Abstract

A child is a human being under the age of eighteen who is considered unable to distinguish between goodand bad deeds. So that a child protection law is formed which specifically regulates how a child isprotected by his rights and obligations before becoming a person who is considered capable as a legalsubject. From these regulations, children are also protected from sexual crimes committed by force andthreats of violence, but children are also protected from seduction or committing a series of lies so thatchildren can become a place to release someone's sexual desires. Therefore, there are rules that alsoregulate persuasion, deception, or a series of lies that have been regulated in the Child Protection Law, sothat if such an incident occurs, it must be prosecuted with an appropriate article between the act and theelements in it. article.This regulation is also one way to provide justice between victims and perpetrators ofcrimes.

Abstract

The Criminal Procedure Code adheres to the principles contained in the provisions stipulated in Articles 50 to 64 ofthe Criminal Procedure Code which can be concluded as the rights of the suspect or defendant. Among the rights ofa suspect or defendant is the right to obtain legal assistance from legal counsel which can be provided at every levelof examination and in the context of rapid distribution of justice for everyone which is carried out quickly, cheaplyand simply. In the practice of implementing litigation, the provision of legal assistance to the community is often notcarried out. One of them is in the case that the author will discuss, the Decision of the Class II A TembilahanDistrict Court number 215/Pid.Sus/2019/PN Tbh which sentenced Kamarek bin Ruslan to 6 years in prison and afine of Rp. 3 billion, subsidiary to 6 months in prison. In the a quo trial, the Defendant who is an illiterate person isnot accompanied by a Legal Counsel so that he cannot fight for his rights as a Defendant. In this paper, the authorwill examine the legal consequences that arise in the court process where the defendant is not accompanied by alegal advisor, as well as legal protection for the rights of the defendant who is not accompanied by a legal advisorduring the trial.

Abstract

Handling corruption in the Republic of Indonesia is more appropriate to use non-penal policies or those that are more concerned or inclined to efforts to prevent corruption which are directed at reducing opportunities to commit criminal acts of corruption, such as the report on the assets of state administrators, hereinafter referred to as LHKPN by every state institution, either executive, legislature and judiciary both at the central and regional levels so that state administrators get supervision in terms of assets so that this can reduce the potential for committing criminal acts of corruption. So far it has not been effective, besides that non-penal facilities can also reduce the number of corruption in Indonesia, therefore one form of prevention that can be intensified by the KPK is socialization about the dangers of corruption or by using n monitor all forms of cooperation carried out by every state institution, by attending every signing of cooperation agreements so that all budgets or funds launched can be accounted for properly, because if anti-corruption socialization continues to be intensified, it is not impossible to clean up the republic. Indonesia is from a corruption case which is dominated by state administrators, who should provide a good example of living the life of a nation and state to the community.

Abstract

Rape is increasingly occurring with perpetrators who are unaware of the place and time. Protecting minors who become victims is a government priority. This study uses a normative research method, referring to primary and secondary legal sources. Law Number 35 of 2014, which amends Law Number 23 of 2002 concerning Child Protection, regulates legal protection for child victims of rape. Victims can file for restitution, receive medical assistance, and undergo psychosocial rehabilitation. Rapists can be sentenced to a maximum of 15 years in prison and a minimum of 5 years, as well as fined up to Rp.5,000,000,000.00. Therefore, it can be concluded that child rape victims receive strong legal protection under the Child Protection Law. Additionally, they also receive the necessary assistance for physical and psychological recovery. On the other hand, rapists face severe sanctions commensurate with the crime committed. This research has important implications for raising public awareness about the importance of protecting child rape victims and ensuring consistent enforcement of existing laws.

Abstract

Indonesia is a legal state which consists of various rules to provide protection, security and welfare for its people. Especially regarding the rights of every person, such as the rights that every person gets when he is in his parents' womb, namely Human Rights, but not throughout a person's life it is guaranteed that his rights will not be disturbed or injured by other people, such as cases of sexual harassment received by children, both boys and girls. This research uses a normative type of research. In Indonesian law there are regulations that regulate the death penalty for perpetrators of abuse or rape of children. There are various pros and cons to this regulation because the imposition of the death penalty sanction is also a violation of a person's right to life which is regulated in Human Rights.

Abstract

LPSK, sebagai lembaga yang berdiri berdasarkan Undang-Undang Nomor 13 Tahun 2006 yang diubah menjadi Undang-Undang Nomor 31 Tahun 2014 tentang Perlindungan Saksi dan Korban, memiliki tugas dan wewenang untuk memberikan perlindungan dan bantuan kepada saksi dan korban. Namun, kendala dan tantangan muncul terutama terkait dengan pemenuhan hak korban, seperti restitusi dan kompensasi. Penelitian ini bertujuan untuk menganalisis peran Lembaga Perlindungan Saksi dan Korban (LPSK) dalam melindungi saksi dan korban kekerasan seksual di Indonesia. Metode penelitian yang digunakan adalah analisis dokumen resmi, termasuk undang-undang, regulasi, laporan LPSK, dan kebijakan terkait lainnya. Hasil analisis tersebut memberikan pemahaman mendalam tentang kerangka kerja dan implementasi perlindungan saksi dan korban Dalam laporan tahunan LPSK, terlihat peningkatan jumlah korban kekerasan seksual yang mendapatkan restitusi. Meski demikian, evaluasi terhadap prosedur pengajuan restitusi perlu dilakukan agar lebih transparan dan cepat. Selain itu, LPSK perlu melakukan advokasi yang lebih efektif terhadap aparat penegak hukum untuk memastikan pemberian fasilitas restitusi sesuai dengan kebutuhan korban.

Abstract

Demokrasi adalah pemerintahan dari rakyat, oleh rakyat, dan untuk rakyat. Hal ini diucapkan oleh Abraham Lincon di dalam pidatonya di Gettysburg, Pennsylvania, 19 November 1863. Belau mengatakan “Democracy is a government of the people, by the people, and for the people”. Indonesia merupakan salah satu negara yang menerapkan sistem demokrasi. Hal ini dapat dilihat dalam Pancasila dan Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. Salah satu bentuk Demokrasi di Indonesia adalah dengan dijalankannya Pemilihan Umum dimana warga negara Indonesia memiliki kesempatan untuk menentukan pemerintahan itu sendiri. Oleh karena itu jalannya sebuah Pemilihan Umum harus lancar, adil, dan transparan. Dalam jalannya Pemilihan Umum sudah dipastikan akan terjadinya sebuah pelanggaran, salah satu dari pelanggaran tersebut adalah pelanggaran pidana Pemilihan Umum. Proses penanganan perkara pelanggaran pidana Pemilihan Umum tercantum di dalam Undang-Undang No. 7 Tahun 2017 tentang Pemilihan Umum Pasal 476. Berdasarkan Teori Efektivitas Hukum dan Teori Keadilan terjadinya kelemahan dalam proses penanganannya, dapat di lihat dari waktu penanganan yang cenderung singkat dengan proses yang cukup Panjang dan rumit. Hal tersebut menyebabkan terhambatnya penyampaian keadilan kepada para pelapor atau orang-orang yang percaya bahwa telah terjadinya pelanggaran tersebut, hal ini dapat dikatakan sebagai tidak tersampaikannya keadilan atau keadilan yang terlambat sama denga ketidakadilan. Hukum seharusnya bersifat Lex nemini operatur iniquum, neminini facit injuriam atau hukum tidak memberikan ketidakadilan kepada siapapun dan tidak melakukan kesalahan kepada siapapun.

Abstract

This research aims to evaluate the effectiveness of women's protection institutions in Indonesia, such as the National Commission on Violence against Women, in providing support and services to victims of sexual harassment. This research also identifies the obstacles and challenges faced by these institutions in carrying out their functions. The research methods used include qualitative analysis of reports, interviews with women's protection agency staff, as well as literature reviews regarding women's protection policies and practices in Indonesia. The research results show that Komnas Perempuan and similar institutions have demonstrated a strong commitment to supporting victims of sexual harassment through various services, including psychological counseling, legal aid, and assistance during the legal process. In addition, education and public awareness campaigns conducted by these institutions have helped change society's views on sexual violence. However, the effectiveness of these services is still limited by obstacles such as limited resources, social stigma, and challenges in law enforcement.

Abstract

Abortion is a public health problem because it has an impact on maternal morbidity and mortality. As is known, the main causes of death for pregnant women and giving birth are bleeding, infection and eclampsia. However, abortion is actually also a cause of maternal death, only in the form of bleeding complications and sepsis. Abortion, which we often know as the act of aborting a pregnancy, is basically an act that is iprohibited in indonesia. In ithe Criminal Code, regulations regarding abortion are included in the chapter on crimes against life. Criminal responsibility is based on if there is a iviolation of norms and there are sanctions, then there will be responsibility. The iudge in determining criminal responsibility is based on the indictment and the facts in the trial and the fulfillment of the "intentional" element. The basis for the judge's consideration in handing down a decision in the crime of abortion is based on many things, including the evidence presented, the statements of witnesses and the defendant, and the indictment submitted by the public prosecutor.

Abstract

This research analyzes the effectiveness of the implementation of Supreme Court Regulation (PERMA) no. 1 of 2016 in resolving civil cases at the Denpasar District Court Class IA through mediation. The research uses empirical legal methods, with a statutory approach to analyze legal principles and a factual approach to describe the practical implementation of mediation. Data was obtained through interviews, observations and document studies, and analyzed descriptively qualitatively to understand the empirical reality, views and constraints from various perspectives, including judge mediators, disputing parties and private mediators. The research results show that although mediation increases the efficiency of the dispute resolution process, its success is still low compared to the number of cases submitted, due to the limited number of certified mediators and lack of public understanding. Recommendations include increasing mediator training, outreach on the benefits of mediation, and adoption of technology to increase efficiency and accessibility.
