Abstract

This study aims to first determine the factors driving community involvement in Community Watch Human Trafficking and knowing the role of Community Watch Human Trafficking in the aspect of preventing human trafficking. The results of the study are as follows. First, the factors driving community involvement in CW-PO are: legal awareness of the dangers of trafficking in persons and their impacts; the experiences of family members and neighbors who have been victims of the Human Trafficking criminal act; accustomed to volunteering; There are joint concerns because there is an Indonesian Manpower Services Company and field workers who are tasked with recruiting prospective migrant workers from the village. Secondly, the role of Community Watch Human Trafficking in the prevention aspect of yatru: To collect data on migrating citizens; increasing public understanding of Human Trafficking criminal act; economic empowerment; advocating for village government to allocate village funds to open businesses; accompany former migrant workers who have returned to the village but have problems; carry out monitoring in the village.

Abstract

Sanksi waja merupakan mekanisme penyelesaian pelanggaran adat dalam masyarakat Bajawa yang tidak hanya berfungsi memulihkan hubungan sosial, tetapi juga berimplikasi terhadap kedudukan dan pemenuhan hak anak. Penelitian ini bertujuan menganalisis pengaruh sanksi waja yang dijatuhkan kepada orang tua terhadap kedudukan hak anak serta menganalisis pemenuhan hak anak menurut hukum adat Bajawa di Desa Naru, Kecamatan Bajawa, Kabupaten Ngada. Penelitian menggunakan jenis penelitian hukum empiris dengan pendekatan kualitatif. Populasi penelitian terdiri atas tiga ayah yang dikenai sanksi, dua ibu kandung, dan tiga tokoh adat. Seluruh anggota populasi dijadikan sampel sehingga diperoleh tujuh responden. Data dikumpulkan melalui wawancara dan dokumentasi, kemudian dianalisis secara deskriptif kualitatif melalui tahapan editing, coding, tabulasi, dan interpretasi data. Hasil penelitian menunjukkan bahwa sanksi waja memengaruhi kedudukan hak anak dengan berkurangnya hak atas nafkah, kehadiran dan peran ayah, hubungan dengan keluarga ayah, serta tidak diperolehnya hak waris dari garis ayah, sedangkan hak atas identitas, pengasuhan oleh keluarga ibu, dan kehadiran ayah dalam peristiwa adat tertentu tetap diakui. Kesimpulan penelitian menegaskan bahwa sanksi waja tidak menghilangkan status anak dalam masyarakat adat Bajawa, tetapi membatasi pemenuhan beberapa hak anak akibat kuatnya sistem kekerabatan matrilineal sehingga pelaksanaan sanksi adat perlu tetap memperhatikan kepentingan terbaik bagi anak.

Abstract

This study examines the role of Maneleo in early-age customary marriage practices in Kuli Aisele Village, Rote Ndao Regency, and its impact on the social and cultural life of the community. The problem addressed is the persistence of early-age marriage despite national law setting the minimum marriage age at 19 years. The objective of this study is to identify the role of Maneleo as a customary authority and to analyze the resulting impacts. This research uses an empirical method with a descriptive qualitative approach, collecting data through interviews, observations, and literature studies. The respondents include Maneleo, community leaders, and couples involved in early-age marriages within the last five years. The findings show that Maneleo plays a dominant role as the highest customary authority in determining the legitimacy of marriage, acting as a mediator and negotiator in determining bride wealth (belis), leading traditional rituals, and preserving cultural values. This role contributes to the continuation of early-age marriage as part of tradition and social stability. The impacts are both positive and negative, including cultural preservation and strengthened kinship, as well as socio-economic risks, disrupted education, and potential conflicts with state law. Therefore, collaboration between customary institutions and the government is necessary through education and policy integration.

Abstract

Customary land is land controlled and managed collectively by indigenous communities based on customary law that has been inherited from generation to generation. For the indigenous community of Teba Timur, customary land holds significant social, cultural, economic, and spiritual value as a source of livelihood and communal identity. However, a dispute arose when the Regional Technical Implementation Unit of Forest Management (UPTD KPH) claimed the area as part of a state forest zone, resulting in restrictions on the community’s rights to manage and utilize their customary land. This study aims to examine: (1) the customary legal basis of the Teba Timur indigenous community over customary land that has been traditionally controlled and managed, and (2) the perspective of Indonesian positive law regarding the control and management of land by the UPTD KPH over the customary land of the Teba Timur indigenous community. This research employed an empirical juridical method with a qualitative approach. Data were collected through interviews with village officials, customary leaders, community members, and UPTD KPH personnel, as well as literature studies on relevant legal regulations. The findings indicate that the Teba Timur indigenous community possesses a strong customary legal basis over its customary land due to continuous hereditary control and management. Although customary rights are recognized under Indonesian law, their implementation remains ineffective because of overlapping authority claims. Therefore, stronger legal protection, formal recognition of indigenous communities, regulatory harmonization, and deliberative dispute resolution are required.
