Abstract

The decision of the International Court of Justice in the cases of Sipadan and Ligitan Islands is to hand over the sovereignty of these to Malaysia. However, this decision only states the status of the island, not the status of the waters. Such a decision has created a new dispute, namely the dispute over maritime boundaries. The continental shelf boundary dispute occurred in 2005 due to Indonesia and Malaysia granting overlapping concessions to Unocal and Shell to explore the Ambalat Block. The problems formulated are how the provisions in UNCLOS 1982 to resolve maritime territorial disputes Indonesia and Malaysia in the Ambalat Block and the Sulawesi Sea after the decision of the International Court of Justice on the sovereignty of Sipadan Island and Ligitan. This study uses normative legal research whose approach is based on library materials or secondary data. The results showed that; First, the process of resolving territorial disputes (delimitation) in the Exclusive Economic Zone and the Continental Shelf through negotiation (Articles 74 and 83 of UNCLOS 1982). Second, the settlement of boundary disputes between the Exclusive Economic Zone and the Continental Shelf between Indonesia and Malaysia after the decision of the International Court of Justice on the sovereignty of Sipadan and Ligitan Islands needs to be followed up by the two countries, from the results of the study it appears that no agreement has been reached on this matter. However, both countries can submit disputes through mediation and or other dispute resolution facilities known in international law.

Abstract

Inheritance division can be a trigger for family conflicts that can strain relationships between siblings and may need to be resolved through legal channels. In Islamic law, adopted children do not have inheritance rights, but they can still receive a portion through gifts or compulsory bequests as long as it does not exceed one-third of the total assets of both parents. Compulsory bequests must be given to relatives or heirs who do not receive a portion of the inheritance from the deceased due to Sharia limitations that prevent them from receiving that inheritance share. Compulsory bequests are a form of fulfilling a trust given to someone who is left behind by dividing the inheritance among adopted children. Adopted children are prohibited from receiving a larger share of the inheritance than biological children. This is intended to provide protection for biological children. However, often these provisions are disregarded, becoming a source of disputes within families, such as the issue that occurred in Block Duku RT. 11/RW. 10, Kelurahan Cibubur, Kecamatan Ciracas, East Jakarta. Therefore, the PKM team provides education on inheritance law regarding adopted children, with a focus on the procedures for implementing the distribution of inheritance to adopted children through gift bequests that are in accordance with Islamic law, based on the lack of knowledge among Cibubur residents regarding inheritance issues that continuously cause disputes and conflicts. The implementation methods involve lectures and discussion sessions with the Cibubur youth community. The outcome of this activity is that residents understand how to resolve disputes over the division of inheritance to adopted children, which is through compulsory bequests according to Islamic rules. ABSTRAK: Pembagian warisan dapat menjadi pemicu konflik keluarga yang memecah belah hubungan antar saudara yang harus diselesaikan melalui jalur hukum. Dalam hukum Islam, anak yang diangkat tidak memiliki hak waris, namun mereka tetap dapat menerima bagian dari hibah atau wasiat wajibah asalkan tidak melebihi 1/3 total harta kedua orangtuanya. Wasiat wajibah harus diberikan kepada kerabat atau ahli waris yang tidak mendapatkan bagian dari warisan Pewaris karena ada batasan syariah yang menghalangi mereka menerima bagian warisan tersebut. Wasiat wajibah adalah bentuk pelaksanaan amanah yang diberikan pada seorang yang ditinggalkan dengan membagi warisan kepada anak angkat. Anak yang diangkat dilarang mendapatkan bagian warisan yang lebih besar dari anak kandung. Hal ini bertujuan untuk memberikan perlindungan anak kandung. Namun, seringkali ketentuan ini diabaikan, dan menjadi sumber perselisihan dalam keluarga, yang mana masalah ini terjadi di Blok Duku RT. 11/ RW. 10, Kelurahan Cibubur, Kecamatan Ciracas, Jakarta-Timur. Oleh karena itu tim PKM memberikan penyuluhan tentang hukum waris terhadap anak angkat yang pembahasannya akan berfokus pada tata cara pelaksanaan pembagian waris kepada anak angkat melalui hibah wasiat yang sesuai dengan hukum Islam yang didasarkan karena kurangnya pengetahuan warga Cibubur terhadap permasalahan hak waris-mewaris yang secara terus menerus menimbulkan persengketaan dan perselisihan. Metode pelaksanaan yang dilakukan adalah dengan ceramah dan sesi diskusi bersama warga karang taruna Cibubur. Hasil dari kegiatan ini adalah warga memahami cara mengatasi sengketa pembagian warisan kepada anak angkat yaitu melalui wasiat wajibah sesuai aturan Islam
