Abstract

Penelitian ini menyelidiki dampak pembelian iPhone yang memiliki International Mobile Equipment Identity (IMEI) yang dibatasi dan hak-hak hukum yang tersedia bagi konsumen menurut Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen, dengan fokus pada studi kasus di Toko iPhone Bi Gadget di Kupang. Metodologi yang digunakan dalam penelitian ini bersifat empiris, meliputi wawancara, survei, dan tinjauan pustaka. Temuan dari penelitian ini mengungkapkan bahwa konsumen menghadapi dampak negatif, termasuk ketidakmampuan untuk terhubung ke jaringan seluler, pengeluaran tambahan untuk mengaktifkan kembali IMEI, dan gangguan dalam aktivitas komunikasi sehari-hari mereka. Perlindungan hukum yang dimaksudkan untuk bersifat preventif dan punitif belum diterapkan secara efektif, terutama karena kurangnya detail tertulis tentang status IMEI, rendahnya kesadaran konsumen mengenai hak-hak mereka, dan keterlibatan yang terbatas dengan badan penyelesaian konflik. Singkatnya, meskipun undang-undang tersebut menguraikan hak-hak konsumen dan tanggung jawab bisnis, penerapannya secara aktual menghadapi tantangan, yang menyoroti perlunya peningkatan transparansi, pendidikan konsumen yang lebih baik, dan komitmen yang lebih kuat dari pelaku bisnis.

Abstract

This study examines the role of Maneleo in early-age customary marriage practices in Kuli Aisele Village, Rote Ndao Regency, and its impact on the social and cultural life of the community. The problem addressed is the persistence of early-age marriage despite national law setting the minimum marriage age at 19 years. The objective of this study is to identify the role of Maneleo as a customary authority and to analyze the resulting impacts. This research uses an empirical method with a descriptive qualitative approach, collecting data through interviews, observations, and literature studies. The respondents include Maneleo, community leaders, and couples involved in early-age marriages within the last five years. The findings show that Maneleo plays a dominant role as the highest customary authority in determining the legitimacy of marriage, acting as a mediator and negotiator in determining bride wealth (belis), leading traditional rituals, and preserving cultural values. This role contributes to the continuation of early-age marriage as part of tradition and social stability. The impacts are both positive and negative, including cultural preservation and strengthened kinship, as well as socio-economic risks, disrupted education, and potential conflicts with state law. Therefore, collaboration between customary institutions and the government is necessary through education and policy integration.

Abstract

This study examines the legal protection afforded to Koperasi Serba Usaha (KSU) Perempuan Berkat against losses resulting from non-performing loans from a civil law perspective. The research employs an empirical legal method with a qualitative approach conducted at KSU Perempuan Berkat in Fatufeto Village, Alak District, Kupang City. Data were collected through interviews, documentation, and literature review involving cooperative administrators, members with non-performing loans, and representatives from the Cooperative Office. The findings indicate that non-performing loans are primarily caused by factors related to character, capacity, capital, and economic conditions of members, while collateral has generally been fulfilled as a loan security requirement. Legal protection for the cooperative is implemented through preventive measures, including the application of the 5C principle, supervision, member education, and collateral requirements, as well as repressive measures such as warning letters, loan renegotiation, and loan restructuring. However, the implementation of legal protection has not been optimal because the cooperative prioritizes a familial approach over formal legal actions. Therefore, strengthening prudential principles and consistent law enforcement is necessary to minimize losses arising from non-performing loans and ensure the sustainability of cooperative operations.
