AbstrakRahasia adalah suatu hal yang dijaga dan tidak boleh diketahui banyak orang dengan adanya maksud tertentu. Rahasia juga dapat berkaitan dengan kondisi maupun rekam medis dari seseorang yang sedang sakit ataupun telah berkonsultasi dengan tenaga kesehatan terkait kesehatannya. Hal terkait rahasia identitas dan juga kesehatan pasien ini merupakan suatu aturan yang berkaitan erat dengan kode etik dokter, tenaga kesehatan dan juga rumah sakit yang di dalamnya mengatur tentang setiap dokter, tenaga kesehatan dan juga rumah sakit untuk menghargai Hak Asasi dari pasien terkait identitas dari pasien tersebut. Dalam keadaan pandemi virus covid-19 seperti saat ini, identitas pasien yang menjadi rahasia sedikit banyak mulai terekspos kepada publik, dimana identitas tersebut biasanya dibuka oleh masyarakat dan kemudian disebarluaskan kepada semua orang di sekitar masyarakat sebagai salah satu cara dan juga bentuk antisipasi dari masyarakat dalam menghalau penyebaran virus dari pasien yang sudah positif terinfeksi maupun dicurigai terinfeksi dari virus Covid-19 tersbut. Oleh karena itu penulis akan melakukan penelitian terkait adanya publikasi identitas pasien Covid-19 oleh masyarakat yang akan ditinjau dari perspektif hukum pidana. Penelitian menggunakan metode penelitian normatif yang dimana penulis akan mengkaji dari peraturan perundang-undangan terkait. Adapun hasil dari penelitian ini adalah data pasien dapat dibuka oleh pasien dan erintah pengadilan atau sesuai dengan kebutuhan medis. Dalam hal penyebaran data identitas dan rekam media oleh masyarakat dapat dikenakan pidana dan bagi tenaga kesehatan yang tidak dapat menjaga kerahsiaan data pasien akan dikenakan sanksi administrative.Kata Kunci: Publikasi; Identias; Pasien, Masyarakat

Penyandang disabilitas di Indonesia, sebagian besar hidup dalam kondisi rentan dan pengurangan atau penghilangan hak penyandang disabilitas. Untuk mewujudkan kesamaan hak dan kesempatan bagi penyandang disabilitas menuju kehidupan yang sejahtera, mandiri, dan tanpa diskriminasi diperlukan peraturan perundang-undangan yang dapat menjamin pelaksanaannya.Hak untuk memperoleh pendidikan merupakan hak asasi manusia yang dijamin dalam Pasal 31 ayat (1) Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. Namun dalam prakteknya, anak penyandang disabilitas sangat rentan untuk memperoleh perlakuan diskriminatif dalam memperoleh hak-haknya, khususnya hak atas pendidikan. Hal tersebut disebabkan oleh ketidak-samaan kondisi fisik atau psikis anak penyandang disabilitas. Anak penyandang disabilitas membutuhkan perlindungan dalam memperoleh pendidikan. Pendidikan yang diikuti oleh penyandang disabilitas berguna sebagai bekal dalam kehidupan yang semakin meng-globalberbasis teknologi.Berdasarkan hal tersebut, penulis memaparkan tentang bagaimana pengaturan mengenai hak pendidikan bagi penyandang disabilitas. Metode penelitian yang dipergunakan adalah penelitian yuridis normative. Kesimpulan dari artikel adalah hak pendidikan penyandang disabilitas telah diatur baik dalam konvensi internasional hak asasi manusia, International Covenant on Economic, Social, and Cultural Rights dan Convention on the Rights of Person with Disabilities dengan Resolusi 61/106, Pasal 28 C ayat (1) dan Pasal 28 E ayat (1) UUD NRI Tahun 1945.Hak atas pendidikan juga telah diatur dalam Undang-Undang Nomor 39 Tahun 1999 tentang Hak Asasi Manusia khususnya Pasal 12. Secara spesifik perlindungan hak penyandang disbilitas termasuk hak pendidikan terdapat dalam Undang-Undang Nomor 8 Tahun 2016 Tentang Penyandang Disabilitas. Selanjutnya, pengaturan di tingkat propinsi yaitu Peraturan Daerah Nomer 3 Tahun 2013 Tentang Perlindungan Dan Pelayanan Penyandang Disabilitas Di Jawa Timur. Begitu pula dengan Peraturan Gubernur Nomor 6 Tahun 2011 Tentang Penyelenggaraan Pendidikan Inklusi.

The problem of economic weakness, which until now hasn’t been resolved, creates conditions for the inability of the community to fulfill their welfare. The welfare includes the right to live a decent life, the right to obtain health, and the right to education. People’s welfare should be the responsibility of the states as the bearer of the obligation to fulfill the rights of every citizen. The right to health that is not fulfilled is a form of human rights violations. Because basically health is a pillar of a nation’s development. Health becomes a basic need for every human being. Judging from the many cases that occur in society as a result of the unfulfilled welfare, especially in terms of economy and health. So the author, in this case the author is interested in studying these problems by taking the case of Baby Deborah. The research method that the author uses is normative juridical, using law as the basis for research. In this case the writer also uses descriptive research method in the Longitudinal way. The data used are sourced from events in the community, as well as supporting statistical data. So from this research, it can lead to a conclusion that the people’s welfare should be the responsibility of the state. This is as stated in the 1945 Constitution of the Republic of Indonesia and is also contained in the International Economic, Social and Culture Convention. If the state is unable to create such prosperity, then the state is considered negligent and violates the human rights of its citizens. So from not achieving this welfare, there will be many rights that aren’t achieved, one of which is the right to health.

The current government can block Electronic System Operators through Regulation of the Minister of Communication and Information Number 5 of 2020 concerning Private Scope Electronic System Operators. However, this regulation does not regulate in detail. This study aims to find things that must be done whether they are in line with the principles of freedom and expression. By going through a normative approach method with the aim of answering issues based on the scientific side. The results of this study indicate that Permenkominfo No. 5 of 2020 is not in accordance with the principle of freedom of opinion and expression because the regulation related to the phrase "disturbing" does not have detailed indicators. So that if the government considers content to be troubling, the government can take repressive measures. Meanwhile, the troubling indicators in this regulation have not yet been developed. This is because freedom of expression and opinion is protected by applicable laws and cannot be contested. And it is necessary to look for new things related to the government's efforts to monitor and provide legal protection for personal data or privacy without limiting the rights of every citizen

Corruption is one of the causes of poverty in many countries, including Indonesia. Corruption causes state losses, so that the return of state financial losses must be carried out by corruptors to restore the Indonesian economy. The mechanism for recovering state financial losses has been regulated in Indonesia through criminal and civil channels. However, the implementation has not been optimally carried out by the State. Based on this, this study aims to determine the concept of civil forfeiture in returning state losses from corruption. The research method used is normative juridical. The results of the study state that in Indonesia the concept of returning state losses is based on criminal charges carried out by the Public Prosecutor and then executed by investigators, while the concept of civil forfeiture is carried out in a civil manner, where civil claims are carried out simultaneously with criminal charges. This is implemented in the United States, and in Indonesia it has the potential to apply it so that the return of state financial losses can be carried out optimally

Children in conflict with the law must be responsible for the violations/crimes committed, but also have the right to receive rehabilitation including social rehabilitation. This article aims to determine the concept of social rehabilitation for children in conflict with the law. As the Juvenile Criminal Justice System has regulated diversion and the rights of children as suspects. Children in conflict with the law must be held accountable for their actions either through formal legal processes or through diversion. In accountability through formal legal processes and diversion they get social rehabilitation rights, social rehabilitation is a process of re-functionalization and development so that a person is able to carry out his social functions well in social life. Social rehabilitation is an action taken against children who are in conflict with the law through diversion for children. If through the criminal justice process for children over 12 years old, the child will receive a determination of social rehabilitation measures at the Social Welfare Institution (LPKS) within a certain period of time with the supervision of social workers carried out under the Ministry of Law. and Human Rights (Kemenkumham).

Technology has made it easier to get the information we need, which is progress.However, the advancement of technology was also used as an opportunity for cybercrime during its development.As the emergence of cases of defamation, cases of hate speech, cases of hoax, cases of fraud pretended to be the buying and selling of online, cases of online prostitution, and the case other cybercrime, where is the moment, abuse of social media is facilitating the spread of cybercrime in the cyberspace?More than half of the bad people in 2018 came from social media, especially Facebook and Twitter.According to the findings of the study, social media abuse continues to contribute to the spread of cybercrime to this day.The majority of those who engage in cybercrime on social media, whether intentionally or unintentionally, will be subject to prosecution under the law No.11th year on electronic transactions and information (UU ITE).

There are so many cases of sexual violence that are not reported to law enforcement officials, or have even been reported but rejected. Among them is rape in marriage. This happens because sexual relations carried out in marriage are considered as common things that husbands do to their wives, because they occur in legal marriages. This study aims to determine marital rape as a crime. The research method uses normative juridical. This research approach uses legislation and conceptual. Based on research, marital rape has not been clearly regulated in the Criminal Code (KUHP). However, it has been regulated in Law Number 23 of 2004 concerning the Elimination of Domestic Violence (PKDRT). Meanwhile, the husband's actions towards his wife can be said to be marital rape if there are elements of coercion, threats, and violence without regard to the interests of the wife. This is reinforced by Islamic law, namely in the letter Al-Baqarah Verse 223

Migrant workers are one way to find income that is needed in everyday life. After the COVID-19 pandemic subsided, the interest in migrant workers increased again, due to the fact that their departure had been restricted before. With the large number of interested migrant workers, there are also increasing number of complaints of problems being overwritten by Indonesian Migrant Workers. The purpose of this research is to know and understand that the Indonesian government can have the authority to provide legal protection for Indonesian migrant workers who experience violence abroad. In this research, the journal uses normative methods and approaches to statutory regulations, as well as international conventions governing the Protection of the Rights of Migrant Workers and Family Members. The results of this study indicate that the protection provided by the government for migrant workers who experience violence can be carried out during pre-placement, placement, and post-placement, as well as the government's handling of migrant workers that must be carried out on Indonesian Migrant Workers both procedurally and non-procedurally. because the state has an obligation to fulfill the legal protection rights of every citizen

Marriage is a constitutional right owned by each person. The prohibition to marry as stated in the work agreement has positive and negative impacts on both employers and workers. With the qualifications regarding the prohibition on marriage given by the employer, it conflicts with the personal rights of workers, especially for contract workers or workers with PKWT status. Prohibition of marriage in work agreements made is the result of agreements made by employers and workers in unequal positions because workers need decent work to fulfill their daily needs. This study aims to find out about the validity of the rules prohibiting marriage for PKWT workers contained in the work agreement. This study uses a normative juridical method that uses primary legal materials in the form of legislation and secondary legal materials. The results of the study show that what is experienced by workers and employers in their daily lives often creates differences in interests that are quite serious so that the resolution also has the effect of experiencing differences between employers and workers. Work agreements that prohibit marriage remain valid according to the Civil Code. However, the agreements made are not based on the equal or weaker position of workers compared to the employer. The right to marry is a right that can be waived because workers prioritize the right to get a decent job, decent wages to meet basic needs. However, marriage should not be prohibited and employers should provide other options as a solution so that both workers and employers get their rights
