Abstract

AbstrakKebijakan Mendagri untuk menghapus 3.143 Peraturan Daerah (PERDA) menimbulkan kontroversi dan pro kontra. Berdasar pasal ketentuan Pasal 251 UU No 23 Tahun 2014 tentang Pemerintahan Daerah, dan Instruksi Menteri Dalam Negeri Republik Indonesia Nomor 582/476/sj Tentang Pencabutan/Perubahan Peraturan Daerah, Peraturan Kepala Daerah Dan Keputusan Kepala Daerah Yang Menghambat Birokrasi Dan Perizinan Investasi, Mendagri seakan menjadi Sweeping Power untuk menghapus PERDA. Padahal jika diperhatikan peraturan-peraturan yang lainnya; UUD 1945, UU tentang Kekuasaan Kehakiman,  mekanisme penghapusan PERDA seharusnya menggunakan judicial review. Sebagai negara hukum (rechtsstaat) penghapusan perda harus memperhatikan asas legalitas dan menghindari kesewenang-wenangan. Banyaknya PERDA yang dihapus mengebiri semangat otonomi daerah dan desentralisasi kekuasaan. Tulisan berikut ini akan menjelaskan prosedur penghapusan Perda secara konstitusional  dan hubungannya dengan negara hukum (reschtsstaat). Keywords: Penghapusan, PERDA, Hukum. AbstractPolicy of the Minister of the Interior removed 3,143 local regulations (PERDA) caused controversy and pros cons. Based on the provisions of Article 251 article of law No. 23 of 2014 about local governance, and the instruction of Minister of Internal Affairs of the Republic of Indonesia Number 582/476/sj Of Revocation/Regional Regulations, regulatory changes to the head Area and the decision of the head area that Discourages Investment and licensing Bureaucracy, Minister of the Interior seems to have Sweeping Power to remove PERDA. But if considering of other regulations; Constitution, Law on the powers of the Judiciary, mechanisms of elimination of PERDA should use judicial review. As a legal State (rechtsstaat) removal of perda should pay attention to the principle of legality and to avoid arbitrariness. The large number of deleted PERDA castrate the spirit of autonomy and decentralization of power.   This article will explain the procedure for removal of Perda constitutionally and their relation to state law (reschtsstaat). Keywords: Removal, Regional Regulation, Law.

Abstract

The electronic court (E-Court) system implemented in this study utilizes online technology to facilitate the legal process. This system is based on the principles of fast, simple, and low-cost, and it is designed to address the challenges of traditional court procedures. The objective of this research is to evaluate the effectiveness of E-Court implementation in the Kendal and Semarang Religious Courts in accordance with the Supreme Court Regulation No. 1 of 2019, No. 3 of 2022 and No. 7 of 2022 as well as the Directorate General of Religious Courts Agency No 5374/DJA/HM.01/X/2019, in achieving the principles of fast, simple, and low-cost. This study employs a juridical-empirical approach, using data gathered through interviews, observations, and literature review. The findings indicate that the online justice system, implemented with the aim of expediting the legal process, has been well received by the community, and has proven to be highly efficient in the Kendal and Semarang Religious Courts. Overall, this research highlights the importance of E-Court implementation in delivering fast, simple, and low-cost for the community, while acknowledging the need for continued efforts to enhance the system's accessibility and inclusivity.
