Abstract

AbstractThe discourse on the progressive law blows up recently. Theassumption which declared that “law is for human” strengthened the progressive law position. This progressive law condition contradicts to the positive law which pretend to be formalistic. The law environment in Indonesia which is coloured with crisis of distrust makes the idea of progressive law accepted enthusiasticly. While the view that “law as a process, law in the making” takes the idea of progressive law as an actual thing. The problem is that the progressive law has not been established a theory yet. It still need to be explored intensively. This passage examines the progressive law in the perspective of philosophy of science, because whatever theory or sosial movement must have had a philosophical ground. Keywords: The progressive law, Perspective of philosophy ofscience

Abstract

Pancasila—as a representament, interpretant and object—facing a dillematic problem in connection to ideal and a utopiavalues that desired by the founding fathers and undesired activitiesin the real life. Pancasila—as an icon, index and symbol that oughtto give oportunity for other interpretation, so we do not fall into amonolitic interpretation that makes Pancasila become a trivialthing, as in New Era.  The power of Pancasila does not lay at themeaning that gave by political elite all, but it depends on allcommunity involvement to belong to Pancasila as a glorioustreasure of Indonesian nation that open to spirit and developmentof the age. Notonagoro is a Pancasila homo significandum for hisattempt to reinterprate national ideology philosophically. He hasused substanstialistical analyzis with refer to the principle words ofeach principles (God, man, one, people, and justice) was anintelligent attempt to placed Pancasila in the abstract, general anduniversal meaning. His concept of Pancasila—abstract, general anduniversal—described the triadic of representament, object andinterpretant.

Abstract

This study is an attempt to re-question the base arguments forsustainable developmentproposal with regardto environmental management. This attempt is important considering intensive deploymemt of cost and benefit calculations in every environmental management policy, which rooted in the utilitarian philosophical tradition. This research runs in the area of political philosophyandemploys methodical components includingdescription, interpretation, critical analysis, and verstehen. The current research suggests that the emergence of sustainable development as a concept of environment management goes along with modernity with all issues that it brings. The proposal of sustainable developments can be categorized into constructive postmodernismapproach. The main purpose of this proposal is to create a condition of balance between the needs of the present generation and the adequacy of the needs of the future generations. However, the concept appears to raise a new concern considering the meaning of “sustainability”has become contestation with strong tendency to economicconsideration which reduces the calculation of cost-benefits into cash-value calculations. This reductionis tendency leads to a dilemma considering the aspiration of shiftinganthropocentrism to ecocentrismunderlying behind concept of sustainable development will ironically produce a new forms of anthropocentrism.

Abstract

AbstractAccording to Wilhelm Dilthey’s hermeneutic perspective, there are six points in reinterpreting the Minangkabau’s traditional aphorism “Urang sabana urang”. First, understanding of Minangkabau’s way of life is a general process, included in an ordinary life which is expressed in the aphorism. Second, theexpression of the aphorism is called “ausdruck”, Minangkabau’sexpression of life experiment and historicity. Third, humancharacteristics in Minangkabau’s aphorism consist of: “urang,urang-urang, tampan urang, angkuh-angkuh urang, urangurangan, urang sabana urang”. Fourth, “urang sabana urang” is a man who has excellent characteristics. Fifth, the globalization influence and the modern culture have changed Minangkabau’s insight of “urang sabana urang” concept so that it needs a reinterpretation in order to be understood by youth of Minang. Sixth, the epistemological dimension in Minangkabau’s aphorism synthesizes an empirical aspect and rationality. The metaphysical dimension of the aphorism shows a relation between tradition and religion so that it arise the principle of “adat basandi syarak, syarak basandi kitabullah”. The axiological dimension in the aphorism is seen as a criterion of values which is an obligation for Minangs to prevent their identity as” urang sabana urang”.Keyword: urang sabana urang, adat basandi syarak, syarakbasandi kitabullah, Minangkabau custom aphorism.

Abstract

This article explores the crisis narrative surrounding the erosion of democracy in Indonesia, with a particular emphasis on political and ethical responsibilities. It examines the prevailing consensus on the consequences, factors, and conceptualization of democracy, especially concerning political trust and ethical governance. The discussion underscores how democracy evolves by deconstructing and reshaping societal structures, drawing on Kantian philosophy and the core pillars of democratic society. The paper highlights the inherent flaws in democratic principles, demonstrating how these imperfections permit varying degrees of freedom within societal practices. It advocates for the value of cultivating a culture of open, public discourse aboutcollective societal objectives. However, it also points out that the actual practice of lawmaking, implementation, and enforcement often deviates from its doctrinal ideals, particularly when the law’s purported impartiality contrasts with its impact on marginalized communities. These inconsistencies are examined as outcomes of the exercise of political power, illustrating that the law is shaped by political morality and legitimacy rather than being wholly independent. Furthermore, the article delves into the decline of democracy by engaging in dialogue about the process of its deterioration, rather than simply questioning the reasons behind it. This study also explores democracy and philosophy both in theory and practice, framing law as a reflective inquiry into the democratic process. Ultimately, it advocates for the political concepts of democracy to be subjected to scientific analysis and validation.
