Abstract

Based on the Badung Regency Regional Regulation Number 8 of 2014 concerning the Implementation of Employment Services in article 11 of the perda, it states that companies provide opportunities for local workers, with the company's needs without compromising labor competency standards. The theory of effectiveness is used to dissect and analyze aspects of the benefits of local labor recruitment with the theory of Economic Analysis of Law where the data obtained are data from field research. From the description above, two problems are obtained, related to the effectiveness of the Badung Regency Regional Regulation Number 8 of 2014 on the recruitment of local workers from the perspective of the Economic Analysis of Law and the inhibiting and supporting factors of the effectiveness of the Regional Regulations. The method in this research is empirical legal research, descriptive nature with the type of real behavior approach and statutory approach. Sources of data used are primary data and secondary data, data collection techniques by observation, interviews and documentation studies. Determination of the research sample used is positive sampling. The data analysis used is qualitative analysis. The recruitment of local workers to companies in the Kerobokan Traditional Village was declared effective because each company made sure that local workers were well absorbed. However, the ineffectiveness was found because the percentage of the agreement between the Kerobokan Traditional Village and the company was that 40% of the local workforce was not fulfilled.

Abstract

Abstract The process of producing goods and services, workers in this case cannot be released in the role of their duties and functions. Not only is it a very valuable asset and cannot be separated from the ongoing business activities. Companies and workers have a very close relationship. Companies rely on workers for the successful production process. Without the role of these workers, the production process will not be good and will not even be able to run. Therefore, there is a need for legal awareness by business actors in protecting the rights of their workers so as to maintain to increase the productivity and stability of the company. Such protection can be done by providing guidance, recognition of human rights, protection of physical and non-physical and socioeconomic through applicable norms and in accordance with the mandate of the Indonesian Repuplik State Constitution of 1945. This research is a normative legal research, namely by examining library materials by conducting a study of the laws and regulations relating to workers' rights in making work agreements. Law No. 13 2003 concerning Manpower is a legal material that the author uses in obtaining data for research.The conclusion of this research is that a fixed-term work agreement is a job based on the type and period of completion of a job. Every worker in a work agreement for a specified period of time has the right to become an employee with an unspecified time work agreement. Unilateral termination of a work agreement for a specified period of time may result in the provision of compensation. The benefits provided to workers in a work agreement for a specified period of time must be in accordance with statutory regulations.

Abstract

Tunjangan Hari Raya Keagamaan diatur dalam Peraturan Menteri Ketenagakerjaan Nomor 6 Tahun 2016 Tentang Tunjangan Hari Raya Keagamaan Bagi Pekerja/Buruh di Perusahaan. Faktanya para pekerja di Kopi Made tidak mengetahui adanya peraturan yang mengatur tentang tunjangan hari raya keagamaan, berdasarkan hal tersebut maka rumusan masalah yang diangkat adalah bagaimanakan mekanisme pemberian tunjangan hari raya keagamaan bagi pekerja/buruh di perusahaan Kopi Made Denpasar dan apakah akibat hukum apabila dalam pemberian tunjangan hari raya tidak sesuai dengan Peraturan Menteri Ketenagakerjaan. Tujuan dari penelitian ini untuk mengetahui bagaimanakah mekanisme pemberian tunjangan hari raya keagamaan di Kopi Made dan apakah akibat hukum apabila dalam pemberian tunjangan hari raya keagamaan tidak sesuai dengan peraturan yang berlaku. Jenis penelitian ini menggunakan penelitian empiris. Kesimpulan dalam penelitian ini adalah mekanisme pemberian tunjangan hari raya keagamaan di Kopi Made sudah terlaksana dengan pemberian 2 (dua) kali dalam setahun yaitu menjelang haru raya Galungan, namun jika melihat peraturan yang berlaku maka dengan pemberian tunjangan hari raya keagamaan di Kopi Made belum sepenuhnya sesuai dengan Peraturan Menteri Ketenagakerjaan. Akibat hukum jika dalam pemberiannya tidak sesuai dengan peraturan menteri ketenagakerjaan adalah adanya sanksi dan denda administratif sebesar 5% dari total jumlah tunjangan hari raya yang harus di bayarkan oleh pengusaha kepada . jika terjadi permasalahan yang tidak bisa terselesaikan oleh para pihak yang bermasalah maka dapat menyelesaikan perselisihan hubungan industrial melalui jalur alternatif penyelesaian sengketa di luar pengadilan atau melalui pengadilan hubungan industrial pada pengadilan negeri masing-masing wilayah hukum. In fact workers in Kopi Made is not aware of any rules that govern about a religious feast day allowances, based on the outline of the issues raised was how the mechanism the granting of allowances for the workers of the religious holy days/labor in Kopi Made Denpasar companies Are legal consequences if the granting of alimony the feasts are not in accordance with the regulations of the Minister of Employment. The purpose of this research is to know how the mechanism of granting allowances religious feast day in Kopi Made and whether the legal consequences when in granting religious feast day allowance is not in accordance with the regulations. This type of research using empirical research. Conclusions in this study is the mechanism of granting allowances religious feast day in Kopi Made already concluded with the grant of 2 (two) times a year, namely towards the Galungan day fair, but if you look at the regulations thus the grant of the allowance in the religious feast of Kopi Made is not fully in accordance with the Regulations of the Minister of Employment. Legal consequences if in his deed incompatible with the regulation of the Minister of employment is the existence of administrative fines and sanctions amounting to 5% of the total amount of alimony the feasts that must be paid by the employers to the. If there is a problem that cannot be resolved by the parties then can complete the troubled industrial relations disputes through the alternative dispute resolution outside of court or by the Court of industrial relations in the District Court of each jurisdiction

Abstract

The design of bone carving crafts in Tampaksiring tourist village of Gianyar Regency needs to be protected to ensure the protection of the rights of the designer and establish its rights and obligations as well as to keep unauthorized parties from misusing the industrial design. This is in accordance with Article 10, 11, 12 of Law Number 31 Year 2000 on Industrial Design. However, in its implementation, not all bone designs have received protection of Industrial Design Rights, so it is important to raise the issue: Implementation of Registration of Industrial Design Rights to obtain Legal Protection of Bone Carving Crafts in Tampaksiring Tourism Village. This study aims to analyze the legal protection of industrial design rights against bone carving crafts in Tampaksiring tourism village. The formulation of the problem in this study is 1). How is the implementation of industrial design rights registration against bone carving crafts in Tampaksiring tourist village, Gianyar regency? 2). How is the effectiveness of legal protection of industrial design rights to bone carving crafts in Tampaksiring tourist village, Gianyar regency. This research method uses the type of empirical legal research with qualitative analysis, with Non-Probability Sampling technique and by using Purposive sampling method which is described by using the theory of legal effectiveness, the theory of legal position, the theory of legal authority and the theory of legal protection. The conclusion of this study is the implementation of industrial design registration of bone carving crafts in Tampaksiring tourist village of Gianyar Regency is evident from the small awareness of individual craftsmen to register industrial design rights of craft products produced due to factors affecting the implementation of industrial design registration in the bone craft industry in Tampaksiring tourist village of Gianyar Regency, due to lack of awareness of craftsmen and lack of coordination and socialization regarding the importance of registration of industrial design rights to obtain legal protection. The effectiveness of legal protection of industrial design rights to bone carving crafts in Tampaksiring tourist village is not effective and optimal, it is caused by the mindset of craftsmen who think the process of registering industrial design rights is not too important and does not really affect the production of crafts produced, so that when a problem arises related to violations of industrial design rights in this case plagiarism of bone carving designs, then the law does not have the authority to take action against such violations and legal protection of the carving crafts cannot be realized because the bone carving crafts do not have legal legality. Bone Carving Craftsmen in Tampaksiring Village, Gianyar Regency think that the Certificate of Industrial Design Rights has not guaranteed legal protection for holders of industrial design rights which are their exclusive rights so that there are still many doubts of craftsmen who think that registration of industrial design rights is not too important to do

Abstract

Kegiatan pengabdian kepada masyarakat ini bertujuan untuk meningkatkan pemahaman aparat desa dan elemen masyarakat di Kecamatan Klungkung terkait hukum dan tata kelola dana desa guna mencegah potensi penyimpangan. Berdasarkan Undang-Undang Nomor 6 Tahun 2014 tentang Desa dan regulasi turunannya, pengelolaan dana desa harus dilakukan secara transparan, partisipatif, akuntabel, dan tertib anggaran. Namun, masih dijumpai kendala di tingkat desa, seperti perencanaan yang tidak tepat, kesulitan menyusun APBDes karena keterlambatan pagu anggaran. Melalui pendekatan edukatif dan dialogis, tim pengabdian memberikan pendampingan intensif terkait regulasi terbaru, mekanisme penyusunan APBDes, pengawasan penggunaan dana desa, serta pelaporan keuangan desa. Kegiatan ini sejalan dengan misi Asta Cita Presiden Dan Wakil Presiden Republik Indonesia, yaitu meningkatkan kualitas tata kelola pemerintahan desa dan mewujudkan pembangunan yang merata dan berkeadilan. Hasil kegiatan menunjukkan peningkatan pemahaman hukum pengelolaan dana desa di kalangan peserta, serta tumbuhnya komitmen untuk menerapkan prinsip transparansi dan akuntabilitas dalam pelaksanaan anggaran desa.
