Abstract

Artikel ini bertujuan untuk menganalisis peran dan kontribusi partai politik Islam dalam pembentukan perda syari’ah wajib belajar pada Madrasah Diniyah Takmiliah Awaliyah (MDTA) di Kota Medan. Pasca tahun 1999 Pemerintahan Republik Indonesia mensahkan regulasi mengenai peraturan daerah (Perda). Lahirnya regulasi ini menyebabkan banyak daerah yang gencar menerapkan Perda berbasi syari’ah termasuk Kota Medan. Terdapat upaya dari partai politik islam yang berkontribusi terhadap Perda syari’ah kota Medan salah satunya peraturan mengenai wajib belajar pada MDTA. Urgensi penelitian ini adalah menilik pemahaman yang lebih mendalam tentang keterlibatan partai politik islam dalam memberikan perspektif yang lebih luas tentang perkembangan pendidikan agama Islam di tingkat dasar. Artikel ini menggunakan metode kualitatif dengan pendekatan yuridis normatif. Sumber data primer yang digunakan adalah Undang-Undang Nomor 23 tahun 2014 tentang Pemerintah Daerah. Sedangkan sumber data sekunder yang digunakan adalah buku-buku, artikel dan draft Undang-undang yang berkenaan dengan tema. Teknik pengumpulan data yang digunakan dalam artikel ini adalah dokumentasi dan dianalisis menggunakan analisis konten. Hasil penelitian menunjukkan bahwa: Pertama, peran dan kontribusi partai politik islam tentang Perda MDTA cukup signifikan mengingat banyaknya partai politik berbasis Islam yang gencar menyiarkan Perda Syari’ah mengenai wajib belajar MDTA. Kedua, meskipun peran partai politik cukup gencar dalam mensahkan Perda wajib belajar MDTA, upaya yang dilakukan masih tergolong belum optimal melihat banyaknya faktor penghambat dalam mensahkan regulasi wajib belajar MDTA.

Abstract

One of the principle of secularism in education is split between the education of the mind (intellect) and the spiritual (spiritual). In fact, man created God-not-as fragmented. Man is a perfect unity, not separated spiritual from the physical, and the physical is not separated from the spiritual. When education is separate from religious instructions then there is spiritual drought in some indecision on the part of students and others. One of the rationale that underlies the spirit of secularization of education in Islamic countries is, to advance civilization in Muslim countries by means of separate education system of "interference" of religion. Abstract

This study aims to determine and analyze the process of unregistered marriage through the guardian of Muhakkam. This study uses an empirical juridical method with a statutory and socio-legal approach. The results of this study indicate that the unregister marriage process carried out by the people in East Aceh by the guardian of Muhakkam still follows the understanding of the tengku and ulama but is not in accordance with the Marriage Act. Marriage without legal evidence and registration at the KUA can bring harm. There are several factors that influence the practice of unregistered marriages, including economic factors, not getting parental approval, low levels of education, lack of understanding and awareness of the importance of registering marriages, the absence of sanctions for perpetrators of unregistered marriages, and problems with polygamy permits

Abstract

This study analyzes the practice of sirri marriage in the City of Padangsidimpuan, Province of West Sumatra, Indonesia. The focus of this research is to see whether gender bias occurs according to gender analysis according to Mansour Fakih in fulfilling the rights and obligations of husband and wife in unregistered marriage families in Padangsidimpuan City. This type of research is field qualitative with the approach of Legal Sociology, Legal Psychology, and Anthropology. Based on research findings, unregistered marriages in the city of Padang Sidempuan do not only have an impact on wives and children, but also have an impact on husbands both in the household and in social life including 1) Marginalization, such as husbands having difficulty getting their rights from where they work and it is difficult to get social assistance from the government because they do not have a marriage certificate and family card, 2) Subordination: the impression that women are objects in marriage so that a woman can be published as a wife or kept secret, 3) Stereotypes: Women who are married in unregistered ways are considered mistresses , having an affair, or living at home without being married, 4) Violence: unregistered marriages are prone to domestic violence because there is no evidence that shows the existence of marital ties, and 5) double burden that must be borne by the wife, namely having to earn a living that should be borne by the husband, as well as take care and care for their children
