Abstract

A good international contract as the experts considered is the most complicated one the parties must draft carefully. It involves many stakeholders and containing documents to attach likewise financial judgment, technical specifications, work scope, rights, obligation, responsibility and other external factors which are beyond the parties’ consideration. A good design contract will prevent the parties from disputes. The dispute settlement mechanisms should be explicitly stated in the international construction contract. The nullity of the choice dispute settlement mechanisms or in the absence of the choice dispute settlement mechanisms and also the unperformed of the contract purposes will not prevent the dispute from being occurred. The most common process to resolve disputes is through litigation, but the process takes time, energy and funding. The method of alternative dispute resolution (ADR) such as mediation, conciliation, mini-trial, arbitration or other ADR techniques eradicate all the obstacles above. The question arises then, how the parties select the best alternative disputes settlement mechanism and how it should be drafted in their contract. Normative legal research is the method employed to respond the problems. Therefore, this article will elaborate the methods that will effectively settle the constructions disputes and mechanism in drafting construction contract disputes resolutions provisions

Abstract

Land fires in South Sumatra are an annual problem during the long dry season. It was recorded that in 2015, 2016, 2017, and 2018, the land fires spread massively in the four districts of South Sumatra. The peatlands located within oil palm plantations in the Districts of Ogan Komering Ilir, Banyuasin, Musi Banyuasin, and the district of Ogan Ilir were the source of the fire. The haze not only attracts national but also international attention. Besides human contribution to land fire, climate change should also be considered. The role of El Nino makes the season uncertain. Land fires affect human health and other human activities in the affected areas. Three legal instruments guarantee and protect the people's right to the environment, i.e., The 1945 Indonesian Constitution, the 2009 Law No. 32 on the Environment, and the 1999 Law No. 39 on Human Rights. The problem raised herein is to what extent people can claim the right to a clean environment as human rights guaranteed and protected in those legal instruments. The results of the discussion show that those three legal instruments do not protect people whose human rights have been violated. This is because 2000 Law No. 26 on Human Rights has no jurisdiction over environmental matters. It is suggested that establishing a special Environmental Court is the solution to protect community environmental human rights cases.

Abstract

Abstrak: Tanah merupakan suatu faktor yang sangat penting dalam kehidupan manusia, sejak lahir manusia membutuhkan tanah untuk berbagai kebutuhan baik untuk keperluan tempat tinggal, usaha pertanian, kegiatan sosial dan lain-lain. Keadaan yang demikian mengakibatkan banyaknya kejahatan maupun pelanggaran terhadap penguasaan tanah. Penelitian ini membahas tentang penegakan hukum yang dilakukan oleh penyidik Unit 3 Subdit II Ditreskrimum Polda Sumsel terkait tindak pidana pemakaian tanah tanpa izin berdasarkan UU Nomor 51 Prp Tahun 1960 di Kabupaten Banyuasin dan kendala yang dihadapi oleh penyidik dalam penegakan hukum tindak pidana pemakaian tanah tanpa izin. Metode Penelitian yang digunakan adalah yuridis empiris, dengan pendekatan studi kasus (case approach) dan pendekatan konseptual (conseptual approach). Dari hasil penelitian bahwa penegakan hukum tindak pidana pemakaian tanah tanpa izin di Kabupaten Banyuasin sebagaimana di atur dalam Pasal 6 UU Nomor 51 Prp Tahun 1960 tidak menimbulkan efek jera, sehingga perlu dilakukan upaya penegakan hukum agar lebih efektif dan efisien di masa yang akan datang.  Kata Kunci: Penegakan hukum;Tindak Pidana Pemakaian Tanah Tanpa Izin

Abstract

The target population of this study is the students of Indralaya Public Highschool Number 1. According to UNICEF data from 2022, 45% of 2,777 children in Indonesia have admitted to being victims of cyberbullying. Therefore, it is necessary to provide legal counseling and prevention of cyberbullying to teenagers, especially high school students. A survey conducted by the Ministry of Women and Child Protection in collaboration with Child Fund International in 2023 revealed that 49.1% of adolescents in DKI Jakarta, Central Java, Lampung, and East Nusa Tenggara (NTT) admitted to being bullies, while 51% acknowledged experiences as victims of bullying. The service method entails the provision of counseling on the prevention of cyberbullying on social media among students in alignment with Law No. 1 of 2024 concerning the Second Amendment to Law No. 11 of 2008 concerning Electronic Information and Transactions.Moreover, the question and answer method was employed to ascertain the extent of students' comprehension of the material presented. The ensuing conclusion, substantiated by the students' inquiries and responses, indicates a persisting lack of comprehension regarding the impact and prevention of cyberbullying, particularly in the context of social media misuse.
