Abstract

The increasing of gold prices and high interest of the community to invest in gold responded by Islamic banking through Islamic gold pawning services with the term gardening gold. This investment is a modification of the mortgage system in Islamic banks and pawnshops. This investment is not neither a product of Islamic banks and Islamic pawnshops. Islamic financial institution provide only mortgage facilities not including investment to customers. The nature of the gardening gold transaction is to borrow money to pay the storage fee pawned gold and then to expect a rise of the gold price at market exceeding the costs of the bankDOI: 10.15408/aiq.v4i2.2096

Abstract

Studi ini bertujuan untuk menjelaskan mengenai Perjanjian yang penandatanganannya tidak dihadapan Notaris, padahal dalam pasal 5 ayat 1 Undang-Undang Nomor 42 Tahun 1999 Tentang Jaminan Fidusia menyatakan bahwa Pembebanan benda jaminan fidusia dibuat dengan akta Notaris dalam bahasa Indonesia dan merupakan akta jaminan fidusia. Serta tata cara proses penarikan objek jaminan fidusia harus dilakukan terdapat aparat Kepolisian sesuai dengan Peraturan Kapolri Nomor 8 Tahun 2011 Tentang Pengamanan Eksekusi Jaminan Fidusia.Jenis penelitian yang terdapat dalam skripsi ini adalah yuridis empiris. Penelitian ini berdasarkan Peraturan Perundang-undangan, Undang-Undang Nomor 42 Tahun 1999 Tentang Jaminan Fidusia dan Peraturan Kapolri Nomor 8 Tahun 2011 Tentang Pengamanan Eksekusi Jaminan Fidusia serta tinjauan langsung kelapangan untuk melihat langsung penerapan dari Peraturan Perundang-undangan.Hasil penelitian yang dilakukan peneliti adalah Jaminan Fidusia memiliki sifat accesoir (tambahan) artinya perjanjian ini ada setelah adanya perjanjian pokok yang dimana perjanjian pokok ini adalah perjanjian baku, atau klausul. Mengingat syarat sah perjanjian pasal 1320 telah memenuhi unsur maka perjanjian tersebut tetap sah. Kemudian Debt Collector dapat melakukan eksekusi dimana saja sesuai di dalam perjanjian tersebut, namun harus dihadiri pihak Kepolisian sebagai saksi dalam proses Eksekusi Objek Jaminan Fidusia tersebut. Sesuai dengan Peraturan Kapolri Nomor 8 Tahun 2011 tentang Pengamanan Eksekusi Jaminan Fidusia.

Abstract

Islamic bank was originally constructed as a non-usurious bankwith profit and loss sharing in all its operational mechanism. However, its progress in fulfilling the function of banks as intermediaries (financial intermediary), all types of business law legalized of syar'î based non-profit-sharing such as trade, leasing, and other services into products of Islamic banks. In fact, theoretically financing products with profit sharing schemecan be more economically prosperous society. This article discusses the problems and solutions system sharing (mudhârabah) in the scheme of financing in Islamic banks.DOI:

Abstract

The article needs to address the problem of dawn time too early in Indonesia. To prove this, the researcher used the Sky Quality Meter (SQM) in four locations with different sky brightness levels: Labuan Bajo, Belitung, Sidoarjo, and Bogor. In addition, the article also seeks to explain the views of the government and Islamic organization using SQM. This research uses normative, astronomical, and sociological approaches. The results showed that the value of the sun's tilt during the Dawn Sadiq period was -19.30º to -13.58º. The appearance of dawn can be detected earlier in locations with high sky brightness and low light pollution, such as in Labuan Bajo (-19.30º), while in other places with opposite conditions, the appearance of Dawn Sadiq is slower, such as in Bogor (-13.58º). If the SQM observation in Labuan Bajo is used as a reference, it will not significantly impact the current dawn schedule (dip = -20⁰). The use of SQM for dawn observation is acceptable to the Ministry of Religion and Islamic organizations. However, considering the mixed results of dawn research with SQM, the response of the Ministry of Religious Affairs, Nahdlatul Ulama, and the Islamic Association still uses dip = -20º, while Muhammadiyah shifts to dip = -18⁰. To minimize differences, it is necessary to conduct joint research on an ongoing basis to produce stable data on the setting of the sun at dawn.

Abstract

Life insurance raises legal issues in Islamic inheritance and Sharia economic law regarding the status of benefits after the policyholder’s death. This study examines judicial disparities in three Religious Court decisions: Tigaraksa, Sungai Raya, and Mataram, based on Islamic inheritance principles, sharia economic justice, and Indonesian positive law. Using a normative and comparative approach, the study analyzes court decisions and literature on Islamic inheritance and takaful. The findings show inconsistent interpretations. Tigaraksa and Sungai Raya courts treated insurance benefits as inheritance subject to faraid, whereas Mataram granted the beneficiary exclusive rights under contractual freedom. From a Sharia economic law perspective, such benefits constitute collective wealth (māl) and should be distributed fairly, unless a valid Sharia-compliant will or grant exists. This highlights the need for clearer Sharia-based guidelines. Keywords: sharia economic law; life insurance; islamic inheritance; judicial disparity; distributive justice   Abstrak Asuransi jiwa menimbulkan persoalan dalam ranah waris Islam dan ekonomi syariah terkait status manfaat asuransi setelah wafatnya pemegang polis. Penelitian ini menganalisis disparitas pertimbangan hakim dalam putusan Pengadilan Agama: Tigaraksa, Sungai Raya, dan Mataram, dengan menilai kesesuaiannya terhadap prinsip hukum waris Islam, keadilan ekonomi syariah, dan hukum positif Indonesia. Dengan pendekatan yuridis normatif dan komparatif, penelitian ini mengkaji putusan pengadilan serta literatur hukum waris Islam dan asuransi syariah (takaful). Hasil penelitian menunjukkan perbedaan penafsiran hukum. Pengadilan Agama Tigaraksa dan Sungai Raya menganggap manfaat asuransi sebagai harta warisan yang dibagikan menurut faraid, sedangkan Pengadilan Agama Mataram menempatkannya sebagai hak eksklusif kepada penerima manfaat berdasarkan asas kebebasan berkontrak. Dalam perspektif hukum ekonomi syariah, manfaat asuransi merupakan harta (māl) yang semestinya didistribusikan secara adil, kecuali terdapat wasiat atau hibah yang sah. Disparitas ini menegaskan perlunya pedoman berbasis syariah yang lebih jelas. Kata Kunci: hukum ekonomi syariah; asuransi jiwa; hukum waris Islam; disparitas putusan; keadilan distributive
