Abstract

Dispute settlement in Islamic tradition has been carried out since the era of Prophet Muhammad SAW. This is done through the courts (litigation) and through shulh, fatwa, mazhalim, and hisbah, known as non-litigation. The form of muamalah dispute settlement especially applicable nowadays is almost the same as those prevailing at the time of the Prophet. Litigation through the judicial institutions and non-litigation settlement called as alternative dispute resolution (ADR) is known by the term shulh in fiqh, while the path through arbitration is knows in fiqh as tahkimDOI: 10.15408/aiq.v5i1.2113

Abstract

The article needs to address the problem of dawn time too early in Indonesia. To prove this, the researcher used the Sky Quality Meter (SQM) in four locations with different sky brightness levels: Labuan Bajo, Belitung, Sidoarjo, and Bogor. In addition, the article also seeks to explain the views of the government and Islamic organization using SQM. This research uses normative, astronomical, and sociological approaches. The results showed that the value of the sun's tilt during the Dawn Sadiq period was -19.30º to -13.58º. The appearance of dawn can be detected earlier in locations with high sky brightness and low light pollution, such as in Labuan Bajo (-19.30º), while in other places with opposite conditions, the appearance of Dawn Sadiq is slower, such as in Bogor (-13.58º). If the SQM observation in Labuan Bajo is used as a reference, it will not significantly impact the current dawn schedule (dip = -20⁰). The use of SQM for dawn observation is acceptable to the Ministry of Religion and Islamic organizations. However, considering the mixed results of dawn research with SQM, the response of the Ministry of Religious Affairs, Nahdlatul Ulama, and the Islamic Association still uses dip = -20º, while Muhammadiyah shifts to dip = -18⁰. To minimize differences, it is necessary to conduct joint research on an ongoing basis to produce stable data on the setting of the sun at dawn.

Abstract

Ilmu Falak merupakan relasi harmonis agama dan sains. Dikotomi agama dan sains adalah hasil dari imperialisme Barat dan kuatnya paradigma positifistik. Dikotomi ini tidak sesuai dengan ajaran Islam, karena di dalamnya memuat ajaran tentang ibadah yang sangat berkaitan dengan fenomena alam terutama yang menyangkut waktu-waktu ibadah seperti waktu salat, puasa Ramadan, salat 'idain dan ibadah haji. Beribadah tepat waktu yang ditandai dengan fenomena alam dan menjadi konsens dari ilmu Falak sebenarnya menunjukkan adanya relasi yang harmonis antara ayat-ayat qauliyah dengan ayat kauniyah atau antara agama dengan sains, sehingga tidak perlu lagi mempertentangkan antara agama dan sains karena keduanya merupakan satu kesatuan yang berasal dari sumber yang sama yaitu Allah SWT. Falaq study is harmonies relationship between religion and science. Nevertheless, this is not in line with an Islamic perspective. It contains such the worship times such as prayer time, fasting month, 'idain and pilgrimage. Performingworship in the right time or predetermine time (kitaban mauqutan), which is science by the nature phenomenon and has become a consensus within Falaq study, actually shows harmonies relationship between kauliyah verses and kauniyah verses or between religion and science.Thereforeit is not necessary to contras the religion and science as (because) both of them are one in the same entity coming from Allah SWT.

Abstract

The obligation of Halal certification mandated by the Law of Halal Product Assurance (Undang-Undang Jaminan Produk Halal or UUJHP) No. 34 2014 for businesses is felt burdensome, especially by small and medium enterprises (SMEs). This research focuses on service process provided by a division in Muhammadiyah organization called “Ikrar Halal Muhammadiyah” or IHM as a solution offered by Muhammadiyah to solve the problem. Data were collected through observation and documents. Observation was conducted through participation in a discussion meeting held by Lembaga Pemeriksa Halal dan Kajian Halalan Thayiban (LPHKHT) Muhammadiyah (the Muhammadiyah Institute for Halal Investigation and Halalan Thayiban Studies) and Majelis Tarjih dan Tajdid (MTT) Muhammadiyah (the Muhammadiyah Tarjih and Tajdid Council). Furthermore, data from documents were collected from related parties such as Halal Center Perguruan Tinggi Muhamadiyah-Aisyiyah (HCPTMA) or the Halal Center of Muhammadiyah-Aisyiyah College, LPHKHT and MTT. The result of the research shows that IHM offered by Muhammadiyah is a smart solution helping the SMEs in fulfilling the halal certification obligation which is implemented gradually. IHM is not a halal certificate per se, but it is a halal self-declaration of SMEs about their products. This self-declaration is conducted under Muhammadiyah’s supervision through the involvement of HCPTMA, LPHKHT and MTT. When the SMEs are considered to be capable, they will be guided to propose the halal certification process held by BPJPH which requires more complex process than IHM. IHM is sort of a breakthrough step to fill legal vacuum and an ijtihad of Muhammadiyah.
