

This study aims to analyze (1) the registration of mixed marriages conducted abroad in the Indonesian Civil Registry and (2) the rights and legal status of children from mixed marriages abroad who are not registered with the Indonesian Civil Registry. Technology development has increased interactions between citizens of different countries, resulting in mixed marriages. The prospective husband and wife from various nationalities are subject to the laws of their respective countries. In the international realm, there are differences between Indonesian marriage laws and those of other countries, both in material and procedural aspects. The research method used is normative juridical. The findings of this study indicate that mixed marriages conducted abroad can be registered in Indonesia by fulfilling administrative requirements. Children from mixed marriages abroad who are not registered in Indonesia are considered Indonesian citizens and have rights as children born out of wedlock unless acknowledged by their father or it can be proven that the child has a blood relationship with the father.

Abstract

Penelitian ini dilakukan untuk mengkaji tentang kedudukan hukum dan keberlakuan antara perjanjian pokok dengan perjanjian tambahan, serta akibat hukum perjanjian jaminan yang tidak diperbaharui bersamaan dengan perjanjian pokoknya. Metode penelitian yang digunakan adalah Yuridis Normatif dengan melakukan studi pustaka yang diperoleh dari berbagai teori hukum dan peraturan perundang-undangan. Hasil dari penelitian ini menjelaskan bahwa dalam suatu perjanjian pokok sangat dimungkinkan untuk dilakukan suatu restrukturisasi, addendum, ataupun pembaharuan atas dasar berbagai macam alasan. Apabila terjadi restrukturisasi, addendum, ataupun pembaharuan dalam suatu perjanjian pokok maka haruslah diperhatikan esensinya terlebih dahulu. Dalam hal ini jika perjanjian tambahannya tidak di restrukturisasi, addendum, ataupun diperbaharui maka menyebabkan perjanjian tambahannya menjadi hapus. Sebaliknya apabila perjanjian ini di restrukturisasi, addendum ataupun diperbaharui dengan tanpa menyebabkan lahirnya perjanjian baru, baik dari sisi subjek, maupun objek, dan prasyarat yang baru, maka dalam hal ini perjanjian tambahan tetap berlaku dan tetap mengikuti perjanjian pokok yang telah di restrukturisasi, addendum ataupun diperbaharui tersebut.

Abstract

The purpose of this study is to examine the legal standing of testaments that forgo a spouse's right to inherit in the event of their death. This study is necessary because, while everyone has the right to draft a testament according to their desires, this does not absolve the contents of the testament from being based on applicable laws and regulations. This study was carried out utilizing a doctrinal and statutory method in a normative juridical manner. The study concludes that a testator's intentions are free to be included in a will; nonetheless, the Indonesian Civil Code governs the legitimacy of Legitieme Portie. Thus, if a testament is written by a spouse whose marriage has entered into a marital agreement to separate assets, and its contents eliminate the longest-living spouse's inheritance rights, then that will not violate the rights of the longest-living spouse because it is based on Article 914 of the Indonesian Civil Code that the husband or wife does not have Legitime Portie. In the meantime, a testament written by a spouse whose marriage did not result in a marital agreement that separates assets only applies to the portion of the maker's assets; in other words, the longest-living spouse still receives a share as part of the joint assets in marriage.

Abstract

This research discusses the unilateral cancellation of concerts by organizers at Serasa Nada music concerts in Yogyakarta. This research uses Normative Juridical research type in which the processing of legal materials is done through literature study. This study aims to analyze the legal protection of Serasa Nada concert ticket buyers in Yogyakarta who were unilaterally canceled by the organizer. The results showed that for the cancellation of the Serasa Nada music concert in Yogyakarta there are legal consequences that occur, namely default. The legal consequences of default are penalties or sanctions in the form of paying losses, canceling the agreement, transferring risks and paying court costs. In addition, because it uses an electronic platform, the rules of Article 17 of the ITE Law and Article 18 paragraph (1) of the ITE Law jo. Article 46 paragraph (1) PP 71/2019 and the organizer is responsible according to Article 21 paragraph (2) letter c of the ITE Law. Legal efforts that can be made by buyers of Serasa Nada concert tickets are to file a civil lawsuit, namely a lawsuit for default in Article 1267 of the Civil Code and because concert ticket sales use a platform which is a form of electronic transaction, ticket buyers can file a lawsuit in Article 35 jo. Article 38 of the ITE Law. In addition, a criminal lawsuit can be filed in Article 28 paragraph (1) jo. Article 45 paragraph (2) of the ITE Law.
