Abstract

WHO states that the Covid-19 virus is a pandemic, so the Indonesian government has implemented various policies to break the chain of spread of COVID-19. The prohibition of gathering or gathering is one of them, so everything must be done online and done at home. This pandemic has had a very bad impact on economic sustainability, many people have experienced a decline in income due to the Covid-19 pandemic, and many have even lost their jobs. One of the economic sectors that is feeling the impact of the pandemic is Small and Medium Enterprises (SMEs). The Deva Bag SMEs is no exception in Jiken Village, Tulangan District, Sidoarjo Regency. With the current pandemic conditions, of course, SMEs must survive so an alternative marketing strategy is needed. Therefore, strategies such as digital marketing are needed which include sales through social media to marketplaces in an effort to increase SME turnover. So this research was conducted with the aim of providing education about digital marketing to Deva Bag SMEs in Jiken Village, Tulangan Regency. The method used is interviews and action research in the form of counseling and education about digital marketing. The activity was carried out properly and regularly, Deva Bag SMEs Desa Jiken was very enthusiastic about wanting to know more about the digital marketing system/strategy.

Abstract

The law Number 23 of 2004 on the elimination of violence in household outlaws violence occurred within domestic sphere or is committed by relatives such as husband. The law acknowledges violence within domestic sphere as a punishable crime. It covers physical, psychological, economic and sexual violence. The law is enacted due to concern on high occurrence of domestic violence and the absence of law specifically addresses the problem. Even though the law can be considered an improvement in gender discourse within Indonesia, there are still many flaws to be put forward, especially from gender perspective. On the other side, the law encounters controversy since some Muslims regard it a violation to Islamic values. This paper analyzes the law from two perspectives; gender and Islam. From gender perspective, this law is a gender-aware policy and therefore can be regarded as a positive development in struggles over women’s rights. Moreover, this law also acknowledges that denying women’s access from economic sources including the right to work outside the house is also violence in term of economic limitatiton. On the other hand, the law is not a gender redistributive policy since it does not deconstruct division of roles between husband and wife. From Islamic perspective, the law actually is actually in accordance to principles and values in Islam. Islam prohibits violence and ensures protection on women’s rights in all aspects; physical, physcological, sexual and economic. To sum up, in spite of certain shortcomings, the law is actually a remarkable achievement in struggles over the improvement of women condition. In addition, with a good understanding on more just interpretation on some related religious texts, Islam actually promotes a peaceful and just relation in a household in particular and between man and women in general.

Abstract

Penelitian ini bertujuan memahami faktor-faktor yang melatarbelakangi praktik pernikahan endogami dalam keluarga pondok pesantren di Kabupaten Tuban. Pernikahan endogami, yaitu pernikahan antara individu yang berasal dari lingkungan suku, etnis, atau status sosial yang sama, menjadi menarik untuk diteliti karena fenomena ini, dalam beberapa kasus, mencapai titik ekstrim seperti pengasingan atau paksaan untuk menikah kembali jika dianggap tidak memenuhi kesetaraan sosial. Metode penelitian yang digunakan adalah kualitatif deskriptif dengan subjek penelitian meliputi pasangan suami istri yang menikah secara endogami dan lima orang tua yang menikahkan anak mereka dalam pola yang sama. Hasil penelitian mengidentifikasi empat faktor utama yang mendorong praktik pernikahan endogami, yaitu: (1) tradisi turun-temurun dalam keluarga pondok pesantren, (2) perjodohan oleh keluarga, (3) cinta di antara pasangan yang sebelumnya dikenalkan melalui proses taaruf, dan (4) keinginan untuk mempererat hubungan keluarga serta menjaga kemurnian garis keturunan. Selain itu, praktik ini dianggap bermanfaat dalam menjaga nasab dan melanjutkan estafet kepemimpinan pondok pesantren. Simpulan dari penelitian ini menunjukkan bahwa pernikahan endogami di lingkungan pondok pesantren didorong oleh tradisi dan nilai-nilai tertentu yang memiliki manfaat sekaligus tantangan, yang perlu ditinjau secara mendalam dalam perspektif hukum Islam, baik secara normatif maupun melalui pertimbangan maslahat dan madharat.

Abstract

Abstract: One issue that remains a stumble block for modernization of Islamic family law is polygamy. In Indonesia, polygamy is restricted, but not completely forbidden. Husbands who have desires for polygamy should fulfill requirements before the court of justice. However, there is a tendency among judges of Islamic courts nowadays to grant permission for them to practice polygamy although not all of those husbands meet the requirements as outlined by the Marriage Law. The judges argue that according to Article 5 the Law No. 48 of 2009 concerning Judicial Authority they have the right and are obliged to deliver justice at all costs. Therefore, they grant permission for polygamy not only on the basis of the corresponding the Law No. 1 of 1974 on Marriage, but also on the authority of rechtsvinding, Islamic jurisprudence or fiqh as living law concept, and contra legem theory, a progressive implementation of legal value. Abstract

Enhancing English speaking skills is crucial for global communication, particularly at Santi Witya Serong School in Thailand. This study implements the English Competition Program as an innovative strategy distinct from conventional learning by incorporating competition-based and interactive activities. The research examines its effectiveness in improving students’ speaking skills and confidence. Applying Asset-Based Community Development (ABCD) theory, the program utilizes school resources—teachers, students, and learning culture—as key assets for language development. Using a qualitative approach, data were collected through observations, interviews with teachers, and document analysis of competition results. The program includes three competitions: spelling bee for grades 1–2, guessing vocabulary for grades 3–4, and introduction speaking for grades 5–6. The findings indicate that competition-based learning significantly improves English proficiency in the form of speaking and confidence. The study recommends continuous implementation and evaluation to optimize the program. This study presents a novel approach, demonstrating that competition-driven methods can effectively enhance students’ communication skills.

Abstract

'Urfi marriage is a practice of unofficial marriage that is recognized religiously but not recorded by the state. This phenomenon becomes a legal issue in various Muslim countries, including Egypt and Malaysia, which have different approaches. This article aims to compare the legal status of ‘Urfi marriage in Egypt and Malaysia, analyze its implications for the protection of women's and children's rights, and examine the legal proof consequences due to the lack of registration of such marriages. Using a normative-comparative legal research method with legislative and conceptual approaches, this study analyzes primary legal instruments from both countries as well as fiqh literature and relevant jurisprudence. Research results show that Egypt recognizes ‘Urfi marriages as legally valid in terms of religion but has required registration since 2000, whereas Malaysia does not legally recognize ‘Urfi marriages because they do not meet mandatory registration requirements. This difference has a significant impact on protecting wives' rights regarding alimony, children's identity, inheritance, and protection from domestic violence. This study concludes that the lack of registration in ‘Urfi marriages weakens the legal position of women and children, so there is a need to harmonize religious law and civil law to ensure substantive justice.
